Waste; Approval of Summary Ordinance for Publication Purposes
ACTION REQUIRED
A simple majority vote of City Council members present is required to adopt the
amendment; however, a 4/5ths vote is required for approval of the summary
ordinance for publication purposes.
BACKGROUND
This item was reviewed previously by the City Council on April 26, 2004 and
tabled for additional information.
Waste Management is requesting a change in the Solid Waste ordinance to allow
for bi-weekly collection of recyclables. They are planning on implementing a
new recycling system that would be a single-sort system (all recycling mixed
together) using 60 gallon carts. The larger volume of the carts, as opposed to the
traditional bins, allows the hauler to collect the recyclables every other week.
Additional changes to the ordinances were proposed as a result of this request.
SUMMARY
Section 16-33 (4). In response to City Council concern that waste haulers would
go to a bi-weekly recycling collection without changing their operation, any
hauler providing bi-weekly recycling pickup would need to provide at a minimum
a 35-gallon, enclosed container for residential customers. The 35-gallon container
is the smallest enclosed container used by all haulers. The typical recycling bin is
an 18-gallon, opened container.
Section 16-33 (5). The amendments in this section of the ordinance requiring
haulers to use recycling facilities with 95 percent recycling rates were
recommended by the Environmental Commission. After discussion with the
hauler, other cities and state agencies, the Environmental Commission determined
that while a 95 percent recycling rate was achievable by material recovery
facilities (MRF), the most important outcome should be informing the public of
their hauler's recycling rate so that the customers can make an educated choice in

their- selection of a hauler. The addition of an annual report to customers that will include the
hauler's facility's recycling rate has been made. As a result of this change, the clause referring
to the 95% recycling rate has been deleted from the ordinance.
The city has received the 2003 recycling data from Waste Management. These numbers can
serve as a base to determine whether there is an increase in the volume of recyclables, as
documented in other cities.
Benefits, single sort / bi-weekly recycling collection:
May increase volume of recyclables
Convenient - cart is easy to roll to curb
Choice - consumer chooses size of cart
Consumers do not have to sort recyclables
Less litter- covered container' keeps materials inside
Negatives, single sort / bi-weekly collection:

Cart contents not visible - more chance of garbage/non-recyclables being included

Staff is recommending approval of the amendment.
RECOMMENDATION
Staff is recommending that the City Council adopt the attached ordinance for Chapter 16 of the
Chanhassen City Code; and approve the summary ordinance for publication purposes.

