SUBJ: Ordinance Amending Chapter 16 of City Code Concerning
' Solid Waste - First and Second Reading
On December 4, 1989, the City Council adopted an amendment to
Chapter 16 of the Chanhassen City Code concerning Solid Waste. The
' amendment required all licensed haulers in Chanhassen to provide
curbside collection of recyclables. Upon further review of the
ordinance, staff found that there was no wording requiring the
' recyclables to be recycled and that they could not be disposed of
at a landfill or incinerated. The whole purpose of the ordinance
is to promote recycling and therefore, staff is recommending the
following amendment which would insure that all recyclables
' collected in Chanhassen have to be recycled. Any licensed hauler
within Chanhassen who collects recyclables and then landfills them
could lose their license in Chanhassen.
' RECOMMENDATION
' Staff is recommending the following amendment to Section 16-32 of
the Chanhassen City Code by adding subparagraph (g) and (h) to read
as follows:
' (g) Recyclables may not be disposed of at a landfill or
incinerated. All recyclables must be recycled.
' (h) Mixed municipal solid wastes may only be disposed at a
designated sanitary landfill or other facility authorized
by Carver County.
' ATTACHMENTS
1. Ordinance Amendment.
Manager's Comments: Staff is looking to get this ordinance on the
books before April 1, 1990. Accordingly, we are recommending that

the City Council adopt first and second reading of this ordinance.
Under Council Procedures this will require a 4/5ths vote. I am
asking Roger Knutson to strengthen the revocation process section.
' A modified ordinance may be distributed to the City Council on
Monday evening.

The City Council of the City of Chanhassen ordains:
Section 1. Section 16-32 of the Chanhassen City Code is
amended by adding subparagraphs (G) and (H) to read:
' (G) Recyclables may not be disposed of at a landfill

' Section 2 . Section 16-35 of the Chanhassen City Code is
amended to read:
Suspension or Revocation of License. The City Manager
may suspend or revoke the license of any person whose
conduct is found to be in violation of the provisions of
this Chapter . Suspension or revocation may also be based on
' other health, safety, and welfare concerns arising out of
the performance of the licensee, its employees and agents,
and/or its vehicles and equipment. Revocation or suspension
' of a license by the Manager shall be preceded by a public
hearing conducted in accordance with Minnesota Statutes
Sections 14 . 57 to 14 . 69 . The City Manager may appoint a
' hearing examiner or the Manager may conduct the hearing.
The hearing notice shall be given at least ten (10 ) days
prior to the hearing, include notice of the time and place
of the hearing, and shall state the nature of the charges
' against the licensee. Any person aggrieved by the decision
of the City Manager may appeal the decision to the City
Council by filing written notice with the City Clerk within
' ten (10 ) days after the Manager ' s decision is made.
Section 3 . This ordinance shall be effective immediately
upon its passage and publication.
