SUMMARY
Staff is requesting the City Council:
1. Receive public comment on the City's NPDES Phase II MS4 Storm Water
Pollution Prevention Program and annual report;
2. Review the City's progress on meeting the requirements of its MS4
permit; and
3. Authorize the Mayor to sign the annual report upon completion, for
submittal to the Minnesota Pollution Control Agency (MPCA).

BACKGROUND
Over the past year the City of Chanhassen has implemented or addressed a
number of the Best Management Practices (BMPs) that were included in its
MS4 permit application. The BMPs within the MS4 permit are required to
address 6 areas of City operations. These 6 areas are:
1. Public Education and Outreach;
2. Public Participation and Involvement;
3. Illicit Discharge Detection and Elimination;
4. Construction Site Runoff Control;
5. Post-Construction Runoff Control; and
6. Pollution Prevention/Good Housekeeping for Municipal Operations.

Presently, the permit is valid for about 3 more years (until March 10, 2008). Last year, a
lawsuit was filed by the Minnesota Center for Environmental Advocacy (MCEA) against
the MPCA with regards to the permit. Consequently, the permit must be reissued by the
MPCA in 2005. Municipalities will be required to resubmit their applications once the
permit is reissued. The current permit applications will be disregarded by the MPCA at
that time. City staff will use this opportunity to modify the Storm Water Pollution
Prevention Program (SWPPP) where current BMPs or measurable goals are inadequate
or not practical.
The current permit requires the City to submit an annual report by March 10 of each year.
The annual report form is not yet available from the MPCA; however, it is anticipated to
be similar to last year's form. The annual report summarizes progress toward measurable
goals for each BMP in the SWPPP. The reporting also helps ensure all City departments
remain aware of MPCA and EP A standards and keeps the City on target to achieve the
goals set forth in the SWPPP. Input has been solicited from City departments on progress
towards the City's measurable goals and entered into a storm water management database
(ASIST) to help track progress with the MS4 permit.
In addition to the annual report, the City must hold a public hearing on the SWPPP. The
purpose of the public hearing is to allow for public comment on the SWPPP. Comments
can be oral or written and must be recorded so the SWPPP can be revised by staff if
public comment merits such revisions. A Record of Decision (ROD) is prepared by staff
following the receipt and review of public comment. The ROD is submitted to the
MPCA as part of the annual report.
2004 HIGHLIGHTS OF PROGRESS
· Initiated 2004 Surface Water Management Plan Update.
o Began the x-y-z stormwater structure inventory. To date, 800 structures
have been located; invert data has been collected for 450.
o Began function and value assessments of Chanhassen' s wetlands.
o Upon completion of the SWMP, the City will have a better idea of
additional infrastructure needed, infrastructure in need of maintenance and
additional ordinances that may be needed to improve water resources
within Chanhassen and complete some BMPs necessary for the MS4
permit.
· The City continued its contract with the Carver Soil and Water Conservation
District. The CSWCD reviewed erosion and sediment control plans for 20
development sites and performed 210 construction site inspections within these
sites during the 2004 construction season.
· Included articles related to storm water quality in each Chanhassen Connection in
all 2004 issues. Articles included:

· Storm water survey results from 2003 were compiled for analysis (results
available upon request).
· Continued entering activities into ASIST database to track permit progress.
. Developed non-structural BMP tracking procedure.
· Inspected 10 newly installed septic systems and sent out approximately 100
reminders to property owners for the septic maintenance program.
· Maintained 55 of 58 sump catch basins.
· Recycled 1,300 gallons of waste oil from City facilities (350 more than in 2003).
· Chanhassen residents made 4,734 visits to Carver County Environmental Center
(1,451 more than in 2003).
· Collected 90 cubic yards of Christmas trees at the Lake Ann collection location.
· Swept approximately 100 miles of pavement during spring and fall street
sweeping, removing 1,732 tons of debris from streets.
o Sweeping activities generally occurred around Chanhassen lakes first to
minimize impacts to the resources.
· 28.5 tons of phosphorous-free fertilizer was used in municipal parks in 2004.
· 2004-2008 Environmental Activity Implementation Plan developed.
· Construction site inspection and stop work order procedures solidified.
· Communication procedures formalized between the City and CSWCD.
RECOMMENDA TION
Staff recommends the City Council:
1. Hold public hearing and receive public comment on the NPDES Phase II MS4
Storm Water Pollution Prevention Program and annual report; and
2. Adopt the following motion: "The Chanhassen City Council authorizes the
Mayor to sign the City's NPDES Phase II MS4 General Permit annual report as
compiled by staff, and submit the report and all required materials to the
Minnesota Pollution Control Agency by March 10,2005."

