City Council approval for the easement release requires a simple majority vote of the City Council present. According to the city attorney, the release of the tree preservation easement does not require a public hearing. BACKGROUND The 4th Addition of the Meadows at Longacres was approved in 2000. At that time the rear yard of Lot 1, Block 1 was wooded. The developer, Lundgren Bros., placed a tree preservation easement over that area of the yard. It was their practice to administer tree preservation or conservation easements over areas outside of the proposed building areas that contained a significant number of trees or were adjacent to wetlands, respectively. DISCUSSION Lot 1, Block I was wooded in the rear with a mix of elm, boxelder and ash. The majority of trees were elm and have been heavily infected with Dutch elm disease over the last few years. The homeowners have had to remove numerous infected trees each summer. Currently, few trees remain within the easement and staff is recommending that the easement be repealed from the property since it is no longer the wooded area for which the easement was intended.
