1980 03 24 I I I SPECIAL ASSESSMENT REVIEW COUNCIL MEETING ~1ARCH 24~ 1980 Acting Mayor Neveaux called the meeting to order at 8:00 p.m. with the following members present: Councilmen Pearson, Geving, and Swenson. Jim Orr, Dal e Campbell, and Russell Larson were present. Acting Mayor Neveaux announced that action on individual assessments will take place on April 14. TIMOTHY AND SANDRA FISHER, 7371 Minnewashta Parkway 25-08-000-0216-000 Four additional units arepropose-d~'for a total of $21,938.78 including interest. The property is 3.25 acres with approximately 500 feet of frontage. The Engineer noted that the proposed unit on the north end of the property would be undersized and he recommended removal of one unit. The Fisher's feel the property could be subdivided into two additional units for a total of three with their existing home. The plan that Mr. Fisher has submitted to the Planning Commission for subdivision shows three"lots. KATHLEEN HOLASEK, 7250 Minnewashta Parkway 25-08-000-0206-000 Five additional units are proposed for a total of $27,389.32 including interest. Councilman Pearson moved to approve a name change on the assessment roll from Edward M. All erman to Kathl een Ho1asek. Mot ion seconded by Councilman Swenson. The following voted in favor: Acting Mayor Neveaux, Councilmen Pearson, Geving, and Swenson. No negative votes. Motion carried. Mrs. Holasek asked if she would get additional assessments at a later date. She was told that the off-line area is in the wetlands area of Lake St. Joe. HAZEL THOMPSON, 7251 Minnewashta Parkway 25-08-000-0219-000 Four additional sewer and two additional water units are proposed. Rodney Thompson was present representing his mother. He feels there is not enough frontage for the four proposed units~ two could possibly fit. Two of the proposed units are along a sewer easement, not a public street. LOUIS ZAKARIASEN, 3861 Red Cedar Point Drive 25-08-000-0200~000 One additional unit is proposed for a total of $5,477.86 including interest. The issue of the ownership of a 24 foot piece of property between theZakariasens and the Searles' was discussed~ Depending upon who owns? the'24 foot piece of property, an assessment would be levied. The City Attorney asked both parties to produce a legal descriptiun of each parcel to resolve the issue. WESLEY SEARLES, 3841 Red Cedar Point Drive 25-08-000-0202-000 One additional unit is proposed for a total of $5,477.86 including interest. The issue of the ownership of a 24 foot piece of property between the Zakariasens and the Searles was discussed. An assessment will be levied depending upon who owns the 24 foot piece of property. The City Attorney asked both parties to produce a legal description of each parcel to resolve the issue. Mr. Searles asked if they are going to be assessed the off line units at a later date. Jim Orr stated that they are not being contemplated now. Assessment Review Meeting March 24, 1980 -2- GEORGE WAY, 3831 Red Cedar Point Drive 25-08-000-0210-000 Two additional units are proposed for a total of $11 ,914.97 including interest. I Mr. l.Jay asked who owns the property listed as "ownership unknown" in the Red Cedar Point Guide Plan. The City Attorney stated he would check Mr. l-lay·'s title. Both proposed uni ts,front on a private, road easement. Mr. Way requested that the City replace his survey stakes that were removed during construction of the project. Counci 1man Gevi ng moved to direct the Ci ty Engineer to repl ace the stakes. Motion seconded by Councilman Swenson. The following voted in favor: Acting Mayor Neveaux, Councilmen Pearson, Geving, and Swenson. No negative votes. Motion carried. RICHARD COMER, 3800 Red Cedar Point Drive 25-08-000-0201-000 Three additional units are proposed for a total of $16,433.59 including interest. Mr. Comer feels that his property does not front on a public street. It was noted that Kirkham Road is a dedicated right-of-way, although not built. KEN SMITH, 3837 Red Cedar Point Drive 25-08-000-0222-000 The proposal is to assess one additional unit in the amount of $6,349.90. Mr. Smith pointed out that sanitary sewer is not available to the property proposed to be assessed. MARGARET AND ROY LEACH, 3900 Red Cedar Point Drive 25-08-000-0205-000 I The proposal is to assess seven additional units in the amount of $38,563.06 including interest. Mr. Leach feels five units is more realistic. This would leave space for the existing creek and provide right-of-way for a circle drive from Minnewashta Parkway to Red Cedar Point Drive. CHARLES LAI-lSON, 6830 