2000 Transit Service Levy Adoption
The Local Levy Option Statute passed in 1996 allowed transit agencies the opportunity to have
transit taxes levied locally, instead of being levied by the Metropolitan Council. As part
of the process to accomplish this, transit agencies and communities participating in the local levy
option must notify the Metropolitan Council and the Commissioner of Revenue of their intentions
to exercise that option by July 1 each year.
If Chanhassen does not act to levy the transit tax locally, the Metropolitan Council will levy the
transit tax. The amount levied will then be $746,548. If Chanhassen exercises the local transit tax
levy option the transit taxes levied will be the lesser of $746,548 or the 1999 levy amount of
$691,977 multiplied by the maximum levy limit for the City of Chanhassen. It is important to note
that the Metropolitan Council does not have the ability to reduce the transit tax amount, which is
one reason the local levy option is a better situation for Chanhassen, Chaska and Eden Prairie.
As in the past few years, Southwest Metro is proposing to use the maximum rate of levy increase
as the City, and, therefore, be subject to the same levy cap. The levy cap is based on a formula
using the following variables: Market Value of New C/I Construction, Implicit Price Deflator,
Household Growth.
This is the first step of several inthe levy and budget process for the transit levy. First, the
resolution of intent (attached) is required and due by June 30th; next the budgets are prepared and
submitted to the cities for review during the months of June through sePtember; and last, the levy
is set and the budgets are finalized in December. This process is a mirror of the process used by
the cities.
After notifying the Metropolitan Council and the Commissioner of Revenue of your city's intent to
levy a transit tax for the taxes payable in 2000, the only change that may be made after June 30,
1999 is to reduce the amount of the transit tax levy.
The resolution and certification both need to be signed the night of the council meeting, June 28,
1999, so that I can take it with me to send to the Metropolitan Council and the Commissioner of
Revenue the following day. It is important that they receive the information by June 30, as the
decision to levy or not to levy is irrevocable.

Minnesota statute requires that a municipality which intends to exercise the
transit services local levy option for the taxes payable year 2000 must notify the
Department of Revenue and the Metropolitan Council of its intent on or before
June 30, 1999. The notification must include the amount of the municipality's
proposed transit tax for levy year 1999, taxes payable 2000.
' After June 30, 1999, the city's decision to levy or not to levy a transit tax for the
taxes payable year 2000 is irrevocable. The only change that may be made after
June 30, 1999 is to reduce the amount of the transit tax.
Staff recommends certification of notice of intent to exercise local transit tax
levy option for taxes payable in 2000 and set proposed transit tax for the 1999
levy year at $746,548.

Resolution for Transit Tax Levy
Enclosed is the resolution that SMTC is requesting the City to execute at its next council meeting in
order to set the levy process for transit for 2000. In compliance with the "levy cap" extended by
the legislature in the 1999 Session we expect to increase the levy the same percentage allowed
for the city.

DECLARING INTENT TO EXERCISE LOCAL TRANSIT LEVY OPTION FOR
TAXES IN 2000
WHEREAS, Laws of Minnesota for 1996, Chapter 455, Section 4 (the "Local Levy
Option Act"), allows the Cities of Chanhassen, Chaska and Eden Prairie, to make a local transit tax
levy in lieu of receiving assistance from the Metropolitan Council under Minnesota Statutes,
Section 473.388, subdivision 4; and,
WHEREAS, said local transit levy will replace a similar transit tax levy which would
otherwise be made by the Metropolitan Council; and,
WHEREAS, in order to effectively exercise the local transit tax levy option, it is
necessary that each of the Cities of Chanhassen, Chaska, and Eden Prairie, notify the State
Commissioner of Revenue and the Metropolitan Council of its intent to levy the taxes before July 1
of each levy year and to include in the notification the amount of the City's proposed transit tax for
the levy year; and,
WHEREAS, it is in the best interest of the City of Chanhassen that it declare/ts intent to
exercise the local transit levy option for taxes payable in 2000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chanhassen as follows:
1. The City hereby declares its intent to exercise the local transit tax levy option for taxes
payable in 2000 in an amount not to exceed that permitted by Local Levy Option Act and as
certified by the State Commissioner of Revenue in accordance therewith.
2. The City Manager is authorized and directed to give the State Commissioner of Revenue
and the Metropolitan Council of the City's intent to exercise the local transit tax option for taxeS
payable in 2000 in accordance with the notice attached hereto as Exhibit A and incorporated herein
by reference.
PASSED AND ADOPTED by the Chanhassen City Council this 28th day of June,
1999.

NOTICE OF INTENT TO EXERCISE
LOCAL TRANSIT TAX LEVY OPTION FOR
TAXES PAYABLE IN 2000
The State Commissioner of Revenue and the Metropolitan Council are hereby notified that the City
of Chanhassen, Minnesota, intends to exercise the local transit tax levy option for taxes levied in
1999 and payable in 2000 pursuant to Laws of Minnesota for 1996, Chapter 455, Section 4.
The proposed amount of the City's transit tax for the 2000 levy year is $746,548, or the 1999 levy
amount ($691,977) multiplied by the maximum levy limit for the City of Chanhassen, whichever is
less, all in accordance with Laws of Minnesota for 1996, Chapter 455, Section 4, for taxes levied
by the City in 1999 and payable in 2000.
