Botcher, City Manager ~ DATE: July 20, 1999 SUB J: Joint Powers Agreement with the City of Shorewood for Drainage Improvements, Project 98-2 I am in concurrence with the City Engineer's recommendation to approve tile Joint Powers Agreement to allow for a minor amount of I/I drainage improvement work to be done in the City of Shorewood consistent with the Joint Powers Agreement. Obviously it makes little sense to perform a majority of the work within the City of Chanhassen and not deal with a small, but existing problem within the City of Shorewood that contributes to the I/I difficulties within the City of Chanhassen. This Joint Powers Agreement will allow us to deal with this nuisance drainage issue as a part of our larger project. Benson, City Engineer DATE: July 19, 1999 SUB J: Approve Joint Powers Agreement with the City of Shorewood for I/I Drainage Improvements Project No. 98-2 The purpose of the 1999 I/I Drainage Improvement Project is to provide an outlet for sump pump discharge into the storm sewer system. The attached joint po~ersl agreement establishes the responsibilities of the cities for the construction, maintenance and ownership of the drainage improvement project within the City of Shorewood. The work proposed within the Shorewood city limits consists of the installation of drain tile behind the curb which will serve two properties fot~ sump pump discharge purposes. It is important to the City of Chanhassen that these properties be provided an outlet into the storm sewer system as currently the discharge flows into the City of Chanhassen. The construction of drainage improvements within the City of - Chanhassen in this area without the inclusion of the work proposed within the City of Shorewood will not fully address the sump pump discharge problem. The City of Shorewood will reimburse the City of Chanhassen ($1,600 based unit bid prices) for the construction costs within the Shorewood city limits. A great plac~to live, work, and p, JOINT POWERS AGREEMENT BETWEEN THE CITY OF CHANHASSEN AND THE CITY OF SHOREWOOD THIS AGREEMENT is entered into between the CITY OF CHANHASSEN, a Minnesota municipal corporation CChanhassen"), and the CITY OF SItOREWOOD, a Minnesota municipal corporation, ("Shorewood"), hereinafter collectively referred to as the "Cities". WHEREAS, the Cities desire to construct a drainage improvement project along Near Mountain Boulevard to provide an outlet for the discharge of sump pumps; and WHEREAS, Minn. Stat. § 471.59 authorizes two or more governmental units to enter into agreements to jointly or cooperatively exercise any power common to the contracting parties or any similar power. NOW, THEREFORE, the Cities agree as follows: 1. PURPOSE. This Agreement shall establish the responsibilities of the Cities for the construction, maintenance, and ownership of a drainage improvement project. 2. DESIGN AND CONSTRUCTION. Chanhassen has designed a drainage improvement project for the discharge of sump pumps along Near Mountain Boulevard between 19795 Near Mountain Boulevard and 19785 Near Mountain Boulevard. Chanhassen has awarded a contract for the improvement and will administer the contract. 3. OWNERSHIP. Following completion of construction, each City will own that part of the improvement project which is within its corporate boundaries. 4. OPERATION AND MAINTENANCE. Following completion of construction each City will be responsible for the operation, maintenance, and replacement of that part of the improvement within its corporate, boundaries. 5. COST SHARING. Shorewood shall pay $1,600.00 as its share of the cost of the project. Chanhassen shall pay for the balance of the project cost.
