'f1110 a, 95_ 22- Web Site thai basset 'T'r LiS MEMORANDUM TO: FROM: DATE: Todd Gerhardt, City Manager Paul Oehme, City Engineer/Dir. of Public Works June 9, 2004 SUB J: 2004 MSA Street hnprovements, Consider Adoption of Assessment Roll, Project No. 04-02 REQUESTED ACTION Staff requests the City Council consider a resolution adopting 2004 MSA Street Assessment Roll. FACTS On May 24, 2004 a public hearing was held considering assessments for this project. Staff presented an assessment roll consistent with the feasibly study that was adopted on September 22, 2003. Staff received six objections to the assessment amounts. Five of the objections were from residential property owners on 78th Street west of Great Plains Blvd. The Chapel Hill Academy School on 78th Street also delivered an assessment objection to the City. The objections mainly were concerning being assessed for a collector street. In addition some property owners were concerned about being assessed for a street that was somewhat in better condition that other segments in the project area. Also, some residents were concerned with being assessed even though their property accesses off a side street. Furthermore, funding for West 78th Street and Market Blvd. was also discussed in depth because of the additional Turn Back funds the City is anticipating to receive from the State. At the September 22, 2003 Council meeting, the Council adopted a resolution approving the feasibility study, assessment roll and authorizing preparation of plans and specifications for the project. The completion date for the assessment process is July 26, 2004. Property owners may choose to pay off the assessment amount in full prior to the July 26, 2004 date without interest. The County Auditor will certify the assessments in November, 2004. The assessments will be payable in 2005. The proposed assessments total is changed to $308,598.53. Discussion of the financing for the prqiect will be presented at the public hearing. The Todd Gerhardt June 8, 2004 Page 2 Financing Summary was prepared as information regarding the project to be assessed. The detailed assessment roll is attached to this background. ISSUES At the May 24, 2004 public hearing council directed staff to reevaluate the assessment mythology for West 78th Street. Staff feels the new assessment roll reflects Councils comments and addresses the property owners concerns that contested their assessment. The residential property owners that access off a side street and not onto West 78th Street are not proposed to be assessed at this time. They will be assessed when their side street is reconstructed in the future. The Chapel Hill Academy current access is off of Market Blvd. However, the Academy will be asking the City for approval for a right-in right-out access to their parking lot off of West 78th Street soon. Staff gave the property owner credit for their existing access off of Market Blvd. and proposed to reduced their assessment by half. West 78th Street from TH 101 to Market Blvd was reconstructed by the State of Minnesota in 1992. No assessments were levied to abutting property owners at that time. This segment of roadway was rated in 2001 and currently has a pavement condition index (PCI) of 66. For a stand alone street resurfacing job staff would consider resurfacing streets from a 41 to 65 PCI rating. The other roadway segment in the project area rate between 38 and 62. Staff' feels that resurfacing West 78th Street know is the most cost effective approach for the City. It is estimated that to postpone this work and resurface West 78th Street later would cost approximately $14,000 more when we consider the additional mobilization, small traffic control plan, additional engineering and biding work, smaller quantities of materials and inflation. If West 78th Street is know, the pavement will be at the same theoretical age as the other segments in the area so route maintenance and improvements will be scheduled the same in the future. Staff would typically consider resurfacing a street on average every between 15 years. Since this street is 12 years old staff has proposed a credit for the property owner on 78th Street from Great Plans Blvd. to TH 101 reflecting the 3 years of theoretical additional pavement live. The residential property owners on West 78th Street are know proposed to be assessed at a unit rate instead of an area charge as the commercial properties. This approach is consistent with the residential street reconstruction project. The Turn Back funds that are currently available from MnDot will be used for West 78th Street from Market Blvd to TH 101 and Market Blvd from West 78th Street to TH 5. These funds will not be available in the future if this project is not constructed in 2004. RESUME OF ASSESSMENT PROJECT IMPROVEMENT PROJECT NO. 04-02 MSA STREET IMPROVEMENTS TYPE OF IMPROVEMENTS & GENERAL LOCATION: The rehabilitation of streets includes the mill and overlay in the following areas: 78th Street from TH 101 to Market Boulevard 79th Street from Market Boulevard to Great Plains Boulevard Market Boulevard from 78th Street to TH 5 Great Plains Boulevard from 79th Street to TH 5 TOTAL PROJECT COST: $818,325.00 PROPOSED ASSESSMENT RATE: Commercial Street Assessment Rate/acre: $6,994.23 Exempt Street Assessment Rate/acre: $3,916.77 Residential Rate/parcel: $458.16 LENGTH OF ASSESSMENT: 8-Years with 6% interest ADDITIONAL COMMENTS: The rehabilitation of these streets consists of milling two inches (2") of bituminous paving and overlaying (2"). Removal and repair of curb & gutter sections that are damaged along concrete sidewalk. Storm sewer improvements along 79th Street are included. G:\ENG\PUBLIC\04 02\ASSESSMENT HEARING background 061404 DOC CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: June 14, 2004 RESOLUTION NO: MOTION BY: SECONDED BY: A RESOLUTION ADOPTING ASSESSMENT ROLL FOR 2004 MSA STREET IMPROVEMENT PROJECT NO. 04-02 WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for the improvement of W. 78th Street from TH 101 to W. 78th Street, from TH 101 to Market Boulevard, W. 79th Street from Market Boulevard to Great Plains Boulevard, Market Boulevard from W. 78th Street to TH 5, and Great Plains Boulevard from W. 79th Street to TH 5, NOW THEREFORE, BE IT RESOLVED by the City Council of Chanhassen, Minnesota: Such proposed assessment, a copy of which is attached hereto and made a part hereof, if hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. Such assessment shall be payable in equal annual installments extending over a period of 8 years, the first of the installments to be payable on or before the first Monday in January, 2005, and shall bear interest at the rate of 6 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment fi'om the date of this resolution until December 31, 2005. To each subsequent installment when due shall be added interest for one year on all unpaid installments. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged in the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the County. Such assessments shall be collected and paid over in the same manner as other municipal taxes. Passed and adopted by the Chanhassen City Council this 14th day ol~ June, 2004.
