IIThe attached feasibility study has been prepared at the request of the Harveys
and O'Briens to address the failing on-site sewer system on the Harvey property.
The report is straightforward and addresses an 820-foot extension of 8-inch

sanitary sewer from the City's existing system in the Curry Farnns subdivision
along Lake Lucy Road.
1 The total estimated cost of the project is $36,855 which is proposed to be
assessed equally to both parties. Before the City can extend sewer service to
these properties, a minor Guide Plan Amendment must be approved by the
I Metropolitan Council. Authorization for preparation.of plans and specifications
should therefore be conditioned upon the City receiving approval from the
Metropolitan Council for this sanitary sewer extension. Similarly, the O'Briens
and Harveys will need to waive their rights to the public hearing and agree to
IIbe assessed for the cost of the improvements.
It is therefore recommended that the attached feasibility study prepared by

authorization be given for the preparation of plans and specifications after the
City receives approval from the Metropolitan Council for the Guide Plan
1 Amendment and the Harveys and O'Briens waive their rights to the public hearing

As shown on the attached map, the Harvey and O'Brien residences
I are located along Lake Lucy Road just west of the Curry Farms
subdivision. These property owners have been interested for some
time in extending sanitary sewer service to their property but,
unfortunately, they lie just beyond the Metropolitan Urban Service
1 Area (MUSA) limits where municipal sanitary sewer service is not
allowed. Over the past several months the septic system for the
Harvey property has been experiencing difficulty to the extent
I that now the system requires pumping approximately once a week in
order to prevent it from overflowing onto the yard and street
area. The building department has been working with the Harveys
to resolve this matter and they are formally on notice as of
IJanuary 25, 1990 to correct this situation (see attached notice) .
If the Harveys are not allowed to connect to the City' s sanitary
I sewer they will have to construct a new septic system at
considerable expense to resolve this situation. It makes sense
therefore to attempt to connect them into the City system at this
I time to resolve this problem once and for all. Since the
sanitary sewer would pass through the O'Brien property to reach
the Harveys, the O'Briens have also requested the City to look
into the possibility of extending sanitary sewer service at this
Itime and are willing to participate.

The Planning Director and I have discussed this in some detail
1 and he has had discussions with the Metropolitan Council and
feels reasonably confident that a Guide Plan amendment could be
procured from the Metropolitan Council to allow the City to
I extend sanitary sewer to this failing septic system area. The
property owners are therefore petitioning the City to proceed
with a Guide Plan amendment and the preparation of a feasibility
study to evaluate the costs and practicality of extending

sanitary sewer se rvi ce . As no t ed in the at t ac hed authorization
form, the property owners have agreed to waive their rights and
pay the assessments to cover the City's expenses for the Guide
Plan amendment and feasibility study. It is understood that if
the Metropolitan Council refuses to allow the City to amend its
MUSA line in this area that the extension will not be allowed and
Mr. Harvey will then have to pursue on-site remedies to resolve
his failing system problems.
It is therefore recommended that the City Council authorize the
preparation of a feasibility study to evaluate sanitary sewer
extension to the O'Brien and Harvey properties and that staff be
directed to prepare a Guide Plan amendment and submit it to the
Metropolitan Council for consideration.

extension of sanitary sewer to service our property. We

RE: Failing Septic System
Dear Mr . and Mrs . Harvey, 1
I spoke to Mrs . Harvey on January 25, 1990 about your failing
septic system. I told her I would research the ordinance and
contact you. I have included copies of pertinent sections of
Chapter 19 of the City Code which deals with sewage disposal .
The tank must be pumped as necessary. T understand you have been 1
having it pumped every 30-40 days . If any more effluent is
discharged on the surface a high level alarm will be required.
City Code (Section 19-83 b3) requires the owner to apply for a
permit within 15 days of this notification to repair or replace
the system. A design must be submitted with the application.
City Code allows 60 days for repair or replacement, but this time
limit may be extended.
I have discussed your failing system with the City Planner and
City Engineer . Due to the proximity of your property to City
sewer, there may be some alternatives to- repairing your failing
system. I would like to meet with you and Mr . O'Brien for some
further discussion on this . Please call me to arrange for a
meeting.
