PROPOSAL/SUMMARY
The applicant is requesting site plan approval for the construction of a 48,565 square foot office
warehouse building. The site is located on proposed Lot 3, Block 1, Chanhassen Lakes Business
Park 7th Addition and has an area of 3.99 acres. It is zoned IOP, Industrial Office Park, and is
bordered by Lake Drive West to the south and east and vacant industrial sites to the north and
west. Access to the site is gained via two driveways of off future Lake Drive West. The westerly
driveway is also shared with lots 1 and 2, and is proposed to provide future access to the
Stockdale property located north of lots I and 2. (Access to the site via Lake Drive West is subject
to the project being ordered by the City Council. Building permits will not be issued until the
road is completed.)
The building is designed in a "U" shape to hide the loading docks from views. The docks are
located in the center of the "U". The applicant is proposing to utilize pre-colored (light gray)
rockface block as the main material on the building. Windows and accent ribbons of dark gray
rap around all four sides of the building. The walls along the east and west side of the loading
docks are not shown on the plans. Staff is assuming that the same materials and architectural
treatment will be carried on through these walls. The design of the building provides variation in
form through stepped back elevations along the south and east. The overall design provides
variation and detail on the facade of the building.
Parking will be scattered around the building. Screening of the parking lot can be improved by
incorporating a meandering berm with landscaping, 3 to 4 feet in height along the perimeter of
the site. Parking lot landscaping exceeds ordinance requirements, however, the buffer portion is
deficient. Site landscaping must be increased to meet minimum ordinance requirements. -T-he

A parking lot light plan is required. The plan should incorporate the light style, height, and
photo-metrics. Also, a detailed sign plan which include lighting method has to be submitted.
The site plan fails to show the trash enclosure location. The dumpsters must be screened by a
wing-wall and doors with siding and trim to match the building.
Rooftop equipment and mechanical equipment are not shown on the plans. All equipment must
be screened from views.
In summary, with the incorporation of staff recommendations the proposed site plan application
would meet ordinance requirements, and staff is recommending approval with conditions outlined
in the staff report.

BACKGROUND
On April 12, 1999, the City Council approved a Resolution Declaring No Need for an
Environmental Impact Statement for the Chanhassen Lakes Business Park 7th Addition Project,
Subdivision 99-1 preliminary plat to replat Outlot D into 10 lots, Chanhassen Lakes Business
Park 7th Addition, and wetland alteration permit to fill 1.23 acres, provide 1.62 acres of in kind
mitigation and 1.89 public value credits, as shown on the plans dated received January 26, 1999,
subject to conditions. The final plat is scheduled to appear before the City Council on May 24,
1999.
GENERAL SITE PLAN/ARCHITECTURE
The proposed office/warehouse building, with an area of 48,565 square feet, will be situated
parallel to and northwest of Future Lake Drive West. The site is bordered by Lake Drive West to
the south and east, and vacant industrial sites to the north and west. The site located south of
future Lake Drive West is zoned PUD-R and is occupied by a park. Access to the building is
proposed from future Lake Drive West. Parking will be scattered around the building. Screening
of the parking lot can be improved by incorporating a meandering berm with landscaping, 3 to 4
feet in height along the perimeter of the site.
Materials used on the "U" shaped building, are pre-colored rock face block on all four elevations.
Entrances into the building are projecting glass boxes framed in aluminum. Decorative pre-
colored rockface block bands are integrated into the walls on all four elevations. The south and
east elevation are stepped out combined with the different colors and materials give the building
the desired visual appeal. The "U" shaped building is designed to screen the loading docks from
views by locating the loading area in the center of the "U". The east and west walls on either
side of the loading area are not shown on the "EXTERIOR ELEVATIONS" plan. The same
architectural treatment is required on these walls.
The site plan fails to show the trash enclosure location. The dumpsters must be screened by a
wing-wall and doors with siding and trim to match the building. Current state statutes require
that recycling space be provided for all new buildings. The area of the recycling space must be
dedicated at the rate specified in Minnesota State Building Code (MSBC) 1300.4700 Subp. 5.
The applicant should demonstrate the required area will be provided in addition to the space
required for other solid waste collection space. Recycling space and other solid waste collection
space should be contained within the same enclosure.