Public Education and Outreach
Descriptive Text:
To satisfy this minimum control measure, the operator of a regulated small MS4 needs to:
1. Implement a public education program to distribute educational materials to the community, or
conduct equivalent outreach activities about the impacts of storm water discharges on local
waterbodies and the steps that can be taken to reduce storm water pollution; and
2. Determine the appropriate best management practices (BMPs) and measurable goals for this
minimum control measure.
An informed and knowledgeable community is crucial to the success of a storm water management
program since it helps to ensure the following:
1. Greater support for the program as the public gains a greater understanding of the reasons why it is
necessary and important. Public support is particularly beneficial when operators of small MS4s
attempt to institute new funding initiatives for the program or seek volunteers to help implement the
program; and
2. Greater compliance with the program as the public becomes aware of the personal responsibilities
expected of them and others in the community, including the individual actions they can take to protect
or improve the quality of area waters.

Decision on the EAIP will be made by assessing the basic 2003 - 2004 EAIP and its specific
components below.
Specific Components:
The 2004 - 2008 EAIP will be a more comprehensive educational program and will incorporate, among
other things, more training for city staff. The staff training will be aimed at preventing and reducing
storm water pollution from activities such as park and open space maintenance, fleet and building
maintenance, new construction and land disturbances, and storm water system maintenance.

"Every Curb's A Shoreline" Article
An article with the above title appeared in the City's quarterly newsletter, the Chanhassen Connection.
The newsletter is distributed City-wide. This particular article was printed in the Summer 2003 edition.
"Did you know that every curb in Chanhassen is a little piece of shoreline? Well, not literally. Each
curb is a part of the storm sewer system. The water from streets drains into the storm sewer system,
which flows into storm water ponds that flow into wetlands, lakes, and creeks. This means that all the
litter, chemicals, leaves, and grass clippings that we put in the street eventually end up in the water
bodies we try so hard to protect. Composting, recycling, and proper disposal of waste and chemicals
will help to clean up Chanhassen's water resources."

"MN Fertilizer Law"
Minnesota's New Fertilizer Law
You may have heard that the state legislature recently passed a law that regulates the use of
phosphorus fertilizers on lawns in the metro area. Starting January 1, 2004, fertilizers containing
phosphorus cannot be used on lawns in the metro area. (The middle number on a bag of fertilizer is
the percent phosphorus. From now on, that number should be zero (0).)
It's also illegal to spread fertilizer on hard surfaces like streets, sidewalks and driveways. Rain washes
fertilizer into nearby storm drains or road ditches, and eventually into lakes and rivers. If you
accidentally spill or spread fertilizer on a hard surface, clean it up immediately.
Fertilizers containing phosphorus may be used on lawns if a soil test indicates it is needed or if you are
establishing a new lawn. The no-phosphorus restrictions do not apply to fertilizers used for agricultural
crops, flower and vegetable gardening, or on golf courses by trained staff.
What's the problem?
Phosphorus is the main nutrient that leads to green pond scum and green lakes. This is because it
provides food for algae, duckweed and other aquatic weeds. Having too many aquatic plants in a
water body can cause lower oxygen levels and water that doesn't allow light through. This can have a
devastating effect on fish populations.
Find out what you need: Test your soil.
A soil test is a good idea, especially if you are concerned that your lawn may need phosphorus.'

INFO-U by calling 612-624-2200 and requesting message 468.