CHANHASSEN CITY CODE,
SOLID WASTES
THE CITY COUNCIL OF THE CITY OF CHANHASSEN, MINNESOTA ORDAINS:
Section 1. Chapter 16, Article I, Section 16-1 of the City Code, City of Chanhassen,
Minnesota, is hereby repealed.
Section 2. Section 16-2 (a) of the City Code, City of Chanhassen, Minnesota, is hereby
amended to read as follows:
All persons shall dispose of refuse and garbage as provided in this chapter. Refuse
and garbage shall be disposed of at least once each week fi'om residential and multifamily
dwellings. Refuse and garbage of any commercial establishment shall be disposed of at
least once each week, and at more frequent intervals if deemed necessary to protect the
public health, and on order of the city. Refuse or garbage shall not be permitted to
accumulate on any property within the city so as to constitute a nuisance by reason of
appearance, odor, sanitation, or so as to create a fire or health hazard.
Section 3. Section 16-33 of the City Code, City of Chanhassen, Minnesota, is hereby
amended to read as Follows:
Operating requirements.
A licensed hauler must comply with the following requirements. Failure to observe these
provisions may be a basis for suspension or revocation of a license:
(1)
Manner. The licensee shall operate in a manner consistent with its application
materials and shall provide notice to the city within ten (10) days of any change in
the information.
(2)
Hours of collection. No collection of mixed municipal solid waste or recyclable
materials shall be made from a residential dwelling nor may a waste hauler
operate within a residential area except between the hours of 7:00 a.m. and 6:00
p.m., Monday through Friday. Operations during these hours may also be
conducted on Saturday, to accommodate recognized national holidays or a special
pickup. No collection of yard waste from a residential dwelling shall be made
except between the hours of 7:00 a.m. and 6:00 p.m., Monday through Saturday.
Customers shall be reasonably notified of the specific day and hours for collection
of their yard waste, mixed municipal solid waste, and/or recyclables and the
licensee shall collect the materials within those time periods.
(3) Vehicles; maintenance. Each licensed hauler shall only use vehicles and
equipment so constructed that the contents will not leak or spill. The vehicles and
equipment shall also be kept clean and as fl'ee fi'om offensive odors as possible,
and shall not stand in any street, alley, or public place longer than is reasonably
necessary to collect mixed municipal solid waste, yard waste, and/or recyclables.
The license shall also ensure that the collection site is left tidy and free of litter.
(4) Opportunity to recycle: collection. Each licensed hauler shall provide its
customers with an opportunity to recycle through the weekly or bi-weekly
curbside collection of targeted recyclables. Any hauler providing bi-weekly
recycling pickup must provide, at a minimum, a 35 gallon, enclosed container for
residential customers. The curbside collection of targeted recyclables shall be on
the same day as the collection of the customer's mixed municipal solid waste, but
may occur at a different time within that day. The targeted recyclables collection
shall be from a location at or near the customer's mixed municipal solid waste
collection site, 07' such other location mutually agreeable to the hauler and the
customer. The licensee may specify how a customer is to place and prepare their
targeted recyclables for collections. The licensee must provide this information to
their customers in writing on an annual basis. In addition, annually the hauler
shall provide their customers with their Material Recovery Facility's recycling
rate. The city must also be provided a copy of this information on an annual
basis. The licensee is also deemed the owner of the recyclables and upon
collections, the licensee may market them. Nothing herein shall be construed to
prevent a licensee from offering curbside collection for other recyclable materials,
in addition to the targeted recyclables.
(5) Monthly report on mixed recyclables. Each licensee shall submit a monthly
report to the city of the weight, in tons, of mixed recyclables collected by the
licensee in Chanhassen. The report shall be provided on or before the twentieth
day of the month following the close of the previous month and shall be on a form
provided by the city. The report shall also identify the estimated weight of each
type of collected recyclable, distinguish residential collection tonnage from
commercial/industrial tonnage, the location of the recycling facilities or end
markets to which all materials are delivered, the recycling rate of the facility, and
describe how the weights were calculated. Upon written notice to the licensee,
the city may require similar reports on other materials picked up by the licensee.
(6) Char~e&tbr service. Licensed mixed municipal solid waste haulers may not
charge their customers a flat fee rate. To the extent possible, charges shall be
based upon the volume 07' weight of mixed municipal solid waste that is collected.
Licensed haulers may not impose greater charges on residents or businesses that
recycle than on those who do not recycle.
(7)
Recvclables. Recyclables may not be disposed of at a landfill or incinerated. All
recyclables must be recycled. Licensed haulers shall not mix source-separated
materials with mixed municipal solid waste or handle source-separated materials
in any way that reduces the reusability or marketability of the source-separated
material. Licensed haulers must notify the customer if recyclable materials are
contaminated or not sorted correctly. The notification must be in writing stating
the violation and corrective measures and it must be presented at the time of
collection.
(8)
Desig~ated sanitary landfill. Mixed municipal solid waste collected from sources
other than public entities may only be disposed of at a designated sanitary landfill
or other facility authorized by the county. All mixed municipal solid wastes
collected from any public entity within Chanhassen must be managed according
to the Carver County waste management hierarchy.
Section 4. This ordinance shall be effective immediately upon its passage and
publication.

Mixed municipal solid waste means garbage, refuse, an other solid waste fi-om residential,
commercial, industrial and community activities which is generated and collected in
aggregate, but excluding auto hulks or large auto parts, street sweepings, ash,
construction debris, mining waste, sludges, household hazardous waste, tree and
agricultural wastes, tires, lead acid batteries, used el! motor and vehicle fluids and
filters, yard waste, and other materials collected, processed and disposed of as separate
waster streams.

