EXECUTIVE SUMMARY
1SD #112 is requesting a land use amendment that allows Office Institutional
as a land use option on the Mattson property. The additional land use
designation offers the City the ability to have Office/Industrial as the other land
use designation if the school were not to be built.
ACTION REQUIRED
City Council approval requires a majority vote of majority of City Council
present. The final approval is subject to Metropolitan Council Approval.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public heating on February 17, 2004 to review
the proposed development. The Planning Commission voted unanimously to
approve the land use amendment. The verbatim minutes are attached in item la of
the council packet.
RECOMMENDATION
Staff recommends City Council adopt the motion approving the land use
amendment to include Office/Institutional, as specified with the conditions and
findings of fact in the staff report dated February 17, 2004.

BACKGROUND
The applicant, Independent School District 112 (1SD 112), is requesting a change in land use and zoning
to permit a secondary school. It is not the intention to build the school at this time. A Land Use
Amendment and Rezoning require a public hearing before the planning commission and approval of the
City Council. In addition the Metropolitan Council must approve the land use amendment. When the
type of school is chosen, a site plan approval and rezoning will be required. Site plan review and
rezoning require a public hearing before the planning commission and approval of the city council. The
tentative plans for the school district include the site plan approval and rezoning in 2007 with an
opening of the school in 2009.
The subject site, as well as the Holasek and Volk properties at the intersection of Galpin Boulevard and
Lyman Boulevard, was guided for office/industrial development as part of the 1991 comprehensive plan
partly because it was adjacent to the industrial expansion coming from the south and west in Chaska. In an
attempt to accommodate a reasonable amount of office-industrial development within the community and
in order to promote a balance of land uses and accompanying mix of tax base, these lands and others
(adding approximately 640 acres) were guided for office/industrial uses. The site is also adjacent to an
arterial roadway, which provides high levels of access, as well as adjacent to an active railroad comdor.
In April 1993, D. R. Horton submitted a proposal for a land use amendment to permit a concept plan of a
mixed townhouse (52 acres), support commercial (5.5 acres) and open space (24.7 acres) development on
this property for review by the city. The Planning Commission and staff recommended denial of the
amendment. The applicant withdrew their requested amendment prior to City Council review.
In June of 2003 Tollefson Development proposed a land use amendment from Office/Industrial to
Residential Medium Density and concept Planned Unit Development approval for a 427 unit townhouse
project on 94.8 acres of land. This request was denied by the City Council.
Originally, staff was considering re-guiding the land use to Office/Institutional only. A concern arose that if
ISD 112 chose not to build on the site they could sell the property to a use that may be less desirable. With
the option of Office/Industrial or Office/Institutional it gives the city the ability to rezone to either land use
zoning designation.
Staff is recommending the approval of the additional land use of Office/Institutional. Based on the trip
generation and the use of the building it is compatible to an office or industrial use. The site is also
adjacent to a collector street.
ANALYSIS
Staff is recommending the Land Use be designated as office/industrial or office/institutional. The
purpose of having the two underlying land use designations is if ISD 112 chooses not to build a school
the city could still require an Industrial Land use/zoning. This would give the city the flexibility of
reviewing those uses that are public or "quasi-public" or private.

"OI" Office and Institutional District
The intent of the "OI" District is to provide for public or quasi-public nonprofit uses and professional
business and administrative offices
The following uses are permitted in an "OI" District:
1. Schools.
2. Churches.
3. Public buildings.
4. Post office.
5. Fire station.
6. Library.
7. Museum.
8. Health services/hospitals.
9. Nursing homes.
10. Community center.
11. Public recreational facilities.
12. Utility services.
13. Professional, business, and administrative offices.
14. Funeral homes.
15. Commercial antennas as regulated by article XXX of this chapter.
The following minimum requirements shall be observed in an "OI" District subject to additional
requirements, exceptions and modifications set forth in this chapter:
1. The minimum lot area is fifteen thousand (15,000) square feet.
2. The minimum lot frontage is seventy-five (75) feet, except that lots fronting on a cul-de-sac shall
have a minimum lot frontage of sixty (60) feet.
3. The minimum lot depth is one hundred fifty (150) feet.
4. The maximum lot coverage is sixty-five (65) percent.
5. Off-street parking shall comply with district setback requirements except:
a. There is no minimum setback when it abuts a railroad right-of-way, except as provided in
sections 20-1191 and 20-1192 pertaining to landscaping requirements.
b. There is no minimum setback when it abuts, without being separated by a street, another
off-street parking area.
c. The minimum setback is fifty (50) feet when it abuts a residential district without being
separated from the residential district by a street or railroad fight-of-way.
d. The minimum setback is twenty-five (25) feet for side street side yards.
6. The maximum height is as follows:
a. For the principal structure, two (2) stories.
b. For accessory structures, one (1) story.

