March 31, 2004 Request for Funding, Streambank Stabilization Project, Christmas Lake Homeowners Association APPROVAL Approval of this item requires a simple majority vote of those members present. BACKGROUND The City of Chanhassen has a history of partnership with the Christmas Lake Homeowners Association ("Association"). In 1996, the cities of Chanhassen and Shorewood cooperated with the Association to write the Christmas Lake Management Plan. The plan summarized water quality data on the lake and established high priority projects, medium priority projects and future projects to consider (Attachment 1). In 1996, the City of Chanhassen rehabilitated the Curry Farms subwatershed pond and stabilized the portion of Curry Creek directly east of Powers Boulevard. The creek stabilization project was not able to proceed along the creek's length to Christmas Lake because the City did not control the entire length. PRO,IECT The Association is now interested in completing the Curry Creek stabilization project. Preliminary restoration plans (completed in 1995) were used to obtain quotes from two contractors. The Association will be responsible for gaining permissions for access, securing all contracts, project design, construction, site restoration and project management. The Association has spoken to property owners along the creek, who have expressed support for the project but, to the knowledge of staff, have not yet provided written authorization to grant access. The Cily of Chanhassen, A growing community with clean lakes, quality schools a charming downtown thriving businesses, winding trails and beautifui parks A great place t,n live work, and play' Request for Funding, Christmas Lake Homeowners Association March 31, 2004 REQUEST In order to complete the remainder of the stabilization project, Association President Greg Swirtz sent a letter on March 9, 2004 (Attachment 2) requesting a $30,000 contribution from the City of Chanhassen. This request is consistent with the $30,000 contribution that was identified in the Christmas Lake Management Plan (Attachment 3). The total estimated cost is $69,000. The rest of the cost (approximately $39,000) will be covered through homeowner participation and public grants, where applicable. The funding for this project falls under the SWMP implementation item (Project # SWMP-012) in the 2004-2008 Capital Improvement Program. At present, there is $105,000 available for SWMP-012 projects (Attachment 4). The stabilization project is one of two projects anticipated in 2004, with the other being a regional storm water pond in the Frontier Trail area of Lotus Lake. An engineer's estimate of cost has not been done for the Frontier Trail project, but the Surface Water Management Plan (1994) estimates a cost of $51,628. Adjusting that number to a 2004 cost based on the Construction Cost Index results in a cost estimate of $67,633. This is less than the $75,000 that will remain in the CIP for SWMP-012 projects. RECOMMENDATION Staff recommends the City Council authorize the Mayor and City Manager to sign the agreement with the Christmas Lake Homeowners Association (Attachment 5). In authorizing execution of the agreement, the City Council approves the reimbursement of the Association in the amount of $30,000 for project design and construction, provided staff first reviews and approves the plans and specifications. In previous conversations the City of Chanhassen had agreed to share in the cost of improving water quality issues pertaining to Bretton Pond and Curry Creek as it impacts Christmas Lake. The City of Chanhassen did take care of Bretton Pond but the Curry Creek project has not been completed as of this date. The request is for the City of Chanhassen to contribute $30,000 towards the total cost of $69,000 to complete the stream bank stabilization with gabions project.. Our Mission is to improve the water quality of Christmas Lake by trying to recreate the natural state of the lake before agricultural and residential development. The natural state should include predevelopment chemical make up, aquatic plant and animal populations, and natural type shore vegetation. This will be financed through homeowner participation and public grants. I am asking for your help in completing the process with the City of Chanhassen's commitment of $30,000 toward the repair of the above mentioned creek. Our goal is to limit phosphorus concentration in runoff.to 160 ppb (now=610 ppb) leaving Bretton Pond and 1,300 ppb at the mouth of the Curry Creek, and in addition reduce silt to 14,000 pounds per year (now -- 154,000 pounds per year). Christmas Lake is the "Crown Jewel" of southern Minnesota lakes and with the City of Chanhassen's help we can keep it that way. No map. 110 AGREEMENT AGREEMENT entered into this . day of ,2004, by and between the CITY OF CHANHASSEN, a Minnesota municipal corporation ("City") and the CHRISTMAS LAKE HOMEOWNERS ASSOCIATION ("HOA"). RECITALS A. In 1996 the City, the HOA, and the City of Shorewood cooperated in the preparation of the Christmas Lake Management Plan. B. A priority goal of the Management Plan is streambank stabilization to reduce silt entering Christmas Lake. C. In 1996 a portion of the streambank stabilization was completed. The proposed project will now complete the stabilization. D. The City supports the project and finds that it would improve water quality in Christmas Lake. NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. PROJECT DESIGN AND CONSTRUCTION. The HOA will have prepared plans and specifications for the completion of Curry Creek stabilization. The plans and specifications shall be subject to the review and approval of City staff. After approval of the plans and specifications by City staff, the HOA will enter into contracts to complete the work. The HOA will administer the contracts and pay the contractors. The City will not be a party to the contracts or responsible for the work. 2. COST ALLOCATION. The City will reimburse the HOA $30,000.00 of the project cost. The balance of the project cost, estimated to be $39,000.00, shall be paid by the HOA. Payment to the HOA shall be made upon project completion.