Minnewashta Parkway 25-05-000-0179-000 Four additional units are proposed for a total of $21,911.46 including interest. Mr. Lawson claims the width of his property is 396 feet. He feels the property can be divided into one additional unit because he has to leave enough right-of- way to serve property behind his. MARGARET CAMPBELL, 6810 Minnewashta Parkway 25-05-000-0176-000 The proposal is to add trunk sewer and water. The Engineer is recommending removal of this assessment as it has been assessed previously. Councilman Geving moved to remove the trunk unit as recommended by the City Engineer. Motion seconded by Councilman Swenson. The following voted in favor: Acting Mayor Neveaux, Councilmen Pearson, Geving, and Swenson. No negative votes. Mot i on carried. HOWARD VIKEN, 1150 Willow Creek 25-45-000-0001-000 I One additional unit is proposed for a total of $5,477.86 including interest. Due to the way the existing home is situated on the property and the tennis court, Mr. Vi ken feels there is not room for an additional unit. The area to the north of the existing home is very low and holds water after a rain. I I I Assessment Review Meeting March 24, 1980 -3- LEE ANDERSON, Part of Lot!2, Lot 3, Block 7, Pleasant Acres 25-57-500-0069-000 Property is proposed to be assessed sewer and water unit charges. These unit charges were paid when the building permit was issued. Councilman Geving moved to remove the unit charges from the assessment. Motion seconded by Councilman Pearson. The following voted in favor: Acting Mayor Neveaux, Councilmen Pearson, Geving, and Swenson. No negative votes. Motion carried. LEE ANDERSON, Lot 1 and part of Lot 2, Block 5, Pleasant Acres 25-57-500-0059-000 One additional unit is proposed in the amount of $5,946.32 plus one additional trunk sewer and water' in the 'amount of $1';017.'38" including interest. Mrs. Anclerson feels this property is only one buildable lot and the additional unit should be removed due to an access road to the church and a ravine. The City Attorney will check into the right-of-way easement along Lot 2 for access to the church. LINDA WISE, Lots 1 and 2, Block 4, Pleasant Acres 25-57-500-0045-000 One additional sewer and water trunk charge is proposed for Lot 2, Block 4. Feel they should not be assessed because a title search did not show them. LINDA WISE, Lot 13, Block 4, Pleasant Acres 25-57-500-0056-000 One additional sewer and water trunk charge is proposed. Feel they should not be assessed because a title search did not show them. AlVIN GELSCHUS, 3841 Church Road 25-71-000-0008-000 One additional sewer unit is proposed in the amount of $4,152.36. The Engineer recommended removal of the assessment because of the placement of the existing home. Councilman Swenson moved to delete the proposed'sewerassessment. Motion seconded by Councilman Geving. The following voted in favor: Acting Mayor Neveaux, Councilmen Pearson, Geving, and Swenson. No negative votes. Motion carried. WILLIS FRIBERG, 3851 Church Road 25-71-000-0009-000 One additional sewer unit is proposed in the amount of $3,716.34. The Engineer recommended removal of the assessment because of the placement of the existing home. Councilman Swenson moved to delete the proposed sewer assessment. Motion seconded by Councilman Geving. The following voted in favor: Acting Mayor Neveaux, Councilmen Pearson, Geving, and Swenson. No negative votes. Motion carried. CITY OF SHOREWOOD, Lot 5, Schmid1sAcres 25-71-000-0005-000 Five additional sewer units are proposed in the amount of $20,761.82 including interest. John Sanders, Attorney for the City of Sn'orewöodand Bill Keeler, Councilman for the City of Shorewood, were present. The City Attorney reques ted a copy of the deed on this piece of property to verify that the property can not be sold for anything other than public park purposes. It was generally agreed to assess the units and defer them for as long as it remains a park. Representatives of Shorewood requested a letter stating the Council IS final action. Assessment Review Meeting March 24, 1980 -4- KEN DURR, Minnewashta Parkway at Highway 7 25-05-000-0172-000 Four additional units are proposed for a total of $22,202.14 including interest. I Mr. Durr is requesting the number of proposed units be reduced to three and the assessment amount be reduced to reflect charges for sewer and water only, not street improvement. Councilman Swenson moved to adjourn. Motion seconded byCouncilrnan Pearson. The following voted in favor: Acting Mayor Neveaux, Councilmen Pearson, Geving, and Swenson. No negative votes.