"lOP" Industrial Office Park District
The intent of the "lOP" District is to provide an area identified for large scale light industrial and
commercial planned development.
The following uses are permitted in an "lOP" District:
1. Offices.
2. Warehouses.
3. Light manufacturing.
4. Vocational school.
5. Health services.
6. Printers.
7. Indoor health and recreation clubs.
8. Body shops.
9. Utility services.
10. Recording studios.
11. Off-premises parking lots.
12. Conference/convention centers.
13. Commercial antennas as regulated by article XXX of this chapter.
The following minimum requirements shall be observed in an "lOP" District subject to additional
requirements, exceptions and modifications set forth in this chapter:
The minimum lot area is one (1) acre.
The minimum lot frontage is one hundred fifty (150) feet, except that lots fronting on a cul-de-
sac shall have a minimum frontage of sixty (60) feet.

The maximum lot coverage is seventy (70) percent.
Off-street parking shall comply with district setback requirements except:
a. There is no minimum setback when it abuts a railroad right-of-way, except as provided in
sections 20-1191 and 20-1192 pertaining to landscaping requirements.
b. There is no minimum setback when it abuts, without being separated by a street, another
off-street parking area.
c. The minimum setback is fifty (50) feet when it abuts a residential district without being
separated from the residential district by a street or railroad right-of-way.
d. The minimum setback is twenty-five (25) feet for side street side yards.
e. Parking setbacks along public rights-of-way may be reduced to a minimum of ten (10)
feet if the applicant can demonstrate to the satisfaction of the city that one-hundred-
percent screening is provided at least five (5) feet above the adjacent parking lot. The
intent of this section is that the city is willing to trade a reduced setback for additional

landscaping that is both an effective screen and of high quality aesthetically. Acceptable
screening is to be comprised of berming and landscaping. Screening through the use of
fencing is not permitted.
The maximum height is as follows:
a. For the principal structure, four (4) stories/fifty (50) feet.
b. For accessory structures, one (1) story.
Minimum setback requirements:
a. For front yards, thirty (30) feet.
b. For rear yards, ten (I0) feet.
c. For side yards, ten (10) feet.
d. The minimum setback is fifty (50) feet when it abuts a residential district without being
separated from the residential district by a street or railroad right-of-way.
e. Buffer yards: The city comprehensive plan establishes a requirement for buffer yards.
Buffer yards are to be established in areas indicated on the plan where higher intensity
uses interface with low density uses. In these areas, a fifty-foot buffer yard is to be
provided where the interface occurs along a public street, a one-hundred-foot buffer yard
is required where the interface occurs on internal lot lines.
The buffer yard is an additional setback requirement. It is to be cumulatively calculated
with the required setbacks outlined above. The full obligation to provide the buffer yard
shall be placed on the parcel containing the higher intensity use.
The buffer yard is intended to provide additional physical separation and screening for
the higher intensity use. As such, they will be required to be provided with a combination
of berming, landscaping and/or tree preservation to maximize the buffering potential. To
the extent deemed feasible by the city, new plantings shall be designed to require the
minimum of maintenance, however, such maintenance as may be required to maintain
consistency with the approved plan, shall be the obligation of the property owner.
Buffer yards shall be covered by a permanently recorded conservation easement running
in favor of the city.
In instances where existing topography and/or vegetation provide buffering satisfactory
to the city, or where quality site planning is achieved, the city may reduce buffer yard
requirements by up to fifty (50) percent. The applicant shall have the full burden of
demonstrating compliance with the standards herein.

