Those that are here and those watching at home. In fact a special welcome to Troop 424 from Excelsior has a number of members here with us this evening. Appreciate you coming. Before we get started, there was one change on the agenda. Item number 2. We have been asked to defer that to a future council meeting, is that right Mr. Gerhardt? Todd Gerhardt: That's correct. Mayor Furlong: Okay, so if anybody's here for item number 2 we will not be addressing that this evening. And we expect that that will come back in a couple meetings to us at this point. Are there any other changes to the agenda this evening? If not, we'll keep it City Council Meeting - February 9, 2004 as published except for that one exception. We'd like to start out this evening with public announcements. We have the presentations of the 2003 Environmental Excellence Awards so I'd like to invite members of the Environmental Commission that are here to join me down in front if you would. PRESENTATION OF 2003 ENVIRONMENTAL EXCELLENCE AWARDS. Mayor Furlong: Good evening. Justin Rowlandson is here from the Chanhassen Elementary School. Or representation for the Chanhassen Elementary School. The Chanhassen Elementary School implemented a number of improvements to their current recycling program at the school, including distributing recycling bins to all the classrooms and creating recycling stations throughout the school. Students were very involved in this project, as well as special education class involved in collecting a number of recycled products, cardboard and other items throughout the school. It's resulted in an increased recycling participation and awareness for all the students. Like all the Environmental Excellence Awards, what the city looks for is using this as an opportunity to recognize environmental improvements within our city and good stewardship throughout the community. These awards are designed not only to recognize achievement, but also is a chance to communicate new ideas and encourage members of the Chanhassen city to make a difference. For each of the recipients tonight, we have two of them. They'll be receiving $50 in Chamber Bucks. Chanhassen Chamber Bucks, as well as a Certificate or plaque so Mr. Rowlandson, congratulations and we appreciate your efforts. Justin Rowlandson: Well I think just everybody in the school's done a great job. You know all the students and staff and everyone just pitching in together to make it really well so ! think everyone at my school deserves this so thank you very much. Mayor Furlong: Marcus. Marcus Ellson worked on a project as part of his Eagle Scout application. The project goal was to improve water quality by educating citizens on how runoff from streets and yards has a direct effect on our lakes and wetlands. He worked with the city staff to plan and coordinate the project and work with other scout troop members to carry out the work. It was a great project and made a difference in terms of improving the water quality over in the Lake Minnewashta area where they were. So Marcus, congratulations on your work. Thank you for your fine work. Marcus Ellson: All I'd like to say is it was a lot of fun to do this. I had a lot of help from a lot of people. First off, my parents helped me out a lot with that. And Lori Haak from the City of Chanhassen helped me get started with that, and then of course all my fellow scouts who came that day and just helped me out for a good 2-3 hours that day. CONSENT AGENDA: Councilman Peterson moved, Councilman Lundquist seconded to approve the following consent agenda items pursuant to the City Manager's recommendation: 2 City Council Meeting - February 9, 2004 Approval of Minutes: -City Council Summary & Verbatim Minutes dated January 26, 2004 Receive Commission Minutes: -Planning Commission Summary & Verbatim Minutes dated January 20, 2004 Approval of Lifeguard Contract for Lake Ann Beach, Minnetonka Community Education and Services Approval of an Application for an Exempt Gambling Permit to Conduct a Raffle, St. Hubert's Catholic Community, April 24, 2004. All voted in favor and the motion carried unanimously with a vote of 5 to 0. B. APPROVE CHANGE ORDER NO. 3 FOR HIGHWAY 101 NORTH TRAIL~ PROJECT 97-12-3. Councilman Ayotte: Thank you Mayor. On item l(b), the 101 trail project, I'm not so concerned about the amount of money, the $29,000 that we're talking towards but ! am curious to know, and we've had these discussions before, do we have a sense as to the use that we're getting out of this particular trail as compared to others? We've asked in the past to have some view of this, and I'm just taking this opportunity because ! saw a number of people walking down 101 trail, but when ! took a closer look it was the same guy wearing different sweaters, and you know who I'm talking about so. But do you have a sense of it and do you have a sense of this trail being in terms of the amount of money we spent, are we getting our ROI? Anybody. Matt Saam: ! guess ! would defer it to Todd Hoffman, our Parks Director to see what position he can give. Councilman Ayotte: Say thank you. Todd Hoffman: Thanks Matt. ! thought about this today. Todd talked about this and the only, we have no data on the use of the 101 trail. So it was an expensive piece of trail to install. The per lineal foot. All we know is that trails are ranked number one in our residential surveys. This is what people want. As far as a cost analysis, cost benefit analysis, there's nothing been prepared, and we've never done that quite honestly in any of our trail segments in the city. Councilman Ayotte: And I guess I've just