A special meeting of the Chanhassen City Council was called to order on Monday, October 5,
1998 at 5:30 p.m. The following members were present: Mayor Nancy Mancino, Councilmen
Berquist and Senn. Staff present included Don Ashworth, City Manager; Charles Folch, Director
of Public Works Operations; and Anita Benson, City Engineer

Approve Change Order No. 2 for Project No. 97-1A (98-1) Pond Relocation: City Engineer
Benson presented the following staff report:
"This change order is necessary to provide for additional storm sewer quantities required to
relocate the original proposed storm water pond in the Lake Lucy Road project to approximately
45 feet south of that shown on the original plan. This pond is a regional storm water quality pond
as identified for the area in the City's Surface Water Management Plan. Since the time that the
original pond was designed and approved, a revision has occurred to the official wetland
delineation for the property. Staff was aware that the wetland boundary was under scrutiny at the
time the original pond was designed. However, in order not to hold up the Lake Lucy Road
project, a pond was designed under the restrictions imposed by the original delineation which was
under question. Since that time, the City's Water Resources Coordinator has worked extensively
with other agencies over a period of several months to determine the wetland boundary. When
the wetland delineation, as submitted by Svoboda Ecological Resources dated June 20, 1997, was
accepted by the relevant agencies and the LGU, engineering staff re-evaluated the pond design.
The pond is now proposed to be relocated approximately 45 feet south of that originally shown
on the attached drawing.
The new pond location has several advantages over the original pond design. They are as
follows:
This pond will be constructed in a relatively flat area and will not outlet on a hill as
previously proposed, thus eliminating potential erosion concerns from the discharge of the
pond.
The new pond will have 3,000 cubic feet more storage volume than the previous pond
design.
From a liability standpoint, the pond is further away from both existing and proposed
homes and away from steep slopes, thus creating a safer pond.
Staff is aware that there have been concerns expressed regarding the tree removal which will be
required to construct the pond at the revised location. It is important to remember that, although
trees will be removed at both pond locations, these trees are primarily willow and elm which have
grown up since farming of the land was discontinued. Upon completion of the pond construction,

it is anticipated that these types of trees will re-establish themselves in the area. Additionally, the
City of Chanhassen will be planting 21 trees in conjunction with the Lake Lucy Road construction
and the Brenden Pond 3rd Addition development will be installing an additional 24 trees.
The relocation of the pond will necessitate an additional quantity of 750-millimeter (30-inch)
concrete pipe and an additional drainage structure for a total increased cost of $7,560. As this is
a regional pond as identified by the Surface Water Management Plan, SWMP funds will be
utilized to pay for the additional costs. Staff believes the long-term benefit to be gained by
relocating and constructing the larger pond outweighs any short-term loss of tree undergrowth.
Therefore, it is recommended that the City Council approve Change Order No. 2 for City Project
No. 97-1A (98-1) in the amount of $7,560."
Upon completion of the staff report and Council discussion, the meeting was opened up for public
comment. Ms. Erin Raden, 2237 Lake Lucy Road, expressed concerns regarding the new
location of the storm water pond; specifically, with the tree removal that will be taking place. She
requested that upon completion of the pond at the new location Council consider the addition of
landscaping in the pond area to replace some of the trees which would be removed due to pond
construction.
Resolution 98-89: Councilman Berquist made a motion to approve Change Order No. 2 for
Project No. 97-1A (98-1) Lake Lucy Road Pond Relocation in the amount of $7,560 with the
condition that staff incorporate wetland grass seed mix and install trees consistent in type with
those being removed for the pond construction. Councilman Senn seconded the motion.
Councilmen Senn and Berquist voted in favor. Mayor Mancino abstained.
A motion was made by Councilman Berquist and seconded by Councilman Senn to adjourn the
special meeting at 5:45 p.m. All voted in favor and the motion carried.
