SUBJ: Animal Ordinance Amendment Regarding Cleaning Up After
I Animals on Public and Private Grounds
I On Monday, March 12, 1990, the City Council at their regularly
scheduled Council meeting directed Staff to look at an ordinance
that would require the cleaning up ,of animal feces from domesti-
' cated animals. At that time, YttheCouncil reviewed two ordinances
submitted by our City Attorney regarding the cleaning up of feces.
The first ordinance was from Bloomington and the second was from
Lakeville.
The City Attorney has drafted a proposed ordinance amendment for
the City of Chanhassen regarding the o1eaning up of dog feces.
I This ordinance will allow the Public Safety Department to enforce
the cleaning up of dog feces as it is p ohibited in code.

It should be pointed out that Section 5. .2, Item a. prohibits the

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 5 OP THE
CHANHASSEN CITY CODE CONCERNING ANIMALS
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Chapter 5 of the Chanhassen City Code is amended ,
by adding Section 5-22 to read:
Sec. 5-22: DOGS: CLEANING UP LITTER. ,
A. The owner of any dog or an person having the custody or
control of any dog shall be responsible for cleaning up and feces
of the animal and disposing of such feces in a clean and sanitary
manner. Every occupant or a dwelling unit, or owner if the
dwelling unit is not occupied, shall remove animal feces from the
unit, the yard, or lot on which the unit is located, or from any
structure appurtenant to the unit which he controls and dispose
of such animal feces in a clean and sanitary manner.
B. It is unlawful for any person owning, keeping,
harboring, or in custody of a dog to cause or permit the dog to
be on property, public or private, not owned or possessed by such
person, without having in his or her immediate possession a
device for removal of feces and depository for transmission of
excrement to a proper receptacle located on the property owned or
possessed by such person. The person shall immediately remove any
feces from such property and dispose of the feces in a clean and
sanitary manner.
C. The provisions of this section shall not apply to the '
paved or traveled portions of public streets, to rural
undeveloped areas of the City, to guide dogs accompanying a blind
person, or to a dog used by police.
Section 2. This ordinance shall be effective immediately
upon its passage and publication. '
PASSED AND ADOPTED by the Chanhassen City Council this