dropped that dime for public consideration at some point because in terms of having an idea of repair and maintenance requirements, preventive maintenance, all those sorts of things and usage, it would be a good idea to know how the city's assets are being utilized and if the money we're spending is the right trend or the wrong trend. ! just bring that up so that maybe for future consideration we can take a look see, because we did talk about, when we passed this, to gauge the use of 101. I'm surprised we haven't. ! thought that was part of the direction from council. City Council Meeting - February 9, 2004 Todd Gerhardt: It's something we can try to look at. We drive by it, comments that I received today was, that you always see somebody out there utilizing the trail, either through a bicycle, walking or jogging along the trail. It's not like you can get a count like you do on automobiles but we'll see what we can do out there to see if we can get some kind of count, or pictures or something. Councilman Ayotte: Something. Even if it's a QA view of the world from those communities that are kind of blocked in there. We talked about that a little bit in the work session. Maybe meeting with a neighborhood group to get, at least a sense as to how they feel about it so that we can have an affirmation that we had done the right thing and continue to do the right thing. Todd Gerhardt: Sure. Councilman Ayotte: Thank you. Mayor Furlong: Thank you. Is there any other discussion or questions on this item? Councilman Ayotte: I feel comfortable with that as long as we react to it. Mayor Furlong: If not, is there a motion regarding, is there a motion to approve? Councilman Ayotte: Move to approve. Mayor Furlong: Is there a second? Councilman Lundquist: Second. Mayor Furlong: Any discussion on the motion? Resolution #2004-07: Councilman Ayotte moved, Councilman Lundquist seconded to approve Change Order No. 3 for Highway 101 North Trail, Project 97-12-3. All voted in favor and the motion carried unanimously with a vote of 5 to 0. APPROVAL OF REQUEST FOR A SPECIAL EVENT PARKING PERMIT FOR A WEDDING RECEPTION~ NORTH LOTUS LAKE PARK~ MIKE & GLORIA LYNCH~ 6630 HORSESHOE CURVE. Councilman Ayotte: The wedding party. Is this, Mr. Hoffman, is this a, I know it's not an atypical event but do you have an idea of how many permits like this we've issued? Todd Hoffman: A couple a year. A couple each summer. Councilman Ayotte: A couple a year? And do we do anything with regard to, before people start partying down, like we do with an environmental baseline, is there a 4 City Council Meeting - February 9, 2004 predictable and standardized way that we look at the park before the event and go back and look at the park after the event to see if we've had any issue during the, in this case wedding? Todd Hoffman: On all our reservations we do that. In this case they're just asking to park cars there and then shuttle people up to their residence because there's limited parking at their residence so we'll check the location the following morning. See if there's any issues and if there are any issues of, big issues, we'd probably hear about then but. Councilman Ayotte: Okay. And one other question with regard to the folks in the neighborhood. Do we ever go out, as we do with other activities and let the neighbors know that we're going to have an event or no? Todd Hoffman: No. Councilman Ayotte: Okay. And we haven't had a problem in the past with this sort of activity, complaints? Todd Hoffman: No. The reason we're bringing it to the council, it's a special event request, because it's going past the 10:00 and so many of the parks close, there may be a few cars left in the park after that and we want to make sure that the council and public safety people were aware of that. Mayor Furlong: Councilman Labatt. Councilman Labatt: What sort of program is going to be at the fields at this park on this day or field users will be put off and have to park elsewhere? Todd Hoffman: No reservations on Saturdays. There's 36 spots available. They don't predict that they'll use those, all of those spots. Councilman Labatt: So there's no soccer games in the field? Todd Hoffman: That day, no. parks on weekends for activity. scheduled activities on the site. Not scheduled. We do not schedule the neighborhood There may be some pick-up games going on but no Councilman Labatt: Okay, so no athletic association will be put out. Todd Hoffman: Correct. Councilman Labatt: My only concern is maybe 36 stalls is going to be enough in some minds but ! look at what happens at Lake Ann Park once in a while on busy days. With kids activities and people park out on the grass and if it's raining this day and people choose to park on the grass, potentially damage to the grass area so ! would suggest City Council Meeting - February 9, 2004 maybe some sort of damage deposit where if there's no, we take an assessment of what the parking lot is like and the grass on a Friday and then Monday, or on Sunday if somebody's in, they go and look and see if there's any damage to it. Mayor Furlong: Other questions or discussion? Councilman Ayotte: It'd just make me feel warm if we did that. Something like that. Councilman Peterson: Sounds like overkill. Councilman Ayotte: What's the cost of the permit? Todd Hoffman: Not enough. Councilman Ayotte: Well then that really makes me feel warm. Mayor Furlong: Well ! think as ! understand it, and correct me if I'm wrong. What heard is that if they weren't extending past the 10:00 park time, would they even be coming for the permit? Todd Hoffman: No. Mayor Furlong: They wouldn't