The building is located 73 feet from the north, 97 feet from the east and south, and 79 feet from
the westerly property line. The ordinance requires a 30 foot parking setback along Lake Drive
SITE PLAN FINDINGS
In evaluating a site plan and building plan, the city shall consider the development's compliance
with the following:
(1)
Consistency with the elements and objectives of the city's development guides,
including the comprehensive plan, official road mapping, and other plans that may
be adopted;
(2) Consistency with this division;
(3)
Preservation of the site in its natural state to the extent practicable by minimizing
tree and soil removal and designing grade changes to be in keeping with the
general appearance of the neighboring developed or developing areas;
(4)
Creation of a harmonious relationship of building and open space with natural site
features and with existing and future buildings having a visual relationship to the
development;
(5)
Creation of functional and harmonious design for structures and site features, with
special attention to the following:
An internal sense of order for the buildings and use on the site and
provision of a desirable environment for occupants, visitors and general
community;
b. The amount and location of open space and landscaping;

Materials, textures, colors and details of construction as an expression of
the design concept and the compatibility of the same with adjacent and
neighboring structures and uses; and

Vehicular and pedestrian circulation, including walkways, interior drives
and parking in terms of location and number of access points to the public
streets, width of interior drives and access points, general interior
circulation, separation of pedestrian and vehicular traffic and arrangement
and amount of parking.

Protection of adjacent and neighboring properties through reasonable provision
for surface water drainage, sound and sight buffers, preservation of views, light
and air and those aspects of design not adequately covered by other regulations
which may have substantial effects on neighboring land uses.
Finding: The proposed development is consistent with the City's comprehensive plan,
the zoning ordinance, and the site plan review requirements. The site design is
compatible with the surrounding development. It is functional and harmonious with the
approved development for this area.
WETLANDS
There are no wetlands on this lot, however, the proposed stormwater pond is included in the
overall drainage and wetland mitigation plan. the development of this site must be consistent
with the approved Wetland Alteration Permit (WAP 99-1).
GRADING
The preliminary plat for Chanhassen Lakes Business Park (CLBP) 7th Addition was approved by
the City Council on April 12, 1999. Final plat and construction plan approval is tentatively
scheduled for the May 24, 1999 City Council meeting. In conjunction with the platting (CLBP
7th), the developer will rough grade all the building sites and streets in the development and
install the public utilities and street improvements in Marshland Circle. The City will extend
utility service from Lake Drive West to the property line and construct Lake Drive West. Only
minor grading is anticipated on the lots after the project has been initially graded by the
developer. Since the final construction plans have not been approved, there may be minor
adjustments of the grades and/or utility connection points on this site. The preliminary grading
plans for this plat proposed some berming along the north side of Lake Drive West adjacent to
this lot. Due to parking lot and street grades, berming will be limited. The site plans should be
revised to incorporate berms along Lake Drive West as shown on the preliminary plans to
provide the required screening. The berming will not require modifications to the proposed
parking or building improvements as shown on the plans.
Erosion control fencing appears to be omitted on the plans. Erosion control fencing will be
required proposed around the downstream side of the grading limits. Additional erosion control
fence will be required along the north property line adjacent the pond. The plans shall
incorporate erosion control measures prior to issuance of a building permit. Rock construction
entrances are also proposed.

