1979 09 11 SPECIAL CHANHASSEN CITY COUNCIL MEETING SEPTEMBER 11 , 1979 I Mayor Hobbs called the meetin'g to order at 7:30 p.m. with the following members present: Council men Pearson· and ~1atthe\tJs. {ouncilmen Neveauxand Geving were absent. SIDE YARD SETBACK VARIANCE, 3725 SOUTH CEDAR - THOMAS HEIBERG: Mr. H.eibetg- is requesting a variance to construct an addition to his home at 3725 South Cedar. Councilman Pearson moved to grant the side yard setback variance, Planning Case P-637, to Thomas Heiberg. Motion seconded by Councilman Matthews. The following voted in favor: Mayor Hobbs, Councilmen Pearson and Matthews. No negative votes. Motion carried. The l. 2. 3. I 4. 5. PLAN AMENDMENT" PLANNED RESIDENTIAL DEVELOPMENT AND SUBDIVIS ION, LOTUS LAKE ESTATES I I AND III: B.-T. Land Company is proposing to develop an approximate 100 unit single family residential planned unit development on the eastern shore of Lotus Lake. The Park and Recreation Commission recommended that Outlot B be utilized for conservation/ pedes tri an/bi keway access to the park at the north end of the property, and that an easement for the pedestrian way be 61 and that additional easement be dedicated for maintenance purposes. The City Plànnerdiscussed his report dated September 7,1979. City Planner reconmended approval subject to the following contingencies : Tha t sufficient doC:Umentat·ion in lhe'áffirmative from the DNR regarding the us e of Outlot B for a pedestri an way be recei ved by the city offi ces. That an emergency access be~construeted"H·as a part of the overall public improvements of the development. . That the City Engineer verify in the final plans that the lowest floor elevation in the development be at an elevation of 900 feet or higher; in accordance with the Flood Plain Management Ordinance No. 68. That the applicant submit plans satisfying requirements no. 6 of the Engineer's report of August 15, 1979, and no. 1, 2, and 3 of the Watershed District's letter of June 6, 1979. That the applicant satisfy requirements 1, 2, and 3 of the planning report of August 20, 1979, with the exception that no. 3 be amended to requi re an emergency access in the vicinity of Lots 4-6, Block 2. Council members discussed the size of the lots including lot widths. Ri ck Murray: There probably are a hi gh percentage of our 11 ,600 square foot lots in the second addition is compensated for by the fact that so much of the property has been made available to public use, so much of it is being conserved. The DNR indicated that that center area should be a rearing pond. The watershed district concurred with them and that IS going to help control the run off into the lake. I don It have an answer why all the 11,600 square foot lots are in the second addition òther than the fact that that happens to·be our most level terrain. The easiest place for us to condense density for the areas where we have 19, 20, 23 or 24,000 square foot lots. The reason I submitted both plats was that the grading that we do along in the second phase is the filling that1s required in the third phase. That's why we felt it was mandatory that we make the Council aware of both phases. I Lot frontages and a second access road to the park property road or onto Chanhassen Road were discussed. B-T Land Company~has requested that the city install the improvements. Staff was instructed to meet with Bob Sander regarding this and other requests that have been made of the city for public improvements and report to the Counci 1. Council Meeting September 11 ,1979 -2- Councilman Pearson moved to table action on Lotus Lake Estates until staff feels it is ready to be resubmitted. