FROM: Matt Saam, Assistant City Engineer /Úf1 ok DATE: January 18, 2005 ~I SUBJ: Approve Temporary Easement Acquisition with MnDOT for TH 212 - Project No. 03-09 (Simple Majority Vote Required) REQUEST The City Council is requested to approve the attached temporary easement with MnDOT for work related to the upcoming TH 212 project. BACKGROUND The City-owned parcel (Outlot B, Chanhassen Hills 1 st Addition), which MnDOT is requesting the temporary easement over, was dedicated to the City as a part of the Chanhassen Hills 1 st Addition plat in 1986. .~ ~ DISCUSSION MnDOT is requesting the temporary easement for work related to the upcoming TH 212 project. Specifically, this work involves the extension of Lake Susan Drive east of its current terminus at TH 101 and minor upgrades to existing TH 101. Based on MnDOT's appraisal of the City-owned parcel, they are offering a compensation amount of $100 for the temporary easement use. Due to the very small size of the temporary easement area « 50 sq. ft.), staff has no objections to the financial compensation amount. RECOMMENDA TION Staff recommends that the City Council approve the attached temporary easement with MnDOT for work related to the upcoming TH 212 project. TEMPORARY EASEMENT Date: C.S.1017(312=260)902 Parcel 67C County of Carver For and in consideration of the sum of Dollars ($ ), City of Chanhassen, a municipal corporation under the laws of the state of Minnesota, Grantor, hereby grants to the State of Minnesota, Grantee, a temporary easement to be used for highway purposes on all that part of the following described property in Carver County, Minnesota: All of the following: A temporary easement for highway purposes in that part of Outlot B, CHANHASSEN HILLS 18T ADDITION, shown as Parcel 67C on Minnesota Department of Transportation Right of Way Plat Numbered 10-18 as the same is on file and of record in the office of the County Recorder in and for Carver County, Minnesota, by the temporary easement symbol, said easement shall cease on December 1, 2009,or on such earlier date upon which the Commissioner of Transportation determines by formal order that it is no longer needed for highway purposes. Grantor is the owner of the above described premises and has the lawful right and authority to convey and grant the temporary easement herein granted. The said Grantor does hereby release the State of Minnesota from any claims for damages to the fair market value of the above-described area covered by this temporary easement and for its use, or any claims for damages to the fair market value of the remaining property of Grantor caused by the use of the temporary easement, including grading and removal of materials from said easement area for highway purposes. Notwithstanding the foregoing, Ii' Grantor does not release any claims it may have as a result of the negligence of the Grantee, its agents or contractors, in conducting any of the above activities.
