According to Chanhassen city code section 5-16, a private kennel is defined as "more than two dogs; or a combination of four dogs or cats over six months in age are kept or harbored, provided such animals are owned by the owner or lessee of the premises on which they are kept or harbored." According to Chanhassen city code section 5-18, a license is required for a private kennel. If the site inspection meets the animal control officer's satisfaction, and no negative comments are received by the City, then the license is issued. The application for this license was posted in the September 23rd edition of the Chanhassen Villager. The public has ten days from the publication of the notice to submit comments. Staff received both verbal and written comments (see attached letter), so this matter automatically goes to the City Council for their consideration. Staff has inspected the house where the animals are to be kept and found it to be in satisfactory condition (see attached report). While the number of cats is high, staff believes that they can be cared for in an acceptable manner. The only pending matter is the actual registration of the animals. No private kennel permit can be issued until the owners register their animals with the City of Chanhassen. RECOMMENDA TION (requires majority vote of the Council) Staff recommends the City Council approve the application for a private kennel permit at 8561 Flamingo Drive pending registration of all animals listed on the application. While we were at the residence we spoke with both Lindy and Denise Hollingsworth. They are the owners of three (3) pug dogs and eight (8) cats of various breeds. On the first and second floors of the residence they keep the three dogs, each of which has their own kennel to sleep in. Each kennel is approximately 32"x 48" in size. Mr. Hollingsworth stated that the dogs are free to roam the main and second floors of the house when someone is home, but are never allowed to go downstairs in to the "cats area." He also stated that the dogs are never allowed to go outside unless they are on a leash. Downstairs, in the basement they house eight (8) cats of mixed breeds. All of the cats are kept together inside of a fenced kennel area approximately 12' x 20' in size. There are multiple beds for the cats to sleep on and items for them to crawl and scratch upon. There appeared to be a sufficient amount of food and water available to all of the animals at all times. All of the animals appeared to be very well cared for at all times. At this time we would recommend approval of the kennel application that the HoIlingsworth's submitted. The residents of 8561 Flamingo Dr. have requested this permit. I do understand that it is a private permit. I do not believe that this many animals are healthy for a home or community.