DRAINAGE
Stormwater runoff from the parking lot will be conveyed via storm sewers into a regional
stormwater pond north of the site for pretreatment. The storm sewer system on the site will be
constructed by the developer and owned and maintained by the developer upon completion.
Since the storm drainage system will be constructed to serve more than one lot a cross-access
agreement should be prepared for the joint use of the system.
Detailed storm drainage calculations will be required to determine if there are sufficient catch
basins being provided to convey surface water runoff to the pond. The drainage calculations
shall be for a 1 O-year, 24-hour storm event and be submitted to the City for review and approval
at time of building permit application:
UTILITIES
Municipal sewer and water is not available to the site at this time. The developer has petitioned
the city to construct the infrastructure and Lake Drive West (Project No. 98-16) later this
summer. The developer will be responsible for extending the utility and street improvements on
the site. The city's project will extend an 8-inch sewer line from Lake Drive West to the property
line. Water service is proposed to be extended from Lake Drive West to provide service to Lots
1, 2 and 3. Since the water line will be serving more than one lot a cross-access agreement which
addresses maintenance responsibility shall be prepared by the applicant and recorded against the
benefited lots. Installation of the private utilities throughout the site (i.e. storm sewer, sanitary
sewer, water) will require permits and inspections through the City's Building Department. The
location of the fire hydrants may change after review of the final construction plans for Lake
Drive West.
STREETS
Lake Drive West is proposed to be constructed this year by the City. An 8-foot wide trail will be
constructed along the north side of Lake Drive West adjacent this site. Lake Drive West and
Audubon Road are classified as Class I collector streets in the City's Comprehensive
Transportation Plan. They are both designated as Municipal State Aid Routes. Lake Drive West
is being constructed to Municipal State Aid standards which prohibits parking along one side.
Typically, with Class I collector routes, the City prohibits parking on both sides of the street.
However, given the park location, staff/City Council may revisit the parking situation in the
future. Parking is also prohibited along Audubon Road.
The plans propose two driveway accesses from Lake Drive West. The westerly driveway access
will be shared by Lots 1 and 2. Both driveway access points have a grade in excess of 4.0%.
These grades will need to be reduced to a maximum of 4.0% to accommodate fire trucks. Lots 1

and 2 will also have access to Lake Drive West through Lot 3. The drive aisle width and parking
stalls appear to be designed in accordance with the City's ordinance. However, there are a couple
of curb radii that need to be increased to accommodate turning movements of fire trucks. Staff
will work with the applicant to revise them before issuance of a building permit. An industrial
driveway apron with pedestrian ramps will be required with construction of driveway access
points along Lake Drive West.
Staff reviewed the access needs for the Stockdale parcel which is located north of the site on
Audubon Road. In conjunction with platting CLBP 7th the developer is required to provide an
ingress/egress easement over Lots 2 and 3, Block 1 as a secondary access for the Stockdale parcel
out to Lake Drive West to eliminate the need for additional access points along Audubon Road.
A cross-access easement will need to be prepared and recorded by the applicant in favor of the
property owner to the north (Stockdale).
MISCELLANEOUS
Site plan approval should include provisions for staffto administratively approve minor changes
to the site plan resulting from the final plat approval for Chanhassen Lake Business Park 7th
Addition and the City's Lake Drive West Public Improvement No. 98-16. Changes may include
elevations, landscaping, and utility connection points.
Issuance of building permits within the plat should be a topic for discussion. The City requires
that each site have a paved street access (7-ton design) prior to issuance of a building permit. In
addition, the utility improvements designated to service the site will need to be installed, tested,
and accepted by the City prior to issuance of a building permit. The City in the past has typically
issued one building permit adjacent to a hard surfaced street to each subdivision. There have also
been situations in the past where the City issued up to four residential building permits as long as
they were easily accessed from a paved street (within 150 feet) and the City's fire marshal's
concerns were addressed. Given the timetable of this development (CLBP 7th Addition) and the
City's improvement project for Lake Drive West, it is doubtful that the required utility and street
improvements will be completed prior to mid-November of 1999. Therefore, building permits
other than one off Audubon Road will not be issued until sometime in November, 1999.
SURFACE WATER MANAGEMENT PLAN (SWMP)
The Chanhassen Lakes Business Parks 7th Addition development was required to construct water
quality ponds and pay fees associated with the management of storm water in accordance with the
City's Surface Water Management Plan (SWMP).
These fees are determined when the final grading and utility plans are submitted with each phase of
the project. The fees are due at the time of final platting.

