Vacation of a Public Sewer & Water Easement within the Hidden
Creek Development - Vacation File No. 2004-03
REQUEST (Simple Majority Vote Required)
Staff has received a request fi'om Rick Vogelgesang, the developer of the Hidden
Creek subdivision, to vacate an existing public sanitary sewer and water easement
within the Hidden Creek development.
BACKGROUND
The existing 30-foot wide public easement was granted to the City as a part of
City Project No. 73-1 in 1973.
The Hidden Creek development was plated in July, 2002.
DISCUSSION
Prior to the development of the Hidden Creek property, the City had existing
sewer and water lines within the property. These sewer and water lines were
contained in 30-foot wide public easements throughout the property. With the
development and platting of the Hidden Creek property, a large portion of the
sewer and water lines fell within new dedicated right-of-way. There was also a
portion of the existing lines that were moved during construction of the project.
The moved lines had new easements dedicated over them. The remaining sewer
and water lines outside of the right-of-way also had new easements dedicated over
them on the final plat.
In order to remove the old easement encumbrances on the new Hidden Creek lots,
the developer has requested the City to vacate the old easements. Staff has no
objection to this since all of the sanitary sewer and water lines within the property
are either contained within new right-of-way or easements.
RECOMMENDATION
Staff recommends that the City Council adopt the following motion:
