SPECIAL ASSESSMENT REVIEW COUNCIL MEETING APRIL 14, 1980
Mayor Hobbs/called the meeting to order at 8:00 p.m. with the following
members present: Councilmen Pearson, Neveaux, and Swenson. Councilman
Geving was absent. The meeting was chaired by Acting Mayor Neveaux.
JOSEPH MASSEE, 6381 Hazeltine Blvd.

Three additional sewer units and five additional water units are proposed
for a total of $19,956.64 including interest. Dr. Massee feels he
has two assessable lots plus the existing home due to the close proximity
of State Highway 41.
RUSSELL STODDART, 1611 West 63rd St.

Four additional units are proposed for a total of $21,911.46,including
interest. Mr. Stoddart feels there are three possible building sites.
DONALD BRANDT, 3801 Leslee Curve

One additional unit is proposed for a total of $5,477.86 including
interest. Due to the location of their home, the Brandt's feel they
do not have an additional lot.
FRANCIS MC GINN, 1800 Koehnen Circle

One additional unit is proposed for a total of $5,477.86 including
interest. The Council previously denied a request for subdivision
because of a lack of sufficient frontage for the newly created lot.
HERBERT CLASEN, 6351 Yosemite

One additional sewer and water lateral is proposed for a total of
$5,332.52 including interest. The Engineer recommended deletion of
the proposed unit because there is not enough square footage.
Councilman Pearson moved to delete the proposed assessment at the
April 28, 1980, meeting because of problems with engineering diagrams
and house location. Motion seconded by Councilman Swenson. The
following voted in favor: Mayor Hobbs, Councilmen Neveaux, Pearson,
and Swenson. No negative votes. Motion carried.
CHARLES KNOBLAUCH

Six additional units are proposed in the amount of $33,303.21 including
interest. Joe Knoblauch, representing Charles Knoblauch, was present.
Mr. Knoblauch feels his uncle should not be assessed for six additional
units as a portion of the property has water standing.
DONALD BASTIANSEN,

Four additional lateral units and five additional trunk units are
proposed in the amount of $22,928.84 including interest. The Bastiansen's
feel they should not be assessed because of the deep ravine along
Yosemite.

interest. Mr. Howard feels the terrain is not conducive to another
lot.

One sewer trunk unit is proposed in the amount of $465.09 including
interest. The Engineer recommended removal of the assessment because
of lack of an access.
Councilman Swenson moved to recommend 'removal of the proposed trunk
assessment at the April 28, 1980 meeting. Motion seconded by
Councilman Pearson. The following voted in favor: Mayor HObbs,
Councilmen Pearson, Neveaux, and Swenson. No negative votes.
Motion carried.
DERRICK LAND COMPANY

$12,990.49 including interest. No representatives of Derrick Land
Company were present. They have expressed concern about the number
of off line units.

Four additional units are proposed in the amount of $21,911.46
including interest. Mr. Mauer stated that his purchase agreement
states that only one dwelling can be placed on the property. Mr.
Mauer called the Council's attention to the drainage problem on
the southerly portion of the property.

This property was not assessed in 1973. The southern portion of the
property was assessed three units with the East Lotus Lake Project.
The Council asked for a map scaling out the East Lotus Lake units and
the proposed North Area units for the April 28 meeting.
V. C. WIRTZ, 1620 Koehnen Circle

One additional unit is proposed in the amount of $5,477.86 including
interest. Mr. Wirtz feels the property is not buildable due to
wetness. Council members requested a report from the Building
InspecDor for the April 28, 1980, meeting as to whether he would
issue a building permit on this property without granting variances.

One additional unit is proposed in the amount of $5,477.86 including
interest. Mrs. Headla feels that due to the R-IA zoning and the location
of the horse corral, the unit should not be assessed.
BILL NAEGELE, 3301 Shore Drive

One additional unit is proposed for a total of $6,349.90. The
Shoreland Management Act precludes an additional lot.
Councilman Swenson moved to recommend removal of the unit at the April
28, 1980, meeting. This is not a buildable site due to the Shoreland
Management Act. Motion seconded by Councilman Pearson. The following
voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, and Swenson.
No negative votes. Motion carried.
STEPHEN MC CORMICK
25-56-500-0009-000
Two lateral units and three trunk units are proposed for a, total of
~11,973.11 including interest. Dan Zeddies,Attorney, was present
representing Mr. McCormick. Mr. McCormick feels he should not be
assessed as there are no structures on the property. Mr. Zeddies
feels the value òf the property has not increased to warrant the
assessments.
ART BAKER/MORK
25-71-000-0001-000
Five sewer units and six water units are proposed for a total of
$29,848.48 including interest. Mr. Mork feels the property can be
divided into three buildable lots.
After the final decision is made on April 28, 1980, notices will be
sent to all property owners that appealed their assessments notifying
them of the Council's action.
JAMES LARKIN,

Two additional units are proposed for a total of $10,955.73 including
interest. The Engineer recommended removal of one unit.
APPRAISER: Councilman Neveaux moved to authorize the City Attorney to
hire an appraiser for the Stephen McCormick property not to exceed
$300.00. Motion seconded by Councilman Pearson. The following voted
in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, and Swenson. No
negative votes. Motion carried.
Mayor Hobbs chaired the remainder of the meeting.
BUILDING MORATORIUM ORDINANCE: Councilman Neveaux moved to approve
Ordinance 47K 6. Motion seconded by Councilman Pearson. The following
voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, and Swenson.
No negative votes. Motion carried.
1980 DISEASED TREE PROGRAM: Councilman Pearson moved to approve the 1980
Diseased Tree Program in line with the budgetary comments by the
City Manager. Motion seconded by Councilman Neveaux. The following
voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, and Swenson
No negative votes. Motion carried.

A decision on assessment of boulevard trees will be made at a
future meeting.
SANITARY SEWER AND WATER ORDINANCE: The city Manager presented an I
outline of proposed charges. The Assistant city Attorney will
prepare an ordinance for Council approval.
VOLUNTEER RECOGNITION WEEK:
RESOLUTION #80-10: Councilman Pearson moved the adoption of a
resolution proclaiDing volunteer recognition week. Resolution
seconded by Councilman Neveaux. The following voted in favor:
Mayor HObbs, Councilmen Pearson, Neveaux, and Swenson. No negative
votes. Motion carried.
HRA DOWNTOWN REDEVELOPMENT: Councilman Swenson requested that
VonKlug and Associates prepare a summary of procedures available
to the business people in Chanhassen.
Councilman Pearson moved to adjourn. Motion seconded by Councilman
Neveaux. The following voted in favor: Mayor Hobbs, Councilmen
Pearson, Neveaux, and Swenson. No negative votes. Meeting
adjourned at 12:20 a.m.
