Consider adoption of resolution for TH 212 municipal consent.
BACKGROUND
On July 28, 2003, the City Council adopted a resolution supporting the accelerated
funding of new TH 212.
On December 8, 2003, the City Council called a public hearing to be held January 26,
2004 on the project.
On January 26, 2004, the City Council held a public hearing to receive comments
from the community on the project.
DISCUSSION
The proposed TH 212 project is an advanced state aid project which will utilize the
design build process. Under the design build process, plans are only 30% complete at
the time of municipal consent. The plans are required to show layouts, alignments
and access points. They also address environmental issues through the ElS review
and noise mitigation, The municipal consent process is designed for the review of
these issues. Other items such as landscaping, utilities, esthetics will be addressed at
the time of final design and subsequent projects. The City will play a role in
determining the final design.
As required by State Statute, the City held a public hearing on January 26, 2004 for
the municipal consent of new TH 212. At the public hearing, several residents voiced
concerns about aspects of the proposed project. These concerns included traffic
noise, traffic routing, property access, the 101 gap project, and environmental
impacts. Staff has responded to all residents in writing who spoke at the public
hearing. All the issues have been addressed by MnDOT or will be incorporate in the
final design of the project. Some of these issues cannot be fully addressed at this time
due to the constraints of the design build process. The municipal consent resolution

has some conditions included that address these concerns. Other issues have been
addressed by MnDOT or will be worked on in conjunction with the final design.
These include landscaping, noise mitigation, temporary traffic control and trail
alignments. Staff will continue to work with MnDOT on remaining issues.
LAYOUT REVIEW
TH 101 GAP Project from Lake Drive to W 86tn Street
Staff has been working with the MnDOT and the County to try to advance this project
to coincide with the TH 212 project. The project, as proposed, would be a turnback
project for State to Carver County jurisdiction. The City would receive the turnback
of old 101 from Lake Susan Drive north to a new cul-de-sac at the last house south by
Riley Creek. To date, no agency has programmed funds for this project. The
anticipated start date for construction is 2006. Several funding scenarios were
reviewed. The most promising funding mechanism is advancing county turnback
funds for this project. The proposed City portion of the project is shown on the
attached sheet. Most of the City share is being allocated to construction of trails and
the trial underpass. This is only a rough estimate since the design is still preliminary,
but it gives a sense of how much funds are being proposed from each agency and
what items each agency could be ask to contribute to. Also, attached to this
background is a letter from MnDOT stating their intent to build this project to
coincide with the TH 212 project. A Memorandum of Understanding (MOU) will be
drafted between the City, MnDOT and the County once most of the funding, design
and turnback issues have been resolved.
SW Metro Park-n-Ride
In conjunction with the TH 212 project, MnDOT has allocated approximately 10
acres of land at the southwest quadrant of TH 212 and TH 101 for a park-and-ride
facility. Of the 10 acres of land, three acres are being proposed to be used for the
park-n-ride. The other seven acres of land is being proposed from other uses, mostly
residential. This project is separate from the TH 212 municipal consent approval
process. Council will have opportunities to review the proposed park-n-ride project
prior to considering approval.
Lake Susan Drive
Several residents in the Lake Susan Drive area have raised concerns about potential
cut through traffic in conjunction with the TH 212 project. The current TH 212
design has the exit ramp of TH 101 on westbound TH 212 lining up with Lake Susan
Drive. Lake Susan Drive currently connects from TH 101 to Lyman Boulevard. The
new intersection of TH 101 and Lake Susan Drive will be a signalized intersection
with turn lanes off the exit ramp from TH 212. It is anticipated any traffic wanting to
access onto Lyman Boulevard south of TH 212 would exit off of Powers Boulevard.
Powers Boulevard is less then one mile from the TH 101 exit. Because of the short
proximity to TH 101, the speed of which drivers will be able to access Powers
Boulevard and Lyman Boulevard off of TH 212 verses the less safe and slower route
to go through Lake Susan Drive, it is anticipate that cut-through traffic will be
minimal.
Staff took traffic counts on Lake Susan Drive in 2002 and will take traffic counts
again this summer to quantify the amount of traffic currently using the road. We will
continue to monitor the traffic levels during and after construction of TH 212. If a
traffic problem is identified, the City will then take the appropriate measures to
correct the problem. We would request MnDOT play a role in addressing any future
traffic issues.
Sound Mitigation
One of the biggest concerns staff has heard l¥om residents on the TH 212 project is
the potential noise impacts that could be generated from traffic. Staff has and will
continue to work with MnDOT to construct sound mitigation structures where ever
possible in the construction con'idor. The current design meets all federal guidelines
for sound abatement.
FUNDING CITY PARTICIPATION
MnDOT's cost estimate for City participation on the project is still approximately
$2.5 million. These costs were identified at the February 23, 2004 council
worksession. Currently, funding for this work is being proposed from assessments,
municipal state aid and park dedication funds. It should be noted that these costs do
not include any proposed City water or sanitary sewer improvements. These utility
costs will be identified with the upcoming feasibility study for the 2005 MUSA area.