"If you're like every other resident of Chanhassen, you've washed your car in the driveway a time or
two. It's a great way to get outside and enjoy the weather, right? It may be, but it can also be a source
of pollution for our creeks and lakes. Think of everything in your car (oil, antifreeze, brake pads,
grease, and rubber just to name a few) and everything you drive through (mud, sand and salt). Then
think of all the cleaners and detergents you use to wash your car. The soapy, dirty water running onto
your lawn or into the street doesn't go to a water treatment plant. Instead, it runs into storm drains or
other drainage-ways and eventually to Chanhassen's water bodies. As you might imagine, those
pollutants have an impact on fish and other organisms. You might want to think twice before you break
out the hose and bucket. Take your car to the car wash!"

"Ways to Reduce Green Pond Scum" Article

"That unsightly green scum on your local pond need not be a permanent part of the neighborhood. The
scum is made up of algae - microscopic plant organisms. Like other plants, algae can only thrive if
given a steady supply of nutrients. Here are some steps you and your neighbors can take to reduce
the amount of nutrients feeding that pond scum:
Buffer strips (areas of natural vegetation) along the shore of ponds and wetlands reduce the amount
and velocity of storm water runoff going to the basins. Less soil erosion means less sediment being
carried in the runoff and deposited into the pond. In addition, the vegetation uses the nutrients that are
in the runoff water. This will reduce the amount of nutrients available to the algae, thus limiting their
growth.
Stop using lawn fertilizers that contain phosphorus. Phosphorus is a nutrient that boosts plant growth,
but Chanhassen's soils already have more than enough phosphorus to sustain your lawn. The
residential use of fertilizers with phosphorus is restricted in the seven-county metro area. To find out
how the new restrictions apply to you, contact the Minnesota Department of Agriculture at
651-297-7269.
Proper management of yard waste is another important step in reducing green pond scum. When
grass clippings and leaves get into water bodies, either directly or through the storm drain system, they
decompose and release nutrients into the water. These nutrient loads further increase algae growth.
Mulching and composting are great ways to take care of yard waste.
Some cleaning activities also add phosphorus to our water resources. Many common household
cleansers contain phosphates that, when released into water, break down into a form of phosphorus
that algae use as food. Using phosphate-free cleansers will reduce algae overgrowth in your
neighborhood ponds and wetlands.
Water your lawn responsibly. If you water your lawn, give it only what it needs, about Y2 to 1 inch of
water at a time. Over-watering your lawn wastes water and leads to excess surface runoff, which
carries nutrients away from your lawn and into nearby water resources.
By following these simple steps, you can help combat green pond scum."

Ice House Trash/Deicing Salt usage/Leaf Pile Location
Now that winter is here it is easy to forget that protecting Chanhassen's water resources does not end
after leaves have been raked up in the fall. It is important to participate in year round water resource
protection to maintain Chanhassen's high quality water resources. Here are a few suggestions that will
help local water quality as well as maximize the enjoyment of all users of Chanhassen's water

resources.
1) If you're thinking about raking your leaves to your shoreline or into your wetland, don't! By raking
your leaves to the edge of lakes and wetlands you are allowing additional nutrients to enter the water
resource. Keep your leaf piles far enough away from the lake that the leaves will not find their way into
the lake. Keeping nutrients in your gardens or compost bins and out of local lakes and wetlands will
ensure cleaner healthier water resources in Chanhassen. Call the Carver County Environmental Center
(952-361-1400) for prices and directions to their yard waste disposal drop off site. The Environmental
Center also has compost bins for sale to Carver county residents.
2) If you plan on ice fishing on area lakes this winter take all refuse off the lake with you. This will not
only ensure cleaner lakes, it will also create safe, enjoyable experiences for all users such as
snowmobilers, cross-country skiers, ice skaters and snowshoe users.
3) Are you getting a real tree for the holidays? When you are finished enjoying the tree in your home,
have it picked up by your refuse hauler or compost it. Do not leave it on the ice of a pond, wetland or
lake. When a tree decomposes it releases nutrients. If the nutrients are released into a water resource
they contributes to poor water quality, including algae blooms (green ponds).
4) If you use ice melting salts to help clear your driveway of ice try to minimize the amount you apply.
Follow the directions on the bags, or mix the salt with some sand to minimize salt use. Keep in mind
that all snow and ice melted on your property (and any chemicals or sand you use) will eventually end
up in area lakes and wetlands. If too much salt or sand is applied to your driveway it not only can burn
your grass and trees, but it can also harm area lakes and wetlands.
Surface Water Management Plan Update-
The City of Chanhassen is beginning to work on updating its 1994 Surface Water Management Plan
(SWMP). The update of the SWMP will help guide the future projects and developments within the City
of Chanhassen and make recommendations on how to improve water quality. The SWMP update
should be completed by December 2005.