LANDSCAPING
Minimum requirements for landscaping include 5,730 sq. fi. of landscaped area around the
parking lot, 23 trees for the parking lot, and buffer yard plantings along Lake Drive, as well as
neighboring property lines. Applicant's proposed as compared to the requirements for landscape
area and parking lot trees is shown in the following table.

The applicant is short plantings for the buffer yard areas. Staff recommends the applicant
increase plantings in order to meet ordinance requirements.
LIGHTING
Lighting locations have not been illustrated on the plans. Only shielded fixtures are allowed as
required by ordinance. A detailed lighting plan should be submitted. Street lights consistent
with Lake Drive East and West will be at 200 feet intervals, staggered from one side to the other.
SIGNAGE
The applicant has not submitted a signage plan. One ground Iow profile business sign is
permitted per lot. The area of the sign may not exceed 80 square feet and a height of 8 feet.
Also, one wall mounted sign per business shall be permitted per street frontage. The total display
area shall not exceed 15% of the total area of the building wall upon which the signs are

mounted. No sign may exceed 90 square feet. Staff is recommending the following criteria be
adopted:
All businesses shall share one monument sign per lot. Monument signage shall be
subject to the monument standards in the sign ordinance.
2. Wall signs are permitted on no more that 2 street frontages.
3. All signs require a separate permit.
The signage will have consistency throughout the development and add an
architectural accent to the building.
5. ConsiStency in signage shall relate to color, size, materials, and heights.
No illuminated signs within the development may be viewed from the residential
section south of the site.
7. Back-lit individual letter signs are permitted.

Only the name and logo of the business occupying the unit will be permitted on
the sign.
The applicant must obtain a sign permit prior to erecting the signs on site. One stop sign must be
posted on the driveway at the exit point of both sites. A detailed sign plan incorporating the
method of lighting, acceptable to staff should be provided prior to requesting a building permit.
PARKING
The city's parking ordinance requires 4.5 parking stalls per 1,000 square feet of office (54 stalls)
and one stall per square feet of warehouse area (37 stalls). The total parking spaces required by
ordinance are 91. The applicant is providing 124 spaces. The applicant is also showing 34 future
parking spaces. The applicant need to be aware that the hard surface coverage of the site is at
69%. The ordinance allows a maximum of 70% coverage. Adding these spaces will cause the
site to exceed the minimum hard surface coverage requirements of the ordinance which will
require a variance. Staff will recommend against such variance since we do not perceive a
hardship. The future parking spaces must be eliminated from the plan.

PARK AND TRAIL
The Comprehensive Park Plan identifies this site as lying within the park service areas of Lake
Susan Park and Sunset Ridge Park. Sunset Ridge Park is situated across the street frOm this site.
The Comprehensive Trail Plan identifies an east/west connecting link along Lake Drive. On
other sections of Lake Drive, this walkway/trail is constructed as a concrete sidewalk. This
section of walkway will be developed as a component of the new section of Lake Drive.
The Park & Recreation Commission recommended the city require payment of full park and trail
dedication fees for Chanhassen Lakes Business Park 7th Addition.

On May 19, 1999, the Planning Commission reviewed and approved this application
unanimously.
RECOMMENDATION
"The City Council approves site plan 99-5 for a 48,565 square foot office warehouse building to
be located on Lot 3, Block 1, Chanhassen Lakes Business Park 7th Addition, as shown on the
plans dated April 6, 1999 and revised June 4, 1999, subject to the following conditions:
The applicant shall increase plantings for buffer yard areas in order to meet ordinance
requirements.
The parking setback along Lake Drive West shall be increased to 30 feet. Within the 30
foot setback, the applicant will be required to provide a 3 to 4 foot meandering berm.

