MEMORANDUM
TO:
Todd Gerhardt, City Manager
FROM:
Justin Miller, Assistant to the City Manager~) ¡.~
September 1, 2004 (J~ .
DATE:
RE:
Transfer of Ownership of Old Village Hall Parcels to the
Chanhassen Economic Development Authority
BACKGROUND
On August nrd, the EDA approved a purchase agreement with Fred and Valaire
Riese for Old Village Hall addition for the purposes of building a Goddard
Learning Center. This land is actually an assemblage of eight individual parcels
acquired by the City and/or ED A over a period of time.
Two of the parcels within this area are technically owned by the City of
Chanhassen, not the EDA. Consistent ownership of these parcels is needed for
the following reasons:
1) The purchase agreement is between the Riese's and the EDA.
2) The final plat defines the area as wholly owned by the ED A.
3) Under Minnesota statutes, the EDA, not the City, has the right to
re-acquire the property from the buyer if no action has been taken
on the land within one year.
RECOMMENDA TION (maioritv approval required)
Staff recommends the City Council quit claim deed the City-owned parcels within
the area preliminarily platted by Otto Associates to the Chanhassen Economic
Development Authority.
