BACKGROUND
In October of 2002, the city adopted ordinances establishing a property
maintenance code and requirements for licensing rental dwelling units. The rental
licensing requirements include provisions for building maintenance and conduct
on the premises. The rental license program was initiated in 2003. Through
January 2004, we have issued rental licenses for 484 rental units (list attached).
Inspections of rental properties are ongoing with licenses pending on 388 units.
The larger apartment complexes have received licenses with the exception of
Lakeview Hills Apartments and Lake Susan Apartments. Initial inspections have
been completed at these complexes and we expect the violations identified to be
corrected within 30-60 days. When these licenses are issued, 94% of the identified
rental units will have licenses.
We have received $39,600 in revenue to date with applications for 872 units. I
expect an additional $5,000 in rental license revenue during 2004. Revenue for
2005 should be around $40,000 at the current fee schedule. The fee for a rental
license remains at $50.00 per unit; however, last October the term of the license
was extended to two years, which in effect reduced the original cost to property
owners by 50%. I estimate that we have about 900 rental units in the city at this
time. Buildings under construction at Villages on the Ponds will add 161 units
when ready for occupancy this summer. There are 82 units under construction at
the Powers Ridge complex, but those are being marketed as owner-occupied, not
rental.
In 2003, Inspections Division staff put in over 500 hours at a cost of approximately
$17,000 to implement and administer the program. This cost does not include
time for supervising the program, or the time that the Crime Prevention Specialist
and the Sheriff's Office have invested in the conduct on premises portion of the
program. Costs for 2004 arc estimated at around $10,000 to complete inspections
of the pending licenses and continued administration the program.

INSPECTIONS
During the course of rental inspections, the following code violations were
identified:
· General lack of maintenance
· Tom window screens
· Inoperable smoke detectors
· Inoperable doors and windows
· Plumbing and HVAC systems not functioning properly
· Egress windows not to code
· Fire doors that don't close
· Improper storage of LP fuel tanks
· Fire alarm and sprinkler systems not maintained properly
· Single family homes converted into multi-family dwellings in violation of
zoning regulations
All of the multi-unit buildings have required re-inspections to verify that violations
were corrected. Most single family houses did not require re-inspection, although
some properties have required additional inspections and administrative work in
our effort to gain compliance (see attached inspection reports of actual violations
at a single family home and a multi-tenant building).
Inspections also revealed problems and inconsistencies with the original property
maintenance ordinance adopted in 2002 and the new 2003 State Building Code
and 2003 International Property Maintenance Code. Revisions were made to the
ordinance this past November. The code is now coordinated with the model code
documents it was modeled after.
CONDUCT ON PREMISE
The conduct on premises portion of the rental license program is administered by
Beth Hoiseth with the assistance of Jim Olson and the Carver County Sheriff's
Department. Tracking and enforcing conduct violations began on July 10, 2003.
Nine violations have been documented to date (see the attached memorandum for
locations and details of the violations).
RECOMMENDATION
It is the opinion of staff that the Rental License Program is accomplishing what it
was intended to do and should continue. The purpose of the program is to protect
the public health, safety and welfare of the citizens of the city who reside in rental

housing. Before this program was initiated, the city had very little enforcement
authority to address complaints and problems with rental units. The license
program provides for inspection and maintenance of rental units to ensure the
minimum standards for health, safety and welfare are met and also establishes a
procedure for license revocation if the standards are not met in a reasonable period
o'f time.
