Pillsbury Sewer Charge Change
As discussed at the work session on July 19, 1999, I am requesting approval of the
sewer charge methodology for Pillsbury. Pillsbury will now be charged on actual
usage of the sanitary sewer services as opposed to calculation based upon their
consumption of water. As indicated at the work session, I will have the new
Finance Director recalculate the potential impact of this change of accounting
upon the revenue stream of the sewer utility, and any adjustments will be
incorporated as a part of our Fiscal Year 2000 Budget deliberations for the
sanitary sewer service Utility.

Mr. Folich:
On behalf of The Pillsbury Company, we are requesting a change in the way sewer usage services
are calculated. The balance of this letter will summarize the basis for this request. ~
The City Water, Sewers and Sewage Disposal regulations (Sec. 19-51 User rates and charges)
state, "The quarterly billings will be based on winter quarter water usage unless that consumgtion
proves inaccurate, then actual quarterly usage measurements shall be employed." Dave Hempel
of the City of Chanhassen said that the City agreed that actual quarterly measurement is requCed
at Pillsbury. Mr. Hempel suggested that an effluent measuring system (approved by the City,t
the Rosemount facility) be used to measure flow. :
An open channel effluent measurement system similar to the one installed at Rosemount wil[not
deliver the .actual quarterly usage measurements that both Pillsbury and the City of Chanhassen
require. Open channel flow systems especially in food production facilities are unreliable an~
inaccurate. The Isco Open Channel Flow Measurement Handbook states "A review of !iterflure
on the subject of accuracyofprimary devices reveals few positive statements and those' _~
statements that are made are extremely cautious. However, weirs are generally recognized a~ -
being more accurate then flumes. Mougemot rates the basic error in the head/flow relations~p
of V-Notch weirs as +-3 to 6% .... an inaccurately constructed flume can have associated erro~ of
+-5 to 10% or more." The sewer load at Pillsbury would require a flume and not a weir. Ou~
experience suggests that a flume at a food processing facility would have errors in the 10% r~nge.
SERVICE recommends that the City approve the measurement system currently accepted byfthe
Metropolitan CoUncil Environmental Services (MCES). Pillsbury has installed meters at all ~e
locations where water is used in product or is evaporated in cooling towers. The MCES rep,s
have included evaporation and loss to product calculations since Pillsbury open.ed. The curr~_nt
waste discharge rules for the MCES (215.00 Continuous Flow Measuring and Recording) stye
operating day losses including product loss or evaporation can be used to determine sewer u~age
if the MCES Regional Administrator determines that operating day losses can be accounted for.

We suggest that a copy of the MCES worksheet (copy attached) be sent to the City of
Chanhassen billing department on a quarterly basis in order to accurately reflect Pillsbury's
sewer use. I will follow this letter up with a call to you in one week. Please let me know ifI can

215.00 Continuous Flow Measuring and Recording
Permittees shall provide accurate volume measurements for the discharae of wastewater to public
sewers for self-monitoring report periods. Water meters may be used to determine reporting period
discharge volumes if the Reaional Administrator determines that operating day losses can be accounted
for. Operating day losses include, but are not limited to, lawn sprinkling, loss to product, or
evaporation. Water meters used for wastewater discharge volume determinations shall be maintained in
go.od operating condition. The Reaional Administrator may require routine calibration of such meters.
In the event the Reaional Administrator determines that operating day losses cannot be accounted for,
continuous flow measuring of industrial waste discharges to public sewers shall be required.
All continuous flow measurina installations shall include a continuous recordina device and meet the
requirements in Section 213.04.
All continuous flow measurin~ installations shall be maintained in good operating condition. Records of
all maintenance conducted on flow measuring installations shall be kept as required bv Section 214.00.
Maintenance includes, but is not limited to, the removal of sediment from upstream and downstream of
any primary device, and calibration of the flow meter.
The permittee shall notify the Reaional Administrator in writing within five calendar days of any failure of
a continuous flow measuring installation required by this section.
Written notification to the Regional Administrator shall also be made prior to any alteration of a
continuous flow measurin~ installation.

building and the whole considered as the building sewer. Other exceptions may be allowed
only by special permission granted by the city.

Sec. 19-50. Inspections and City supervision of work.
(a) Inspections of all interior plumbing and exterior services, including connections to the
municipal sewage disposal system, are required. The permit holder is re,sponsible to arrange
for such inspections which are performed between 8:00 a.m. and 4:00 p.m. on weekdays within
twenty-four (24) hours of notification.
(b) All direct connections to and tappings of the actual city main line shall be supervised
by the city. Depending on the availability of the inspector, trenches may have to remain open
for some period of time and in some instances overnight. In such cases the permit holder shall
be responsible, to enclose the opening to ensure pedestrian and vehicular safety.

Sec. 19-51. User rates and charges.
(a) A quarterly sewer usage unit rate shall be established by resolution of the city council
as a part of the annual budgetary process.
(b) The city clerk shall prepare and mail to the owner, occupant or lessee of each con-
sumer premises connected with the sanitary sewer system a statement for sewer usage
services furnished thereto during the preceding quarter. The quarterly billings will be based
on winter quarter water usage unless that consumption proves inaccurate, then actual quar-
terly usage measurements shall be employed. Charges for individuals connected to sewer but
not water shall be billed on an assumed usage rate.
(c) The city clerk shall compute the amount due to the city for sewage charges and render
a quarterly statement thereof. All amounts due as shown on the statement shall be paYable at
the municipal building on or before the twentieth day of the month in which the statement is
presented. A penalty of ten (10) percent shall be added to all accounts that are not paid in full
by the due date. This penalty shall be computed on the unpaid balance not paid by the
appropriate due date at the time each quarterly statement is prepared and presented.
(d) In the event any sewer usage charge is not paid within three (3) months after the time
it is rendered, the council may recover said amount in an action brought in any co~t of
competent jurisdiction, or in the alternative, may certify the amount due together with
penalties to the county auditor to be collected with other real estate taxes levied against the
premises served.