*Item 2. We have elinzinaled the garbage hauler lintitations within the nuisance section
of the ordinance. Commercial pickup within residential areas is limited to the same
hours as the residential pickup.
*Item 4. This addition reflects the public feedback concerning what and how materials
can be recycled. Haulers currently do not seem lo provide lhis infomnation as frequently
as it appears to be needed. After the city initiated the ordinance review of Chapter 16,
Waste Management requested a change in the ordinance to allow [br bi-weekly collection
of recyclables. The hauler would supply customers with 60 gallon carts. The increased
volume of the carts allows the hauler to make bi-weekly instead of weekly collections.
7'he Environmental Commission reviewed the materials presented by a Waste
Management representative and recommends that the ordinance be changed with the
condition that all haulers must use recycling facilities that meeI a 93% recycling rate.
This rate is commonly achieved at sites and is not an undue burden to haulers. The
condition was added in order to address the greatest concern of the commission that
being the amount of residuals generated with single-sort recycling. Residuals are
materials that are not able to be recycled and titus become solid waste. 7'he mosl
significant component of residuals in both single-sort and re, o-stream (separating paper
from everything else) is glass.
*Item 5. This change reflects the need for more up-to-date attd thorough in/brmation on
solid waste management by the city's licensed/tattlers.
The Environmental Commission recommends that all haulers submit monthly reports
documenting ct 95% recycling rate at the recovery facility they use. Haulers are already
required to submit monthly reports on the amount of recycling they collect and therefore
are not burdened by also including facility information as well. The commission will
track the submittals with support from the city staf~i
*Bent 6. Haulers may not be allowed to charge a higher rate to those who recycle in
order to discourage the practice and thereby reduce the hauler's expenses.
*Item 7. Haulers must ,take every e~'ort to recycle properly and not reduce their
recycling ef~rts by ignoring violations by customers.
*Item 8. This change reflects Minnesota State Statute 115A.46, subd. 5, Waste

The Environmental Commission sub committee met to discuss the ordinance change to section 16-33 (4). The Committee
recommends approval of the change to allow bi-weekly collection of single sort material with the following conditions:
To ensure that all recyclable material collected are managed properly, haulers must utilize a facility that has a minimum recycling
rate of 95%. Utilizing glass as daily cover for landfills is not considered recycling and can not be used in calculated recycling rate.
The hauler must report to the city through the Environmental Commission the facilities they utilize and the facilities residential and
commercial recycling and residual rates.
If facility is not in compliance with the 95% recycling rate it must provide a written explanation and provide corrective measures
that will ensure compliance within 30 days.

I look Ibrward to meeting with the Chanhassen City Council on Monday, April 12th to
further explain Single-Sort Recycling and thc many benefits it offers. As you arc aware,
in order for tis to utilize the system in Chanhassen it is necessary to amend your
ordinances allowing for the opportunity to establish a "bi-weekly" pick-up schedule.
Single-Sort Recycling allows residents to simply co-mingle all recyclables in one
container. Thus, proven to increase participation on average 15% in other communities.
At the same time, the program creates less wear and tear on streets, and is much safer for
everyone involved. Currently, over 150,000 homeowners throughout the Twin Cities
Metro Area Recycle the Single-Sort way.
There is no doubt the recent popularity' of Single-Sort has stirred debates, just like a
decade ago when commingled recycling became the norm, or even a little further back
when curbside recycling was first introduced. The opponents have expressed their
concerns over two main issues:

Restricts Competition - Waste Management views Single-sort as an advantage to
its customers. The convenience attributes to a rise in recycling participation.
That's a pretty significant environmental advantage. Over time, most companies
adapt to these type changes in the marketplace.
Increases Contmnination - Reports have shown the amount of Residue
(Unrecovered/Non-Recycable) picked-up at the curb remains approximately 5%
of the total amount of material taken. Even if residue amounts increased, the
additional volmne of material recovered more than oflkets potential contaminates.
Waste Management has made significant investments in equipment capable of
sorting the material and is in our best interest to produce clem~ commodities.