have to. So really we're just looking at that period between 10:00 and 1:00 that they're looking for. I'm wondering ! guess if we can you know, we've got deputies out on patrol anyway probably going through this neighborhood once or twice, knowing that that event's taking place at those hours. Having them swing by and see if there's any issue, including parking on the grass, and if there is, get in touch with the people hosting the party and have them clean it up. And if there's damage, we'll know who is it as well. Councilman Ayotte: What do we do if there is damage? Todd Gerhardt: Our crews will go out and make the repairs to it. Councilman Ayotte: Well ! know that. Who's going to pay for the darn thing? Todd Gerhardt: We'll try to go back and get the applicant to make those, come up with the money to fix them. Councilman Ayotte: Well if you put 100 bucks down on the table and you get the 100 bucks back after the fact, you know. Councilman Lundquist: It's not going to be 100 bucks if they wreck the grass. It's going to be $10,000. They're not going to put that kind of deposit down anyway so what's the difference? City Council Meeting - February 9, 2004 Todd Gerhardt: Mayor and council, what we were trying to do in this application is to make the situation a safer situation. If they choose not to put the money down, they're going to park along Pleasant View, and if anybody has driven along Pleasant View, it's a dangerous road in the current condition it's in. Having. Councilman Ayotte: I'm just worried about damage to the park. I agree that it ought to pass but I'm just interested in making sure that we mitigate risk to the area, because if it gets out of hand, and ! suspect, will there be wine at the. Todd Hoffman: Event? ! do not know. ! do know Mr. Lynch. He's the past Chair of our Park Commission for probably some dozen years. He's a Boy Scout leader in town. He called simply out of courtesy and ! believe he'll be very respectful of the situation and would personally feel very responsible if there was any damage done to the park. Councilman Ayotte: Alright. At the minimum ! do like the idea of just having a little bit more adult supervision so we do mitigate risk to the property, and if the rest of the council feels uncomfortable about Councilman Labatt's recommendation, and ! hear your point. It's a good point. You know 100 bucks isn't going to do anything but, and we want this sort of thing to happen. We want this because it does mitigate risk on the streets and so on but. Mayor Furlong: Agreed. Councilman Ayotte: I'm just saying to re-state the concern and to possibly ask for a few more drive by's is not a bad thing. Mayor Furlong: Well and ! think, and can we do that Mr. Gerhardt, Mr. Hoffman, emphasize the concerns raised here tonight to Mr. and Mrs. Lynch and also work with Sergeant Olson to make sure that they watch for that. Councilman Ayotte: Could we have Mr. Hoffman put a damage deposit down? Mayor Furlong: Absolutely. Councilman Lundquist: He might be at the wedding. Mayor Furlong: Absolutely. City Council Meeting - February 9, 2004 Councilman Ayotte moved, Councilman Peterson seconded to approve the request for a special event parking permit for a wedding reception, North Lotus Lake Park, Mike & Gloria Lynch, 6630 Horseshoe Curve. All voted in favor and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS: None. COUNCIL PRESENTATIONS: None. ADMINISTRATIVE PRESENTATIONS: Todd Gerhardt: Just a reminder that the City Council will be meeting on the 17th at 5:30 in the courtyard conference room to continue their strategic planning session. Mayor Furlong: Thank you. Any questions for Mr. Gerhardt or staff?. I guess just one comment. Some feedback, if you can extend it to the staff and that's in regard to the snowplowing that our staff has been doing for the last few weeks. ! think it' s been going great. ! haven't received any calls so that's a good sign and if you could just, ! know they've been putting in some long hours, especially last weekend with the multiple day snowstorms and again this week and the one today so we appreciate their efforts. Todd Gerhardt: I'll pass that on. I'd also like to thank Todd Hoffman and his crew for the February Festival this past weekend. Great job on predicting the weather. Just perfect. Mayor Furlong: You guaranteed it for me so I wasn't surprised. Very good. No, that was a great event. Hundreds of people were out on the ice fishing and it was just a lot of fun. Lot of fun. Any other items for administrative presentations? Councilman Peterson: Where are we at with applicants and interviews for the open commission seats? Todd Gerhardt: We're slowly getting them in. We could still use more. ! don't have the exact count, but ! do believe we have enough to fill the vacancies. But we did run ads in the paper twice so if anybody is interested in joining our Senior Commission, Planning Commission, Park and Rec Commission, and Southwest Metro Transit ! believe is closed. No, it's still open? We have vacancies or will be interviewing here ! believe in March for those positions. So to access the applications, you can either come in to City Hall or we have them on our web site which you can download from there. Mayor Furlong: Very good question. Schedule that just for anybody listening, we'll want those applications in this week, is that right? The 13th. Kate Aanenson: Friday. City Council Meeting - February 9, 2004 Mayor Furlong: Friday, and if people have questions, feel free to call City Hall and you'll be directed to somebody that can give you more information about a particular commission.
