1 SUBJ: Public Hearing for Lake Drive West Improvement
Project No. 90-1; Authorize Preparation of Plans
and Specifications
As will be recalled, City Council accepted the feasibility study
for Lake Drive West from County Road 17 to Audubon Road at the
April 9, 1990 meeting. A public hearing was called for April 23,
1990 and appropriate notices were placed with the affected
1 property owners and the newspaper. A preliminary assessment roll
was included in the appendix to the report. Basically, from an
assessment standpoint, four property owners are impacted by the
1 project; that being Lake Susan Hills West Partnership, Redmond
Products, the City ' s park property, and the David Stockdale
property which fronts on Audubon Road.
1 As noted in the attached April 11, 1990 letter from Ryan
Construction Company, Redmond Products has requested that the
Redmond project be removed from any further consideration as it
1 relates to the Chanhassen approval process . Apparently Redmond' s
new Chief Operating Officer, Mr. Larry Perkins, is reviewing the
feasibility of the planned expansion and until he is satisfied,
1 their site development will not proceed. Since the impetus for
the City ' s project was the petition of Redmond, it appears
prudent for the City to withhold any further progress on this
project until such time as Redmond has reaffirmed their interest
1 in proceeding. This would be done by providing the City with
appropriate financial guarantees to cover the expense for the
preparation of the plans and specifications.
1 It is therefore recommended that the City Council, after the
close of the public hearing, authorize the preparation of plans
1 and specifications conditioned on the receipt of an appropriate
agreement from Redmond Products stating that they agree to be
assessed for the cost of the improvements as utl_;... ed ia. —the

assessments and demonstrate clear ownership of the property. As
an alternative, it would also be acceptable for Redmond Products
1 to provide the City with a letter of credit or cash escrow in the
amount of $120 ,000 to cover the cost of the preparation of plans
and specifications and other up-front administrative charges
1 which the City will incur prior to receiving bids.

impacts Redmond so dramatically must be carefully reviewed to insure
proper location, size, and level of technical refinement and this effort
is currently underway. '
Following this thorough project review, I will contact you regarding any
changes. In the interim, Larry Perkins, the new Chief Operating Officer
of Redmond and I would like to meet with you during the week of April
16th. As we have discussed on other occasions, could you please have
available for our review a brief outline of the tax increment assistance
the City is offering Redmond based on the latest design we have
submitted.
Todd, I want to thank you and your staff for the time and energy you
have given the Redmond project to date and hope that we will have the
opportunity to continue the effort to its successful completion.

Honorable Mayor and City Council:
' This letter is submitted to request changes and express concerns in
the referenced Feasibility Study.
The main concern is the issue of zoning of property adjacent to the
road. When the PUD was done originally the R-12 zoning that the city
requested for the site was to accommodate apartments. Since then the
city added the R-16 zoning to accomplish the objectives of the R-12 in
' the PUD. We expected City cooperation in changing the zoning and request
action to upgrade the PUD agreement with R-16 zoning replacing the R-12,
With the report, the individual infra structure items have been
' discussed with Gary Warren and our concerns are explained below:
WATER MAIN
This site had a substantial assessment as part of the Chanhassen
' Hills- CR 17 Trunk Water Main Exterior in 1987. Outlots E and F were
not assessed at that time although benefit was received. We will
expect credits for this trunk cost and any oversizing to be built as
' part of the final design.
Perhaps some TIF will be required for the cost of water main in
this project.
' SANITARY SEWER
The design should conform to the site plan that we submitted as
part of the PUD approvals. We will want to provide input to the
' construction drawings to assure service locations and depths to
accomodate future uses on the site.
STURM DRAINAGE
' We engaged Ilickok Associates to do an overall Drainage Study
for Lake Susan Hills. This utilized an existing pond and created
a new pond at the Southeast corner of our property. This assessment
' study shows the whole site being assessed and is incorrect.
The topography and past construction for storm sewer as part
of the Hickok report will eliminate nearly all of this site from
assessment for Storm Drainage.

' ROADWAY
We will want to provide input for curb cut access to the •
property as part of the contruction drawing.
' It is felt that the $91,000 for 24 street lights is
excessive and less costly alternatives need to be explorded.
The economic climate for the 1990's do not warrant the gilding
of specification at the expense of creating unnecessary financial
' burdens on the builders committing to the sites.
Deferment of assessments is requested as part of the payment of
' construction on our property. The market for apartments is very
questionable for the next 3 to 5 years and this project puts an undue
burden on the owners for a market that is currently very soft and
outlooks are for level or declining demand.
We shall work with the city in the construction of the Lake Drive
West with the expected support of objections and concerns previously
mentioned in this letter.
