Benson, City Engineer ~ July 19, 1999 Approve Change Order No. 2 to West 78th Street (Lake Ann Park Entrance to CSAH 17) - Project No. 95-21 - A change order request was submitted in the spring of 1998 for work not included in the plans and specifications and a reduction in the size of landscaping to be installed on the project. I requested documentation from the prime contractoron material and labor costs involved in the extra wiring at poles no. 3 and 5 and the bituminous path removal. The requested documentation was received by the Engineering Department on June 22, 1999. The remaining items on this change order are related to landscaping size reductions and substitutions of species type as approved by the City's Environmental Resource Specialist. In exchange for the size reduction for each type of tree included in the change order, a corresponding price reduction was negotiated. I recommend approval of Change Order No. 2 for the West 78t~ Street Projec[No. 95-21 which will result in a net decrease of $470.18 due to this change order. Attachments: 1. Change Order No. 2. 2. EXPLANATION OF CHANGE IN PLAN RECOMMENDED (Attach additional sheets if necessary) The purpose of this change order is to compensate the contractor for work not included in the plans and specifications and reduction in size of landscaping due to damage to subcontractor's nursery stock which occurred in a storm on M~a/y. 15, 1998 as approved by City Environmental Resource Coordinator. Painting of the traffic sign.al system poles and heads. 2. Pavement markings incidental to electrical. 3. Extra wiring at Pole Nos. 3 and 5, raise PVC hand hole and telephone work at Chaseway. Each item is addressed in the following: The request for traffic signal painting, dated May 6, 1998, states that the work had been completed; however, upon field inspection, this work was actually in progress on May 11, 1998. According to Page SS-15, Item M of the Traffic Control Special Provision, "The contractor shall paint all new items of the revised traffic signal system in accordance with the provisions of MnDOT 2565.35. Ail metal signal system items shall be finish painted brown color. Finish coat paint shall be two coats and the finish sheen of the brown color shall be approved by the City before painting." As the specification states that the painting of the traffic signal system brown is to be included in the lump sum for REVISED SIGNAL SYSTEM, no additional payment item will be made. Pavement Marking Incidental to Electrical. Plan sheet number 31 of 50, notes 1-4, clearly applies to pedestrian markings and stop lines. This is the only place in the plan where the zebra crosswalk detail is shown and polymer pre- formed tape is specifically called for. Note number 4 is the only reference shown in the plan that indicates "furnishing and installing pedestrian mark/ngs and stop lines shall be incidental to the signal system." Therefore, for your subcontractor to have submitted a quote for this item, it is reasonable to expect that he/she also read notes 1 through 3. The contention that notes on plan sheets 29 and 30, which do not even depict crosswalks, overrule the specific The City of Chanhassen. Therefore, the request for additional compensation for this item is denied. If any adjustment is warranted it would be in the form of a credit to the City as the specified pre- formed polymer tape was changed to less expensive epoxy paint. Extra Wiring at pole nos. 3 and 5, raise PVC hand hole and telephone work at Chaseway was due to the plans specifying items as part of existing system which were not. Therefore, the work required could not have been anticipated by the contractor at the time the project was bid. This item will be compensated by change order in the amount of $1,331.76 plus prime contractor markup. However, a breakdown of materials and labor costs is required. The request for bituminous path removal is being evaluated. Also, the cost reduction for the smaller caliper trees needs to be established. The seeding and sodding on the project remains to be completed. Before this work is done a herbicide needs to be applied as the weeds have grown quite welt this spring.
