Office/Industrial // t.,,IJUl L t ' 1 Essex Rd ~ ~ Chanhassen Lakes Business Park 7th Addition Vacation of Drainage and Utility Easements August 9, 1999 Page 2 BACKGROUND On July 26, 1999, the City Council approved the following with conditions: 99-9 SUB 99-14 SPR 99-2 CUP 1) Preliminary Plat to replat Lots 9 and 10, Block 1, Chanhassen Lakes Business Park 7th Addition into Lots 1, 2, 3, Block 1, and Outlots A and B, Chanhassen Lakes Business Park 8th Addition. 2) Site Plan Review for the construction of a 20,195 square foot Day Care Center and office/warehouse building. 3) Conditional Use Permit to Allow a Day Care Center in an IOP District VACATION There are utility and drainage easements that were dedicated over Lots 9 and 10, Block 1, Chanhassen Lakes Business Park 7th Addition. Since these two lots have been replatted into the 8th Addition, the easements are no longer in the public's interest to retain. No activity has taken place on this plat with the exception of grading. New drainage and utility easements will be dedicated with the plat of Chanhassen Lakes Business Park 8th Addition. Staff is recommending approval of the vacation of the drainage and utility easements as shown in attachment #1 with conditions. RECOMMENDATION Staff recommends the City Council adopt the following motion: "The City Council approves Vacation 99-5 of the utility and drainage easements over Lots 9 and 10, Block 1, Chanhassen Lakes Business Park 7th Addition as shown in attachment # 1, subject to the following condition: 1. The applicant shall provide the city with the legal description of the easements proposed to be vacated. 2. The vacation is contingent upon recording of the Chanhassen Lakes Business Park 8th Addition's Plat and dedicating the necessary utility and drainage easements." ATTACHMENTS 1.