Dear Gary;
Thank-you fbr forwarding documents relating to discussions at the City of Roseville regarding single stream
collection and processing. Frankly, I am surprised at some of the statements made in the document. In an effort to
provide information relative to the comments, I have prepared the following points for our discussions with the city
council members. These comments include information about production at the Twin Cities MRF (TCMRF),
materials stream components and quality as well as comments in response to statements in the City's document.
Production Information
· The TCMRF has successfully recovered and shipped ~nore than 80,000 tons of recyclables this year through
July 31. This is approximately I 1,000 tons per month.
· The recovery rate at the TCMRF is nearly 95 percent for the year through July 3 l.
· The TCMRF reported a recovery rate of approximately 97 percent to the State of Minnesota for 2002. The
difference from year to year is largely the result more commercial and out-State material of lower quality being
delivered to the facility in 2003.
· The TCMRF receives materials generated by both businesses and residents with materials being processed on
three processing lines.
· Residentially generated materials account for approximately 70 percent of the materials processed at the
facility.
Material Components and (~uality
· The largest component of residentially generated materials is paper, at approximately 73 percent of the total
residential stream. Of this component, newspaper is the largest contributor, representing 77 percent of the fiber
component or 56 percent of the total residential stream.
· Glass represents approximately 15 percent of the residential recycling stream.
· All of the newspaper recovered at the TCMRF is marketed as #8 deink news in contrast to the lower grades of
#6 news or residential mixed fiber.
· Newspaper from the TCMRF is regularly tested for quality by bale audits. Multiple news mills conducting
their own independent audits have confirmed results from these audits.
· Consuming mills have expressed a high degree of satisfaction with paper produced by the TCMRF, being on
par or better than paper from other suppliers, including paper from two-stream collection programs.
· The TCMRF actively partners with Bowater - Thunder Bay, the largest newspaper mill in North America, to
meet the highest quality standards for production. (See the attached letter)
Residentially generated materials delivered to the TCMRF are processed on the same equipment regardless of
collection method (single stream, two-stream or source separated for bottles and cans).
The single stream processing equipment is used to process the fiber fraction collected in two-stream programs
in addition to materials collected as single stream. Single stream material represents in excess of 90 percent of
the total material tributary to the processing line.
Comment in Response
· The TCMRF does market paper to the Weyerhaeuser Cedar River Ihcility. For 2003, nearly 900 tons of
product has been shipped to Weyerhaeuser on a regular and on-going basis.
I have never indicated that Waste Management has "no plans" to determine a single stream residual rate. To
accomplish this task, single stream material must be run exclusively at the plant, a luxury Waste Management
has not had since 2002 due to the receipt of 600 tons per day from a multitude of customers.
· In early 2002, the TCMRF did process single stream material exclusively. The residual rate for this exclusive
processing was approximately 5-6 percent, on par with two-stream collection processing and in keeping with
current recovery rates.
· The TCMRF ships glass to a number of end-users, including Anchor Glass.
· One of the outlets for mixed colored glass is Recycle America's automated optical sorting facility, that in-turn
ships product to glass mills. Through a period of this summer, this was the major outlet for mixed glass from
the TCMRF until a recent market driven cutback in buying by glass mills.
· The TCMRF provides mixed color glass as a replacement for aggregate materials, including landfills. As an
aggregate replacement, the glass substitutes for other materials used in road building, drainage and other
construction activities. One of the beneficial uses, mainly in the winter, is alternative daily cover.
· Alternative or secondary reuse of recycled materials has long been recognized as advantageous, not negative,
for the overall success of the recycling industry as a way to expand recovery opportunities. Witness these
examples of other opportunities:
Residential fiber shredded for use as animal bedding
Plastic bottles used for drain tiles, fatigue mats and one-time use mats
Newspaper used for building insulation, ceiling tiles, cat litter and absorbents
Textiles used lbr rags and wipers.
Waste Management respectfully submits that St. Paul, through its exclusive service provider Eureka Recycling,
did not extend its contract for recycling services due to the differing business interests of Eureka Recycling, a
business competitor of Waste Management.

Keep in mind, the 85115 rule is a requirement for tax exclusion, nol: a definition of recycling. In other
words, a "recycling" facility may recover less than 85 percent and still be termed a recycling facility.
I would strongly suggest the language be changed to "Haulers must use recycling facilities that meet a
90 percent recycling rate" and omit "Utilizing glass as daily cover for landfills is not considered recycling
and cannot be used in calculating the rate", Otherwise, you will find ALL haulers in non-compliance
utilizing a two-sort or single-sort system

Dear Ms. Johnson;
In accordance with Minnesota Rule 7035.2845, please accept this letter as our annual report
complying with Subpart 4a. This letter reports infom~ation for the Twin Cities Materials
Recovery Facility (TCMRF) operated by Recycle America Allim~ce (a subsidiary of Waste
Management) during 2003.
This facility received source-separated recyclable materials generated by residential and
commercial customers. Materials are sorted to various grades of product (i.e. glass, alumimma,
newspaper, etc.) and recovered for beneficial use. No unsorted waste materials are received at
the facility. The facility will continue to operate in 2004_ The infommtion for the facihty is
reported in Attaclmaent A to this letter.
In accordm~ce with Subpart 5 of the Rule 7035.2845, the TCMRF has prepared and maintained a
contingency action plan.