Keep Your Car out of Chanhassen's Lakes
Cars cause air pollution, many of us know that. But did you know that cars are polluting Chanhassen's
lakes and creeks? Those oil spots on your driveway or parking space are actually water pollution
waiting to happen. When water flows over pavement, it picks up everything in its way. If motor oil and
other fluids leak out of your car, they are washed into street storm drains and eventually into our lakes
and creeks. However, paying a little more attention to our cars can make a big difference. Here are
some ideas:
Protect the Drain
Americans dump an estimated 120 million gallons of oil down storm drains each year even though it is
illegal to dump motor oil, antifreeze, battery acid or other auto products down storm drains. Protect
water quality by taking used auto products to the Carver County Environmental Center (952-361-1835).
Repair Leaks
Auto leaks form pollution puddles on your street or driveway and eventually get washed into storm
drains. If you find a leak, soak it up with cat litter, sweep up the cat litter and throw it in your garbage.
At the Car Wash
When you wash your car at home, the soapy, dirty water running down your driveway and into the
street doesn't go to a water treatment plant. Instead, it goes into Chanhassen's lakes and creeks. The
water from car washes is treated in water treatment plants.

Try Alternatives
Research shows that the most polluted runoff comes from heavily traveled streets and highways. As
your car leaks and tires and brake linings wear down, all the pollutants get washed into our lakes and
creeks. Take time to walk or ride your bike. Or plan errands so you can make the most out of every
mile you drive.

people to help with storm drain marking. Families or community groups with participants over the age
of 16 are invited to help. All the required materials and safety gear are provided. To volunteer or for

Where Should I Leave Leaves?
Soon you'll be faced with this perennial question. Yard waste contains a lot of nutrients that can
contribute to nuisance algae and duckweed levels in our ponds, wetlands and lakes. To protect our
water resources, it is important that leaves be collected and disposed of properly. This means that yard
waste shouldn't be dumped in ponds, wetlands or shoreland areas or swept or blown into streets.
Instead, there are a number of alternatives that will help you clean up your yard while keeping
Chanhassen's lakes clean.
Carver County Environmental Center: The Carver Environmental Center accepts yard waste
for a nominal fee. Chanhassen residents can use the coupon included in this edition of the
Chanhassen Connection for up to $10 in recycling services from Carver County Environmental Center.
Compost: Compost your yard waste to improve the fertility of your flower or vegetable
gardens. Composters can be purchased from the Carver County Environmental Center or many lawn
care stores.
Mulch: Protect your flowers and shrubs from the bite of winter. Use leaves to cover plants to
help protect them from the deep freeze. If you live in a wooded area, consider spreading the leaves ou
in the woods. It acts as a natural fertilizer and provides suitable habitat for tree regeneration.
Pick-Up: Many waste haulers offer yard waste disposal services. Contact your waste hauler
for services offered and associated costs.

