The subject properties are I bisected by the Highway 212 and future County Road 17 alignment ( see Attachment #2 for history) . The City Council extended the deadline for preliminary plat approval to three months after the official map for Highway 212 was adopted by the City Council. I The official map was adopted on December 4, 1989 and the three month period expires on March 4, 1990. Gil Laurent, Sever Peterson and Bruce Jeurissen are the only three property owners II who have land proposed for subdivision within the Highway 212 corridor and who are still under the 24 acre minimum. I The applicants are proceeding with the preliminary plat, but will not have preliminary plat approval by March 4, 1990. Reflecting back on the three month deadline, staff realizes that three months was not an adequate amount of time to process a preliminary I plat and that the time period should actually have been six to nine months. Therefore, staff is recommending one final extension for preliminary plat approval for the Peterson/Laurent application. I Staff is recommending preliminary plat approval be extended until the first City Council meeting in June - June 11, 1990. I Recommendation Staff recommends that Sever Peterson, Gil Laurent and Bruce Jeurissen receive extension to preliminary plat approval until 1 June 11, 1990. - Attachments I1. SUBJ: Extension for Sever Peterson Preliminary Plats ?x' -44 BACKGROUND I On April 25, 1988, the City Council approved a preliminary plat I extension for Sever Peterson's subdivision of five single family lots located on the south side of Pioneer Trail (Attachment #1) . The preliminary plat extension was approved because the proposed II TH 212 corridor, which will impact the subject site, had not yet been determined by an official map by MnDOT. The extension for preliminary plat approval was given until January 1, 1989. On June 27, 1988, the City Council also extended preliminary I plat approval for a subdivision proposed by Sever Peterson on the north side of Pioneer Trail (Attachment #2) . Again, the reason II for the approval was that the TH 212 corridor and the realignment of Pioneer Trail will impact the subject property. The City Council approved to extend the preliminary plat approval deadline I until January 1, 1989. -. ANALYSIS As of this date, the city has not received an official map of the I Th 212 corridor from MnDOT. The official map should be completed in the near future. For Sever Peterson to receive preliminary plat approval for both subdivisions by January 1, 1989, as II established by the extension approved by the City Council, Mr. Peterson would have to be going through the application process at this time. Mr. Peterson is requesting another extension to II' the preliminary plat approval for -both subdivisions until the official map has been completed, by MnDOT. The circumstances for approving the previous extensions still exist and staff supports II approving another extension to the preliminary plat approvals. Rather than establishing a set date, staff is recommending that II the City Council approve extending the preliminary plat deadlines to three months after the Th 212 official map has been adopted by the city. At that time, it was anticipated that I the official map would be approved in the spring of 1988; however, MnDOT has notified us that we will not receive the offi- cial map until the end of July. In the meantime, the applicant II has made substantial progress on the application. Attached are two preliminary layouts of the parcel both with and without the TH 212 right-of-way. The applicant is preparing a plan showing lots without the Th 212 right-of-way in order to establish some I type of record of the number of lots that could have been approved were it not for the creation of the TH 212 right-of-way. IANALYSIS Further complicating the plat is the rearrangement of Pioneer Trail and Bluff Creek Drive around the proposed TH 212 right-of- ' way. These additional roadways have put additional con- siderations into preparation of the plat not only for short term but also for long term subdivision layout and planning purposes. I On top of these complications, the legislature changed some of the criteria for applications for receiving right-of-way acquisi- tion loan funds from the Metropolitan Council. Metropolitan I Council staff has admitted a certain amount of confusion about the legislature's action and both they and staff and applicant are trying to determine the best means to process these plat applications and still meet all approvals required for the right- , of-way acquisition loan program. RECOMMENDATION IExtension of the plat deadline is warranted given the above noted facts. It is recommended that the Council extend the time period IIto permit preliminary plat to January 1, 1989. Peterson/Laurent II On February 9, 1987, the City Council extended the deadline for the Peterson/Laurent subdivision until January 1, 1988 (Attachment #1) . The extension was granted to permit the TH 212 II alignment to be determined and approved as part of the official map. The proposed location of TH 212 divides the subject prop- erty approximately in half. MnDOT has nearly completed the final II alignment for the TH 212 corridor at which time the City Council will hold a public hearing to approve the official map. The official map should be approved by spring of 1988. Staff recom- II mends that July 1 , 1988, be established as the final deadline for preliminary plat approval. B. Robert Buresh I On May 12, 1987, the City Council approved the extension of the rural subdivision deadline for Robert Buresh (Attachment #2) . II The Buresh property is located south of the Halla Nursery east of Hwy. 101. It was felt that the Buresh subdivision should wait until the Halla subdivision was completed and the street issue had been resolved. Mr. Buresh has provided the necessary soil II borings to complete the subdivision application, but since it is now winter and there is frost in the ground, the soil consultants cannot review the soil tests until spring. Therefore staff is recommending that a July 1, 1988, extension be approved as a II final extension for preliminary plat approval for the Buresh sub- division. i C. Lake Riley Woods South In June of 1987, the City Council also approved an extension for I the Lake Riley Woods South subdivision (Attachment #3) . The Lake Riley Woods South subdivision is being proposed by George Nelson II IMr. Don Ashworth January 7, 1988 I Page 2 and Associates, the same owner of the Lake Riley Woods sub- I division. The reasons for the extension were boundary overlays and title problems. The applicant has provided the necessary preliminary plat and fees. Staff is recommending that July 1, 1988, be approved as a final extension for preliminary plat 1 approval for the Lake Riley Woods South subdivision. RECOMMENDATION IThe three proposed rural subdivisions cannot be completed until the soil consultants can review the soil borings in the spring. I All of the necessary information has been submitted and the sub- divisions should be able to receive preliminary plat approval by July 1, 1988. Staff recommends that July 1, 1988, be approved as the final deadline for preliminary plat approval by the City II Council for Robert Buresh subdivision, Peterson/Laurent sub- division and for the Lake Riley Woods South subdivision. VISITORS PRESENTATION: SCHOOL DISTRICT 112, LEAN ON ME PROGRAM, MARJORIE ADAMS. Marjorie Adams: lam a member of the School Board for District 112 and we are currently having a campaign called the Lean on Me Project and we're wearing these black and white buttons that I brought for you tonight. This has come ' out of the whole child initiative and that is a p ilot program ogram that is taking place in 10 sites throughout the state. You have probably heard about it. It was developed because we, in education, have felt that children have such complex lives and problems and issues facing them so we're trying to get the involvement of teachers, parents, the community, to alleviate some of these problems. The idea of the Lean on Me Project is to emphasize cooperation and helping others and we're hoping that you will proclaim the week of May 18th to the 22nd as Lean on Me Week and that you will wear your buttons and when you see them or when other people ask you about them you will think, have I done something for someone else today that I didn't have to do. 1 4a City Council Meeting - February 9, 1987 Gary Warren: Ditch sections would be upgraded, right.
