Thank you. DATE: March 22, 1990 ' SUBJ: Public Hearing for the Upgrade of Audubon Road South of the Railroad to Lyman Boulevard Improvement Project No. 89-18; Authorize Preparation of Plans and Specifications The City Council accepted the feasibility study for the Audubon Road south improvements at the March 12, 1990 meeting. The project is a 429 special assessment project and as such a public hearing is required on the feasibility study. Three property owners immediately south of the railroad bridge, as shown on Exhibits 5 and 6 of the feasibility study, are proposed for assessments to coincide with the benefit to the property from the extension of sanitary sewer and watermain . These property owners are listed in the feasibility study, Appendix B, and totals to approximately $112 ,000 . Approximately 82% of the project is proposed to be funded from the tax increment district funds from TIF District No. 2-1 (McGlynn) . Appropriate notices have been provided to the newspaper and ' directly mailed to the affected property owners as noted in the attachments. At the close of the public hearing, if there are no unresolved issues, it is recommended that the City Council authorize the preparation of plans and specifications for the Audubon Road South Improvement Project No. 89-18. ' ktm Attachments: 1. Assessment area maps, Exhibits 5 and 6. 1 2. Appendix B - Preliminary Assessment Roll. 3. Affidavit of mailing. 4 . Newspaper advertisement. ' c: Harald Eriksen, HNTB I I Page 2 ' Manager's Comments March 12 , 1990) : Funding of Audubon Road via tax increment, south of the railroad tracks, has been considered since the creation of the district - albeit not as quickly as I currently being considered. Acceleration is primarily a result of Redmond/Lake Drive proposals. This office concurs with the recommendation of the engineer. However, the issue is whether sufficient TIF monies exist. The answer to this question is dependent on two factors: - Tax Anticipation Estimates: The plan was completed ' using estimated tax figures. Actual figures will not be known for an additional year, but estimates that will be within 5% will be known, within the next sixty days. It is the figures to be received within the next sixty days which will be critical, i.e. we can tolerate a 5% error, but not a 30%, 40%, or 50%; and ' - Status of "A" or "B" Distribution Request: At time of certification, the city requested that the district be accepted as a "A" district under tax increment law. The County Board did not act on this request leaving such to the County Auditor. In layman's language, this request comes down to a determination as to whether the fiscal disparities ' distribution dollars will be available to the district or not. That determination increases or decreases revenues by 37%. That difference alone determines whether funding is available for this project. As stated above, this office concurs with the engineer's recommendation with the caveat that whether funding exists will not be known until the public hearing date or potentially later. Manager's Update (March 26, 1990) : As of this date, information regarding projected taxes is still unavailble.