Descriptive Text:
To satisfy this minimum control measure, the operator of a regulated small MS4 must:
1. Comply with applicable State, Tribal, and local public notice requirements; and
2. Determine the appropriate best management practices (BMPs) and measurable goals for this
minimum control measure.
EPA believes that the public can provide valuable input and assistance to a regulated small MS4's
municipal storm water management program and, therefore, suggests that the public be given
opportunities to play an active role in both the development and implementation of the program. An
active and involved community is crucial to the success of a storm water management program
because it allows for:
1. Broader public support since citizens who participate in the development and decision making
process are partially responsible for the program and, therefore, may be less likely to raise legal
challenges to the program and more likely to take an active role in its implementation;
2. Shorter implementation schedules due to fewer obstacles in the form of public and legal challenges
and increased sources in the form of citizen volunteers;
3. A broader base of expertise and economic benefits since the community can be a valuable, and free,
intellectual resource; and
4. A conduit to other programs as citizens involved in the storm water program development process
provide important cross-connections and relationships with other community and government
programs. This benefit is particularly valuable when trying to implement a storm water program on a
watershed basis, as encouraged by EPA.

Illicit Discharge Detection and Elimination
Descriptive Text:
Recognizing the adverse effects illicit discharges can have on receiving waters, the final rule requires
an operator of a regulated small MS4 to develop, implement and enforce an illicit discharge detection
and elimination program. This program must include the following:
1. A storm sewer system map, showing the location of all outfalls and the names and location of all
waters of the United States that receive discharges from those outfalls;
2. Through an ordinance, or other regulatory mechanism, a prohibition (to the extent allowable under
State, Tribal, or local law) on non-storm water discharges into the MS4, and appropriate enforcement
procedures and actions;
3. A plan to detect and address non-storm water discharges, including illegal dumping, into the MS4;
4. The education of public employees, businesses, and the general public about the hazards
associated with illegal discharges and improper disposal of waste; and
5. The determination of appropriate best management practices (BMPs) and measurable goals for this
minimum control measure.
Discharges from MS4s often include wastes and wastewater from non-storm water sources. A study

conducted in 1987 in Sacramento, California, found that almost one-half of the water discharged from a
local MS4 was not directly attributable to precipitation runoff. A significant portion of these dry weather
flows were from illicit and/or inappropriate discharges and connections to the MS4. Illicit discharges
enter the system through either direct connections (e.g., wastewater piping either mistakenly or
deliberately connected to the storm drains) or indirect connections (e.g., infiltration into the MS4 from
cracked sanitary systems, spills collected by drain outlets, or paint or used oil dumped directly into a
drain). The result is untreated discharges that contribute high levels of pollutants, including heavy
metals, toxics, oil and grease, solvents, nutrients, viruses, and bacteria to receiving waterbodies.
Pollutant levels from these illicit discharges have been shown in EPA studies to be high enough to
significantly degrade receiving water quality and threaten aquatic, wildlife, and human health.

2004 Summary
City staff contacted Carver County Environmental Services staff on November 29, 2004 to discuss if
current salvage yard's potential to contributing pollution to storm water. Carver County stated that the
salvage yard has been a licensed waste generator since the 1980's. Due to the license the buissness is
subject to routine inspections to ensure proper hazardous waste management. The MN PCA
completed an inspection in 1999 without water sampling and found no problems other than the
commercial operation being located in a flood plain.

2003 Environmental Center Participation
In 2003, the City distributed $10 coupons for the Carver County Environmental Center in the

electronics at the Environmental Center.
From January 2003 through November 15, 2003:

Construction Site Runoff Control

Descriptive Text:
The Phase II Final Rule requires an operator of a regulated small MS4 to develop, implement, and
enforce a program to reduce pollutants in storm water runoff to their MS4 from construction activities
that result in a land disturbance of greater than or equal to one acre.
The small MS4 operator is required to:
1. Have an ordinance or other regulatory mechanism requiring the implementation of proper erosion
and sediment controls, and controls for other wastes, on applicable construction sites;
2. Have procedures for site plan review of construction plans that consider potential water quality
impacts;
3. Have procedures for site inspection and enforcement of control measures;
4. Have sanctions to ensure compliance (established in the ordinance or other regulatory mechanism);
5. Establish procedures for the receipt and consideration of information submitted by the public; and
6. Determine the appropriate best management practices (BMPs) and measurable goals for this
minimum
control measure.
Polluted storm water runoff from construction sites often flows to MS4s and ultimately is discharged
into local rivers and streams. Of the pollutants listed in Table 1, sediment is usually the main pollutant
of concern. Sediment runoff rates from construction sites are typically 10 to 20 times greater than those
of agricultural lands, and 1,000 to 2,000 times greater than those of forest lands. During a short period
of time, construction sites can contribute more sediment to streams than can be deposited naturally
during several decades. The resulting siltation, and the contribution of other pollutants from
construction sites, can cause physical, chemical, and biological harm to our nation's waters. For
example, excess sediment can quickly fill rivers and lakes, requiring dredging and destroying
aquatic habitats.