BLUFF CREEK OVERLAY DISTRICT
The site is partially within the Meadowlands Region of the Bluff Creek Overlay District. This region of the
overlay district is characterized by fragmented forest communities, high quality wetlands and diverse
wildlife populations.
The goals set forth in the Bluff Creek Watershed Natural Resources Management Plan (BCWNRMP) for
the Lowlands Region are to:
1. Preserve high-quality wetland systems, riparian areas and remaining forests;
2. Regenerate impaired ecosystems, especially wetlands, to the extent practical under the present land
use constraints;
3. Re-create natural links between major natural features within the Bluff Creek corridor; and
4. Develop environmental educational opportunities within the corridor.
The applicant should keep these goals in mind as a site plan is developed for the property and should work
with staff to achieve these goals for this property.
Staff is recommending the Land Use be designated as office/industrial or office/institutional. The
purpose of having the two underlying land use designations is if ISD 112 chooses not to build a school

the city could still require an Industrial Land use/zoning. This would give the city the flexibility of

attached findings of fact. At the time of development review, the developer will be required to request a

RECOMMENDATION
Staff recommends the Planning Commission Adopt the following motion:
1. The commission recommends approval of the Land Use Amendment to Office/Industrial and
Office/Institutional subject to the attached findings of fact.
2. Approval is conditioned upon approval of the Amendment from the Metropolitan Council.

Application of Independent School District #112 and Charles Mattson for a land use amendment
including office/institutional and office/industrial. On February 17, 2004, the Chanhassen
Planning Commission met at its regularly scheduled meeting to consider the application of
Independent School District #112 and Charles Mattson for a land use amendment to include
office/institutional and office/industrial. The Planning Commission conducted a public hearing
on the proposed amendment preceded by published and mailed notice. The Planning
Commission heard testimony from all interested persons wishing to speak and now makes the
following:

Findings for Land Use Amendment:
The proposed land use amendment has been considered in relation to the specific policies
and provisions of the comprehensive plan and has been found to be consistent with the
official City Comprehensive Plan. City land use goals and policies require that the city
maintain an appropriate balance of land uses, preserve a tax base mix, and create new
employment opportunities. The city needs to preserve more industrial land for
development since only 8.3 percent of the land is guided for office/industrial uses. With
the amendment of either land use designation if the school were not to be built the city
could still recommend a zoning for industrial uses. The land use amendment provides an
opportunity for a community asset and will provide for the needs of the growth in the
community.
The proposed land use amendment will be compatible with the present and future land
uses of the area. Industrial development exists and is planned to the south and west of
this property. A secondary school use would be similar in traffic impacts as the industrial
or office zoning.
5. The planning report #04-08 Land Use Plan Amendment dated February 17, 2004,
prepared by Kate Aanenson, et al, is incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the Land Use
Amendment.

What Happens at the Meeting: The purpose of this public hearing is to inform you about the applicant's request and to
obtain input from the neighborhood about this project. During the meeting, the Chair will lead the public hearing through

City Review Procedure
Subdivisions, Planned Unit Developments, Site Plan Reviews, Conditional and Interim Uses, Wetland
Alterations, Rezonings, Comprehensive Plan Amendments, Code Amendments require a public
hearing before the Planning Commission. City ordinances require all property within 500 feet of the
subject site to be notified of the application in writing. Any interested party is invited to attend the
meeting.
Staff prepares a report on the subject application. This report includes all pertinent information and a
recommendation. These reports are available by request. At the Planning Commission meeting,
staff will give a verbal overview of the report and a recommendation. The item will be opened for the
public to speak about the proposal as a part of the hearing process. The Commission will close the
public hearing and discuss the item and make a recommendation to the City Council. The City
Council may reverse, affirm or modify wholly or partly the Planning Commission's recommendation.
Rezonings, land use and code amendments take a simple majority vote of the City Council except
rezonings and land use amendments from residential to commercial/industrial.
Minnesota State Statute 519.99 requires all applications to be processed within 60 days unless the
applicant waives this standard. Some applications due to their complexity may take several months
to complete. Any person wishing to follow an item through the process should check with the
Planning Department regarding its status and scheduling for the City Council meeting.
A neighborhood spokesperson/representative is encouraged to provide a contact for the city. Often
developers are encouraged to meet with the neighborhood regarding their proposal. Staff is also

PLANNING CASE NO. 04-08
CITY OF CHANHASSEN
NOTICE IS HEREBY GIVEN that the Chanhassen Planning Commission will hold a
public hearing on Tuesday, February 17, 2004, at 7:00 p.m. in the Council Chambers in
Chanhassen City Hall, 7700 Market Boulevard. The purpose of this hearing is to consider the
request for a Comprehensive Land Use Amendment from Office Industrial to Office; and a
Rezoning from A2 to Office Institutional for property located east of Galpin Blvd. and north of
Lyman Blvd., Independent School District #112 - Planning Case No. 04-08.
A plan showing the location of the proposal is available for public review at City Hall
during regular business hours.
All interested persons are invited to attend this public hearing and express their opinions
with respect to this proposal.
