c. Heritage Park Apartments
I had not anticipated this item being on the agenda recognizing
the potential research required by the Attorney' s office. What I
had not considered is the fact that this same question had been
responded to in 1984. Accordingly, except for verifying changes
since 1984, Roger was able to respond to the Council ' s request in
relatively short order. Attached please find his response to
Item a.
' In regards to the re-examination of West 78th Street design,
I believe a number of factors are jointly coming in to play to
respond to this request, i .e:
' - Johnson Redevelopment Proposal: Brad Johnson has submitted
various alternative development proposals for the property
' lying south of the railroad tracks between Great Plains
Boulevard and TH 101/Dakota Avenue. Access to this property
from the newly created PH 101 intersection simply cannot be
achieved. In fact, the primary reason that the City is
' taking the Taco Shop is the recognition that potential
damages awarded to that owner for restricted accessibility
would probably exceed the value of a full taking. Why pay
' an enormous sum and get nothing? Access from either
Highway 5 or across the railroad tracks is also not
possible. Therefore, the only reasonable access to the
' Johnson property is from Great Plains Boulevard which has a
number of inherent traffic congestion problems without
adding 5, 500, or 5,000 cars; and
- West 78th Street Design: Councilman Workman' s question has
been posed by various individuals over the past two to
three years. Tom is correct, they need to be responded to;

- Future Development of the Downtown Area: The overall '
redevelopment plan established Market Boulevard as the
center of Downtown. Typically, we think of downtown as
that area lying between Great Plains Boulevard and Market
Boulevard. In fact, the future is likely to show that the
other half, lying between Market Boulevard and County Road
17 will be as much of the downtown as that portion
currently lying to the east of Market Boulevard. In the
process of putting on our visionary glasses, it is impor-
tant to re-examine the road configuration as it lies
between Market Boulevard and County Road 17 to insure that
such adequately handles future traffic patterns in that
area.
Each of the issues presented above could represent a basis for a
separate traffic study. Combined, they reinforce the necessity
for a study. Each of the sections noted should be separately
addressed, but we also need to look at the sum of the parts.
Both Benshoof (completed the original traffic analysis
establishing the parameters for design in the downtown area) , as
well as BRW, should not be considered to complete the re-
examination. Potential candidates would include Howard-Needles,
Barton-Aschman, etc. The City does not have resources to carry
out this type of project. The HRA does. This office would
recommend that the City Council request that the HRA proceed with
a new study as soon as possible. The City Council would see the
proposed "scope of services" prior to any work commencing.
In regards to Item c, the last administrative packet did include
a rather detailed analysis from Gary Warren as to the history
associated with the Heritage Park Apartment project. '

Dear Don:
' You asked me "how can the City Council become the HRA?"
Technically, the two bodies are separate and distinct. The City
Council, however, can provide that only City Council members can
serve as HRA Commissioners. The terms of office of the
commissioners may be made to coincide with the terms of office as
Council members. If the change is desired the City Code should be
amended to reflect the new requirement.
The existing commissioners cannot be replaced with City
' Council members until their terms expire unless the commissioner
voluntarily resigns. Commissioners cannot be removed by the City
except for "insufficiency or neglect of duty or misconduct."
Minn. Stat. § 469.010.
