In order I to preserve this corridor , it is necessary to have the official map prepared in accordance with MnDOT and State Statute 394. 361 requirements. II The work that BRW performed for the City in establishing the preferred Trunk Highway 101 alignment will serve as the basis for the official mapping process. The attached proposal dated II January 22 , 1990 was solicited from BRW for preparation of the final official mapping documents. As noted therein , in particular item 4, some additional calculations and design work I will be necessary to accurately establish the remainder of the roadway alignment parameters. This will allow the preparation of legal descriptions for the roadway corridor. I Similarly, BRW has researched with MnDOT the official mapping requirements and have identified that the preparation of individual legal descriptions for property acquisition for I individual parcels is not necessary at this time. This will save the City considerable money in the mapping process. I It is therefore recommended that the attached proposal dated January 22, 1990 from BRW be accepted for a cost not to exceed $19,000 . RE: Revisions to Proposal for Official Mapping of Trunk Highway 101 between Rosemount Entrance and Proposed Trunk Highway 212 Dear Gary, ' The following clarifications are provided as requested to our November 7, 1989 proposal for the official mapping of Trunk Highway 101 between the Rosemount entrance and proposed Trunk Highway 212. SCOPE OF WORK Research and Preliminary Layout 3. Obtain current Minnesota Department of Transportation section subdivision/ control survey for Section 24, if available. Mn/DOT officials have been contacted to determine if records exist for a section subdivision/control survey of Section 24. Based on our research, ' it does not appear that complete survey information is available. A Section 24 subdivision survey will , therefore, be required as a part of the official mapping work. The survey is necessary to accurately locate the roadway corridor in relationship to the existing section monumentation. 4. Determine design requirements and establish proposed roadway alignment. ' The preliminary alignment of TH 101 was generally established by degree of curvature for the Preliminary Alignment and Land Use Study. Our proposal for the official mapping work includes all necessary calculations and ' design work to establish the remainder of the roadway alignment parameters. The parameters must be determined to enable a legal description to be pre- pared for the roadway corridor, as well as allow a field survey of the alignment, as detailed in Item #5 of our original proposal. The offi- cial mapping process requires that a legal description and map be prepared for the proposed roadway centerline and associated right-of-way corridor. The pre- paration of individual legal descriptions for property acquisition from indivi- dual parcels is not required. The three work items identified in this section of our original proposal shall be deleted and replaced as follows. 1. An official map will be prepared detailing the extent and location of the roadway corridor, as well as identifying property boundaries and ownership data. The official map will require the signature of a Registered Land Surveyor. 2. The official map will be sent to Mn/DOT for review and signature of approval. 3. All necessary services will be performed to file the official map with the ' Carver County Surveyor's Office. Monumentation 1 1. A field survey will be performed for final monumentation of the roadway corridor. Final monumentation of each individual acquisition parcel will not be required; therefore, this portion of the work shall be deleted from our proposal. COST ESTIMATE , The cost estimate provided in our original proposal shall be modified to reflect the changes in the scope of work detailed above. The new estimated cost for ' services is as follows: Estimated Cost Research and Preliminary Layout (Including Section 24 Subdivision Survey) $12,750 Official Map Preparation $ 4,200 Final Monumentation $ 2,050 ' Total $19,000 I • Mr. Gary Warren January 22, 1990 Page 3 All services required for the official mapping of proposed TH 101 between the ' Rosemount Drive and TH 212 will be performed for a total not-to-exceed cost of $19,000. This includes the subdivision survey of Section 24 necessary for the mapping work. We are ready to begin the official mapping work immediately upon your acceptance of our original proposal along with the clarifications of this letter. An esti- mated schedule for the completion of the scope of work based on a February 5, ' 1990 notice to proceed date is as follows: Estimated Completion Date Research and Preliminary Layout March 23, 1990 Official Map Preparation May 4, 1990 Monumentation June 1, 1990 All work required for the official mapping of TH 101 between the Rosemount ' entrance and TH 212 will be completed by approximately June 1, 1990. Officially mapping this segment is the only means to guarantee that no construction will occur in the proposed corridor. However, I would not be doing my job if I did not alert the Council to the fact that funding for this project was not considered in preparing the 1990 , budget. Optional funding sources could include: - Market/Lake Drive Construction Project: Although the northerly portion of TH 101 could be seen as a part of the corridor study, such currently exists as dedicated right- of-way. Accordingly, the study does not include this segment as there is no necessity in preserving something you already own. Charging costs to the project would not be supported by our auditors; or - Engineering Department/Administrative Trust Fund: Both the operating budget of the Engineering Department as well as the Administrative Trust Fund have limited resources. If a surplus does exist in the Administrative Trust Fund, alter- native uses for such funds have already been identified; or - Highway 101 Reconstruction (Between Rosemount and TH 212) : This would be the logical construction account to charge this type of bill to. Unfortunately, such has not been authorized as an official public improvement project. To do such, the City would need to complete a feasibility study, carry out hearings, etc. By the time you have finished the hearings, there would be no necessity to offi- cially map - you would simply acquire the right-of-way as was done for the northerly segment. It is likely that this will become a project within the next few years; or - State Aid Fund: Both Gary and I have been protective of ' funds in this account to insure that sealcoat activities can be funded in the future. This does represent the .only interim source of funding until the construction fund, noted above, becomes a reality; or - Authorize Study, But Hold Commencing Work: This option recognizes that any request to subdivide, rezone, etc. , would represent a lengthy task and allow time for the offi- cial mapping before any approvals were given. The proper- ties affected include Klingelhutz, Barth, and Ward. For practical purposes, each of these owners considers that the official mapping is in place which, given the work already completed, is generally true. The only exposure in selecting this option is recognizing that the City has limited means to stop a request to build a barn, garage, etc. The likelihood of any of these things occurring is not great in my own mind; or, stated in another way, I can not support spending $19,000 for something that is not likely to occur. I could be wrong. • Page 3 The other factor which may trigger the necessity for fina- lizing the official mapping is the recognition that RALPH funds are not available until after an official map is in place. Any of the owners seeking RALPH funds would have to wait until after the map was filed. Again, I do not see ' this as a major constraint recognizing the fact that the most logical scenario necessitating the request for RALPH funds would be submission of a plat, conditional use ' request, etc. , wherein time would be available to finalize mapping or to commence a public improvement project. Recommendation tThis office would recommend that the Council authorize the official mapping contract as presented. Staff should be instructed not to sign the contract or have work completed unless a building request was submitted and staff found that no other means existed to stop that construction other than moving forward ' with the official mapping. If the latter should occur, interim funding should additionally be authorized from the State Aid Fund. )c:;Lj • 1 1