RESOLUTION FOR LAYOUT APPROVAL
CITY PROJECT NO. 03-09
WHEREAS, the Commissioner of Transportation has prepared a final layout for the
improvement of Trunk Highway 212 (TH 212) within the City of Chanhassen from the
westerly City limits to the easterly City limits; and seeks the City's approval; and
WHEREAS, the final layouts are on file in the Minnesota Department of Transportation
office, Roseville, Minnesota, being marked, labeled and identified as Layout No. 6, S.P.
1017-12, from R.P. west of Co. Rd. 147 to C.S.A.H. 4 (Eden Prairie Road); and
WHEREAS, improvements to City streets and appurtenances have been included in the
final layouts.
NOW, THEREFORE, BE IT RESOLVED that the final layout for the improvement of TH
212 within the corporate limits be and is hereby approved with the following conditions:
1. All construction activities shall be in compliance with City ordinances with
the exceptions allowed only through the approval of the City Council.
2. MnDOT will continue to work with City staff through the preliminary and
final design phases of the project to address traffic noise concerns, including the design
and installation of noise walls and berms at various locations along TH 212.
3. MnDOT will continue to work with City staff through the preliminary and
final design phases of the project to address screening and landscaping concerns at various
locations along TH 212.
4. MnDOT will continue to work with City staff through the preliminary and
final design phases of the project to address access concerns for the proposed park and ride
facility at the northeast comer of the Lyman Boulevard (CSAH 18) and TH 101
intersection.

5. MnDOT will work with City staff through the preliminary and final design
phases of the project to review alternatives to address concerns with cut-through traffic on
Lake Susan Drive.
6. MnDOT will continue to work with City staff to develop a design and
funding plan for the reconstruction of TH 101 between 86th Street and Lake Drive (see
attached letter from MnDOT) with the intent that this segment of TH 101 on a schedule
concurrent with the proposed construction schedule for TH 212. The turnback portion of
old TH 101 to the City shall be reconstructed to City pavement standards.
7. All changes recommended by the City and approved by MnDOT in the final
design shall be included in the plans and specifications.

Dear Mr. Gerhardt:
This letter serves to summarize the funding approach that was discussed at OUT meeting
on March 11, 2004 related to the TH ! 01 project between new TH 212 and TH 5.
Mn/DOT acknowledges that all of the details are not final at this time, however, we
would like to outline how we intend to proceed 'forward.
As was discussed at the meeting, Mn/DOT is proposing to transfer jurisdiction of
proposed TH 101 to Carver County from TH 5 and CSAH 18 (Lyman Blvd.) and in-place
TH 101 to the city of Chanhassen in the same vici~fity prior to completion of the new
TH 212. The realigned highway 101 would be constructed to County State Aid Highway
(CSAH) standards m~d Mn/DOT would apply the cost savings of making this change in
the TH212 Design/Build project towards the TH 101 project.
The attached sheet summarizes items for the TH 101 gap improvement project for both
existing and proposed highway 101, along with thc proposed jurisdictional responsibility.
Please note that items and costs listed are preliminary at this time and updates will made
as better information becomes available.
At this time Mn/DOT has resources working on project development activities for tiffs
project and is proceeding with the timing for the project to be coordinated with the new
TH 212 construction, subject to right of way and environmental process constraints.
Mn/DOT looks forward to a continued partnership with the City mhd Carver County in
working to finance m~d construct this project.
