Vacation of a Landscape Conservation Easement located on Lot 6, Block
1, Chanhassen Business Center, Boedecker Company
On January 13, 1992, the City Council approved the preliminary PUD and plat for the
Chanhassen Business Center as shown on the attached plan. The PUD was approved on
February 8, 1993.
Tile PUD contains a set of standards, which all buildings must comply with. Tile
standard for setbacks is as follow:
c. Setbacks
Ill tile PUD standards, there is tile requirement for landscape buffering in addition to
building and parking setbacks. The landscape buffer on Audubon Road is 50 feeh
south of Lake Drive and 100 feet along the southern property line. The PUD zone
requires a building to be setback 50 feet from the required landscape buffer and public
right-of-ways. There is no minimum requirement for setbacks on interior lot lines.
Tile City recorded a landscape conservation easement over the required buffer which was
intended to cover the area south of Lake Drive West and the southern portion of the
property. As the owner of the Boedecker building was conducting a title search for the
lot, it was realized that the buffer of 50 feet along Audubon Road, south of Lake Drive,
was incorrectly recorded against the portion that extends north of Lake Drive. A parking
lot and a building encroach into that space and the applicant is requesting vacation of this
easelnent. Staff is recommending approval of the vacation.
RECOMMENDATION
Staff recommends the City Council recommend approval of vacation of the conservation
easement located on Lot 6, Block 1, Chanhassen Business Center 2nd Addition with the
following condition:
The applicant shall provide a legal description of the conservation easement
proposed to be vacated and provide the correct legal description for the
conservation easement to cover the area south of Lake Drive West.