Full park and trail dedication fees shall be paid for Chanhassen Lakes Business Park 7th

The applicant shall work with staff in revising curb radii on the plans to accommodate
fire apparatus vehicles.
A cross-access agreement for parking and utilities purposes which also addresses
maintenance responsibilities and scheduling shall be prepared by the applicant and
recorded against the benefited lots (1, 2 and 3, Block 1). In addition, a cross-access
agreement for driveway purposes shall be granted to the parcel north of the site
(Stockdale) over Lots 2 and 3, Block 1 to gain access to Lake Drive West.

Security may be in the form of a letter of credit or cash escrow which will be returned
upon satisfactorily completing the project.

Upon review of the plans prepared by Schoell & Madson, Inc. dated April 16,
1999, I offer the following comments and reco~nmendations:
GRADING
The preliminary plat for Chanhassen Lakes Business Park (CLBP) 7th Addition was
approved by the City Council on April 12, 1999. Final plat and construction plan
approval is tentatively scheduled for the May 24, 1999 City Council meeting. In
conjunction with the platting (CLBP 7th), the developer will rough grade all the
building sites and streets in the development and install the public utilities and
street improvements in Marshland Circle. The City will extend utility service from
Lake Drive West to the property line and construct Lake Drive West. Only minor
grading is anticipated on the lots after the project has been initially graded by the
developer. Since the final construction plans have not been 'approved, there may
be minor adjustments of the grades and/or utility connection points on this site..
The preliminary grading plans for this plat proposed some berming along the north
side of Lake Drive West adjacent to this lot. Due to parking lot and street grades,
berming will be limited. The site plans should be revised to incorporate berms
along Lake Drive West as shown on the preliminary plans to provide, the required
screening. The berming will not require modifications to the proposed parking or
building improvements as shown on the plans.
Erosion control fencing appears to be omitted on the plans. Erosion control
fencing will be required proposed around the downstream side of the grading
limits. Additional erosion control fence will be required along the north property
line adjacent the pond. The plans shall incorporate erosion control measures prior
to issuance of a building permit. Rock construction entrances are also proposed.
DRAINAGE
Stormwater runoff from the parking lot will be conveyed via storm sewers into a
regional stormwater pond north of the site for pretreatment. The storm sewer
system on the site will be constructed by the developer and owned and maintained
by the developer upon completion. Since the storm drainage system will be
constructed to serve more than one lot a cross-access agreement should be
prepared for the joint use of the system.

Detailed storm drainage calculations will be required to determine if there are
sufficient catch basins being provided to convey surface water runoff to the pond.
The drainage calculations shall be for a 10-year, 24-hour storm event and be
submitted to the City for review and approval at time of building permit
application.
UTILITIES
Municipal sewer and water is not available to the site at this time. The developer
has petitioned the City to construct the infrastructure and Lake Drive West
(Project No. 98-16) later this summer. The developer will be responsible for
extending the utility and street improvements on the site. The City's project will
extend an 8-inch sewer line from Lake Drive West to the property line. Water
service is proposed to be extended from Lake Drive West to provide service to
Lots 1, 2 and 3. Since the water line will be serving more than one lot a cross-
access agreement which addresses maintenance responsibility shall be prepared by
the applicant and recorded against the benefited lots. Installation of the private
utilities throughout the site (i.e. storm sewer, sanitary sewer, water) will require
permits and inspections through the City's Building Department. The location of
the fire hydrants may change after review of the final construction plans for Lake
Drive West.
STREETS
Lake Drive West is proposed to be constructed this year by the City. An 8-fool[:.~
wide trail will be constructed along the north side of Lake Drive West adjacent~this
site. Lake Drive West and Audubon Road are classified as Class I collector streets
in the City's Comprehensive Transportation Plan. They are both designated as
Municipal State Aid Routes. Lake Drive West is being constructed to Municipal
State Aid standards which prohibits parking along one side. Typically, with Class I
collector routes, the City prohibits parking on both sides of the street. However,
given the park location, staff/City Council may revisit the parking situation in the
future. Parking is also prohibited along Audubon Road.
The plans propose two driveway accessexs from~ Lake Drive West. The westerly
driveway access will be shared by Lots~l~and,~' Both driveway access points have
a grade in excess of 4.0%. These grades will need to be reduced to a maximum of
4.0% to accommodate fire trucks. Lots 1 and 2 will also have access to Lake
Drive West through Lot 3. The drive aisle width and parking stalls appear to be
designed in accordance with the City's ordinance. However, there are a couple of
curb radii that need to be increased to accommodate turning movements of fire

