EXECUTIVE SUMMARY
The property owner has requested that the City terminate the existing conditional
use permit for a 199-foot commercial radio tower and antenna and an 8-foot by
16-foot building. The terms of the conditional use permit state that "the City may
revoke the permit following a public hearing under any of the following
circumstances: material change of condition of the neighborhood where the use is
located; violation of the terms of the permit". Approval of the subdivision for
Settlers West is a material change of the neighborhood where the use is located.
Additionally, the tower and building have been demolished in preparation of the
land for homes.
BACKGROUND
On October 5, 1987, the Chanhassen City Council approved the conditional use
permit, #87-14, for a 199-foot commercial radio tower and antenna and an 8-foot
by 16-foot building.
On July 12,2004, the Chanhassen City Council granted final plat approval of
Planning Case #04-05 creating 48 lots and 3 outlots for Settlers West on the
property.
On May 10, 2004, the Chanhassen City Council approved the following:
A.
The Comprehensive Plan Amendment to incorporate the property in the
2000 Metropolitan Urban Service Area (MUSA).
B.
Rezoning of the property from A2, Agricultural Estate District to RSF,
Single Family Residential District.
C. Preliminary plat (Subdivision) to create 48 lots, 3 outlots and public right-
of-way with a variance for street width.

CONDITIONAL USE PERMIT
1. Permit. Subject to the terms and conditions set
forth herein, the City of Chanhassen hereby grants a conditional
use permit for: the installation of a 199 foot commercial radio
tower and antenna and an 8' x 16' building.
2. Property. The permit is for the following described
property in the City of Chanhassen, Carver County, Minnesota:
Parcel .1: All that part of Gov't Lot 1, Section 36, Township
116, Range 23, Carver County, Minnesota, which lies Northerly of
trunk highway No. 212.
Parcel .2: All that part of the Southeast Quarter (SE~) of
Section 25, Township 116, Range 23, lying Easterly of the
Easterly right of way of the Chicago and Northwestern Railway
(formerly the Minneapolis and St. Louis Railway) containing 45

3. Conditions. The permit is issued subject to the
following conditions:
1. The applicant must receive a permit from FCC.
2. The chain link fence may not exceed 6 1/2 feet in height and
must receive a fence permit and meet all fence requirements.
3. The applicant must receive a building permit prior to
construction of the building.
4. No residential structures shall be permitted within 200 feet
of the tower.
5. The applicant must determine the ultimate use of the tower.
4. Termination of Permit. The City may revoke the
permit following a public hearing under any of the following
circumstances:
