Vacation of a Portion of Public Right-of-Way on Kirkham Road
West of 3737 Hickory Road - Vacation File No. 2004-06
REQUEST
Staff has received a request from Dan Revsbech, representing the property owner
at 3737 Hickory Road, to vacate an existing portion of the public fight-of-way of
Kirkham Road that is adjacent to the west lot line of the applicant's property.
BACKGROUND
The existing 30-foot right-of-way for Kirkham Road was dedicated to the City as
a part of the Red Cedar Point Lake Minnewashta plat in 1913.
The portion of Kirkham Road that is proposed to be wtcated exists as a gravel
driveway that serves both 3737 Hickory Road and 3800 Red Cedar Point Road.
The remaining southerly portion of Kirkham Road is not improved with either
pavement or a gravel surface and is simply a "paper street".
DISCUSSION
The applicant is requesting the right-of-way vacation in order to add additional
area to their property. The applicant would like to increase the size of the existing
home by either adding on or rebuilding. The existing lot is already substandard
with a lot area of 6,000 square feet. The proposed right-of-way vacation would
add an approximate 4,500 square feet of area to the lot for a total lot area of
10,000 square feet. While this is still less than the minimum lot area requirement
of 15,000 square feet, it is less of a non-conformity than the existing lot size. In
addition, the vacation would decrease the existing sideyard setback limitations of
the property.
As previously mentioned, the current portion of Kirkham Road that is proposed to
be vacated exists as a private gravel driveway for the use of 3737 Hickory Road
and 3800 Red Cedar Point. The City does not currently plow or maintain this
gravel driveway even though it is within public right-off-way. In addition, staff
does not have plans to upgrade this substandard drivewzty to a paved street. For
this reason, staff finds no compelling reason to retain the right-of-way.

There are existing sanitary sewer and water lines which are contained within the
right-of-way. As such, staff is recommending that a 30-foot wide public utility
and drainage easement be retained over the utility lines. In addition, the property
to the west of the Kirkham Road right-of-way (3800 Red Cedar Point) has an
existing driveway within the area to be vacated. As such, a private driveway
easement is required over the vacated right-of-way.
RECOMMENDATION
Staff recommends that the City Council adopt the following motion:
"The Chanhassen City Council approves a resolution vacating a portion of the
public right-of-way on Kirkham Road as defined in the attached vacation
description, subject to the following conditions:
1. A 30-foot wide utility and drainage easement shall be retained over the
existing sanitary and water lines within the vacated area.
2. A private driveway easement is required over the vacated right-of-way for
the benefit of 3800 Red Cedar Point.

Request for Vacation and Variance for 3737 Hickory Rd, Chanhassen, MN 55331
The subject property currently measures 40' x 150'. it contains a 528 square foot
home along with a two car detached garage. The access to this property is on the
west side on a 30' wide stretch of land owned by the city. The city does have utilities
on this land but does not maintain the property and has never built a roadway on
the property which was its intended use.
Because of this unused land the subject property is deemed a corner lot, requiring a
side setback on the west side of the property of 30'. The homeowners are requesting
that the city abandon this land back to the homeowner allowing the lot to no longer
be deemed a corner lot as well as to bring this lot closer to conforming size. The
homeowners also request a variance so that at some time the current structure can
be either added onto or torn down to rebuild. The homeowners understand that it
may be necessary for the city to maintain an easement on the west side of the subject
property, but would like the option to build up to that easement.
The current structure is not a conforming size. Any new structure or addition
would be done so that the home would then fall back into conforming standards.