tracks. Staff will work with the applicant to revise them before issuance of a
building permit. An industrial driveway apron with pedestrian ramps will be
required with construction of driveway access points along Lake Drive West.
Staff reviewed the access needs for the Stockdale parcel which is located north of
the site on Audubon Road. In conjuction with platting CLBP 7th the developer is
required to provide an ingress/egress easement over Lots 2 and 3, Block 1 as a
secondary access for the Stockdale parcel out to Lake Drive West to eliminate the
need for additional access points along Audubon Road. 'A cross-access easement
will need to be prepared and recorded by the applicant in favor of the property
owner to the north (Stockdale).
MISCELLANEOUS
Site plan approval should include provisions for staff to administratively approve
minor changes to the site plan resulting from the final plat approval for Chanhassen
Lake Business Park 7t~ Addition and the City's Lake Drive West Public
Improvement No. 98-16. Changes may include elevations, landscaping, and utility
connection points.
Issuance of building permits within the plat should be a topic for discussion. The
City requires that each site have a paved street access (7-ton design) prior to
issuance of a building permit. In addition, the utility improvements designated to
service the site will need to be installed, tested, and accepted by the City prior to
issuance of a building permit. The City in the past has typically issued one building
permit adjacent to a hard surfaced street to each subdivision. There have also been
situations in the past where the City issued up to four residential building permits
as long as they were easily accessed from a paved street (within 150 feet) and the
City's f'ne marshal's concerns were addressed. Given the timetable of this
development (CLBP 7th Addition) and the City's improvement project for Lake
Drive West, it is doubtful that the required utility and street improvements will be
completed prior to mid-November of 1999. Therefore, building permits other than
one off Audubon Road will not be issued until sometime in November, 1999.
RECOMMENDED CONDITIONS OF APPROVAL
Final grading shall incorporate berming along Lake Drive West outside of the
City's right-of-way. No berming is permitted within the City's right-of-way.
Landscaping improvements may be permitted subject to staff review and
approval.

Planning Case 99-5 Site Plan Review.
I have reviewed the site plan for the above project. In order to comply with the Chanhassen
Fire Department/Fire Prevention Division, I have the following fire code or city
ordinance/policy requirelnents. The site plan is based on the available information subniitted at
this time. If additional plans or changes are submitted, the appropriate code or policy items
will be addressed.
1. Additional fire hydrants will be required. Contact Chanhassen Fire Marshal for exact
number and location.
A 10 foot clear space must be maintained around fire hydrants, i.e., street lamps, trees,
bushes, shrubs, NSP, US West, Cable TV and transformer boxes to ensure that fire
hydrants can be quickly located and safely operated by firefighters. Pursuant to
Chanhassen City Ordinance'9-1.

