JS MEMORANDUM TO: Todd Gerhardt, City Manager FROM: DATE: SUB J: Bob Generous, Senior Planner August 23, 2004 Modification to the Rural Service District PROPOSAL SUMMARY The city is divided into an urban service district and a rural service district, constituting separate taxing districts for the purpose of all municipal property taxes except those levied for the payment of bonds and judgments and interest thereon. Within the rural service district regulations, the ratio that exists between the benefits resulting from tax supported municipal service to parcels in the rural service district to parcels in the urban service district is seventy-five (75). Rural service properties are therefore taxed for municipal taxes at 75 percent of rate used for other properties. City Council has directed staff to evaluate the rural service district including looking at the properties designated within the rural service district and reviewing the costs and benefits of maintaining the district. BACKGROUND On October 27, 2003, the Chanhassen City Council approved amendments to section 2-32 of the Chanhassen City Code regarding the Rural Service District. At that time, City Council did not act on revisions to the Property List for properties in the Rural Service District. DISCUSSION In reviewing the property list for Rural Service District Properties, the city has relied on a Rural Service District task force, consisting of Steven Berquist, Gayle Degler, Willard Johnson and A1 Klingelhutz. In 1995, this task force first met to review and recommend changes to the rural service district properties. Staff submitted the recommendation to the Rural Service Task Force for their opinion on these changes. The Rural Service Task Force recommends that those properties within MUSA that are still primarily farmed be retained under the rural service designation. They reason that these properties are undeveloped and therefore are not benefited to the same degree as other lands by municipal services financed by general taxation as developed properties are. When these properties are developed, then they should and will be removed from the rural service district. This would be accomplished through the adoption of resolution 3. Adopt the Rural Service Task Force recommended list of properties in the rural service district. 2. Adopt the modified list of properties in the rural service district prepared by staff based on the exclusion of properties with sewer and water available. 3. Adopt a resolution deleting all properties from the rural service district. Staff recommends that City Council adopt Resolution #3 that rural service designation is no longer needed based on the cost benefit of administering this program and the benefits received by the property owners and the community as a whole.