Post-Construction Runoff Control
Descriptive Text:
The Phase II Final Rule requires an operator of a regulated small MS4 to develop, implement, and

enforce a program to reduce pollutants in post-construction runoff to their MS4 from new development
and redevelopment projects that result in the land disturbance of greater than or equal to 1 acre. The
small MS4 operator is required to:
1. Develop and implement strategies which include a combination of structural and/or non-structural
best management practices (BMPs);
2. Have an ordinance or other regulatory mechanism requiring the implementation of post-construction
runoff controls to the extent allowable under State, Tribal or local law,
3. Ensure adequate long-term operation and maintenance of controls;
4. Determine the appropriate best management practices (BMPs) and measurable goals for this
minimum control measure.
Post-construction storm water management in areas undergoing new development or redevelopment is
necessary because runoff from these areas has been shown to significantly effect receiving
waterbodies. Many studies indicate that prior planning and design for the minimization of pollutants in
post-construction storm water discharges is the most cost-effective approach to storm water quality
management.
There are generally two forms of substantial impacts of post-construction runoff. The first is caused by
an increase in the type and quantity of pollutants in storm water runoff. As runoff flows over areas
altered by development, it picks up harmful sediment and chemicals such as oil and grease, pesticides,
heavy metals, and nutrients (e.g., nitrogen and phosphorus). These pollutants often become
suspended in runoff and are carried to receiving waters, such as lakes, ponds, and streams. Once
deposited, these pollutants can enter the food chain through small aquatic life, eventually entering the
tissues of fish and humans. The second kind of post-construction runoff impact occurs by increasing
the quantity of water delivered to the waterbody during storms. Increased impervious surfaces interrupt
the natural cycle of gradual percolation of water through vegetation and soil. Instead, water is collected
from surfaces such as asphalt and concrete and routed to drainage systems where large volumes of
runoff quickly flow to the nearest receiving water. The effects of this process include streambank
scouring and downstream flooding, which often lead to a loss of aquatic life and damage to property.

Descriptive Text:
Recognizing the benefits of pollution prevention practices, the rule requires an operator of a regulated
small MS4 to:
1. Develop and implement an operation and maintenance program with the ultimate goal of preventing
or reducing pollutant runoff from municipal operations into the storm sewer system;
2. Include employee training on how to incorporate pollution prevention/good housekeeping techniques
into municipal operations such as park and open space maintenance, fleet and building maintenance,
new construction and land disturbances, and storm water system maintenance. To minimize
duplication of effort and conserve resources, the MS4 operator can use training materials that are
available from EPA, their State or Tribe, or relevant organizations;
3. Determine the appropriate best management practices (BMPs) and measurable goals for this
minimum control measure.
The Pollution Prevention/Good Housekeeping for municipal operations minimum control measure is a
key element of the small MS4 storm water management program. This measure requires the small
MS4 operator to examine and subsequently alter their own actions to help ensure a reduction in the
amount and type of pollution that: (1) collects on streets, parking lots, open spaces, and storage and
vehicle maintenance areas and is discharged into local waterways; and (2) results from actions such as
environmentally damaging land development and flood management practices or poor maintenance of
storm sewer systems. While this measure is meant primarily to improve or protect receiving water
quality by altering municipal or facility operations, it also can result in a cost savings for the small MS4
operator, since proper and timely maintenance of storm sewer systems can help avoid repair costs
from damage caused by age and neglect.