CHANHASSEN FIRE DEPARTMENT NOTES TO BE
INCLUDED ON ALL SITE PLANS
Fire Marshal must witness the flushing of underground sprinkler
service line, per NFPA 13-8-2.1.
A final inspection by the Fire Marshal before a Certificate of
Occupancy is issued.
Fire Department access roads shall be provided on site during all
phases of construction. The construction of these temporary roads
will conform with the Chanhassen Fire Department requirements for
temporary access roads at construction sites. Details are available.
Onsite fire hydrants shall be provided and in operating condition
during all phases of construction.
The use of liquefied petroleum gas shall be in conformance with
NFPA Standard 58 and the Minnesota Uniform Fire Code. A list of
these requirements is available. (See policy #33-1993)
All fire detection and fire suppression systems shall be monitored by
an approved UL central station with a UL 72 Certificate issued on
these systems before final occupancy is issued.

of Article #81 of the Minnesota Uniform Fire Code. High-piled
combustible storage is combustible materials on closely packed piles

commodities such as rubber tires, plastics, some flammable liquids,
idle pallets, etc. the critical pile height may be as Iow as 6 feet.

PREMISES IDENTIFICATION
General
Numbers or addresses shall be placed on all new and existing
buildings in such a position as to be plainly visible and
legible from the street or road fronting the property. Said
numbers shall contrast with their background. Size and
location of numbers shall be approved by one of the
following - Public Safety Director, Building Official,
Building Inspector, Fire Marshal.
Requirements are for new construction and existing buildings
where no address numbers are posted.
Other Requirements - General
1. Numbers shall be a contrasting color from the background.
2. Numbers shall not be in script.
3. If a structure is not visible from the street, additional numbers are
required at the driveway entrance. Size and location must be approved.
4. Nu~zbers on mail box at driveway entrance may be a minimum of 4". However,
requirement #3 must still be met.
5. Administrative authority may require additional numbers if deemed
necessary.
Residential Requirements (2 or less dwellin.q unit)
1. Minimum height shall be 5 1/4".
2. Building permits will not be finaled unless numbers are posted and approved

Blackowiak: Mr. Chairman, I have one question. Dave, you noted in the last report that the Lake
Drive West extension probably wouldn't be done until November. So then are these buildings,
Lot 3, Block 1 and one we'll be seeing here, Lot 4, are they going to be not started until after
November then? Am I correct with that?
Hempel: Mr. Chairman, commissioners. I've had conversations with the developer. That
jumped out at his attention as well. What we discussed was interim access, separate road is you
will that they're willing to build to gain access while Lake Drive West is being constructed. The
major concern is from public safety to access the building and in this situation it's not a stick
built, if you will like residential homes. It's more metal and bricks so the risk of fire is much'
lower. So the main concern is the Fire Marshals and that will be addressed with interim access
road from Audubon Road. Either paralleling or somewhere through the parking lots to gain
construction access to these building sites.
Blackowiak: So they will begin as soon as.
Hempel.' Final plat has been recorded and the project authorized for Lake Drive West.
Blackowiak: Okay, and you're comfortable with an interim road and?
Hempel: I am engineering wise. It seemed like public safety was too.

Kind: I have one. This is the one that does get closer to the park, if I've got my bearings right.
I'm curious, which side of Lake Drive is the sidewalk on? Is it going to be on the north or south
side? North side? And so the business people will be able to use this sidewalk and if they want
to access the park, will there be a crosswalk at that point or intersection with the parking lot or?
Hempel: Correct. A crosswalk at about I believe where the access for the parking lot for the
park is. On the radius of Lake Drive West there.
Kind: And do you know if there's a speed limit set for this new Lake Drive?
Hempel: The road is being designed for a 35 mph speed limit. Fairly typical for a collector road.
Kind: That's all.
Peterson: Other questions? Seeing none, would the applicant like to make a presentation? If so,

trees, and I don't know which map I'm on now but.
Aanenson: You're on a different project.
Stuart Brown: ...many, many trees or little proposed trees. Is that part of the project or is this an
city envisioned plan? I guess this is what provides the barrier. You know the park's over here.
And the ballpark's over here. This is our barrier to the road I guess. So this is not part of their
plan. Is that part of a City plan for these trees?
Aanenson: Correct.
Peterson: Dave, could you respond to that?
Hempel: Certainly Mr. Chairman. That landscaping along the south of the road adjacent to the
park is going to be installed with the city's street project, Lake Drive West.
Stuart Brown: The things shown here, these are real...
Aanenson: The other side is pretty representative: It's 1 tree-for every 30 feet so it's probably
pretty representative. He's just calling and showing what he's responsible for:

