Benson, City Engineer ~ February 2, 1999 Approve Cooperative Agreement with Chaska for Temporary Traffic Signal at Trunk Highway 41 and 82"d Street West - Project No. 97-1B-3 The need for a traffic signal installation at the above-referenced location was identified in 1995 by the City of Chaska. Now with the development of the Arboretum Business Park property, the developer has requested the City proceed with the installation of the temporary traffic signal. The attached agreement outlines the mutual understanding between Chanhassen and Chaska regarding the methodology by which the installation and maintenance of a temporary traffic signal will occur. Chanhassen will assume all responsibilities for project initiation and contract administration as this project was identified in the Arboretum Business Park public improvements feasibility study. Chanhassen's share of the construction cost for the temporary traffic signal is estimated to be $50,000 as identified in the feasibility study for the Arboretum Business Park public improvements. Pending MnDOT approval of the signalization project, the local share of the project shall be paid 50% by Chaska and 50% by Chanhassen as outlined in the attached signal agreement. It is unknown at this time whether or not MnDOT will participate in funding for this temporary traffic signal installation. The property is being reviewed by the City of Chanhassen relative to platting and site plan review. We are requesting that the city begin the process to install the traffic light at the Highway 41 and 82nd Street intersection. Kwik Trip would like to coordinate the completion of the traffic light with their occupancy in the summer of 1999. That area of the City of Chaska abutting and in the vicinity of 82nd Street West and Trunk Highway 41 is essentially developed with industrial properties~ RECITAL NO. 2 That the areas of Chanhassen abutting and in the vichfity of 82nd Stree'~ West and Trunk Highway 41 are in the process of being developed with industrial and related land useso RECITAL NO. 3 It is the desire of both Chaska and Chanhassen~ as a result of the significant traffic at the intersection of 82nd Street West and Trunk Highway 41, for the health, safety and welfare of its citizens, and for the orderly movement of traffic at said intersection, to install temporary signal lights at said intersection. RECITAL NO. 5 For purposes of the Agreement, "local share" shall be any cost of temporary signalization at the intersection of Trunk Highway 41 and 82nd Street West which are not paid by the federal, state or county government; and shall include, but not be limited to, actual cost of engineering and design of the signalization, actual costs of construction and materials for signalization, conduits, redesign and construction of streets, turning lanes, acceleration lanes, deceleration lanes, etc. RECITAL NO. 6 It is the desire of the parties to enter into this Agreement regarding sharing and participating in the cost of signalization at the intersection of 82na Street West and Trunk Highway 41. NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter contained, it is agreed by and between the parties hereto as follows: 1. Chanhassen shall submit a request to the Minnesota Department of Transportation (MnDOT) for the signalization of the intersection of 82nd Street West and Trunk Highway 41. It is understood that said request shall include a signal justification report. 2. That in the event MnDOT approves the temporary signalization project at the intersection of 82nd Street West and Trunk Highway 41, the local share of said project shall be paid fifty percent (50%) by Chaska and fifty percent (50%) by Chanhassen. 3. In the event MnDOT does approve the application for temporary signalization at said intersection, same shall be designed by Chanhassen and Chanhassen shall submit such design and plans and specifications to Chaska for review and comment prior to the solicitation of construction bids° 4. Upon completion of the temporary signalization project as contemplated herein, but not later than the date of activation of said signalization, the City of Chanhassen shall submit to the City of Chaska an itemized statement showing said total costs and Chaska shah pay to the City of Chanhassen, within thirty (30) days after receipt of said statement, the share of said costs, same being fifty percent (50%) of said total costs.