#99-5 for a 48,565 square foot office warehouse building located on Lot 3, Block 1, Chanhassen

conditions of the staff report 1 through 27.

site plan 99-5 for a 48,565 square foot office warehouse building to be located on Lot 3,
Block 1, Chanhassen Lakes Business Park 7th Addition, as shown on the plans dated April
6, 1999, subject to the following conditions:
The applicant shall increase plantings for buffer yard areas in order to meet ordinance
requirements.

The parking setback along Lake Drive West shall be increased to 30 feet. Within the 30
foot setback, the applicant will be required to provide a 3 to 4 foot meandering berm.

Full park and trail dedication fees shall be paid for Chanhassen Lakes Business Park 7th
Addition in accordance with ordinance requirements.

One ground low profile business sign is permitted per lot. The area of the sign may not
exceed 80 square feet and a height of 8 feet. Also, one wall mounted sign per business
shall be permitted per street frontage. The total display area shall not exceed 15% of the
total area of the building wall upon which the signs are mounted. No sign may exceed 90
square feet. All signage must meet the following criteria:

A lighting plan shall be submitted to the city. Only shielded fixtures are allowed as
required by ordinance. A detailed lighting plan should be submitted. Street lights
consistent with Lake Drive East and West will be at 200 feet intervals, staggered from
one side to the other.
The site plan fails to show the trash enclosure location. The dumpsters must be screened
by a wing-wall and doors with siding and trim to match the building. Current state
statutes require that recycling space be provided for all new buildings. The area of the
recycling space must be dedicated at the rate specified in Minnesota State Building Code
(MSBC) 1300.4700 Subp. 5. The applicant should demonstrate the required area will be
provided in addition to the space required for other solid waste collection space.
Recycling space and other solid waste collection space should be contained within the
same enclosure.
Rooftop equipment and mechanical equipment are not shown on the plans. All
equipment must be screened from views.
The 34 future parking spaces shown along the northern portion of the site shall be
eliminated.
The applicant shall enter into a site plan contract with the city and provide the necessary
financial securities as required for landscaping.
Final grading shall incorporate berming along Lake Drive West outside of the City's right-
of-way. No berming is permitted within the City's right-of-way. Landscaping
improvements may be permitted subject to staff review and approval.
The applicant shall work with staff in revising curb radii on the plans to accommodate
fire apparatus vehicles.
A cross-access agreement for parking and utilities purposes which also addresses
maintenance responsibilities and scheduling shall be prepared by the applicant and
recorded against the benefited lots (1, 2 and 3, Block 1). In addition, a cross-access
agreement for driveway purposes shall be granted to the parcel north of the site
(Stockdale) over Lots 2 and 3, Block 1 to gain access to Lake Drive West.
Detailed storm drainage calculations for a 1 O-year, 24-hour storm event shall be
submitted to the City for review and approval prior to issuance of a building permit.
Installation of the public utilities throughout the site will require building permits through
the City's Building Department.
All driveway access points along Lake Drive West shall incorporate an industrial
driveway apron and pedestrian ramps in accordance with the City details and pedestrian
ramps.

The applicant will need to provide financial security in the amount of $2,500 to guarantee
installation of the driveway aprons, boulevard restoration, and erosion control measures.
Security may be in the form ora letter of credit or cash escrow which will be returned

All areas disturbed as a result of construction activities shall be immediately restored with
seed and disc mulch or wood fiber blanket or sod in accordance with the approved plans
within two weeks the completion of each activity in accordance with the City's Best
Management Practice Handbook.
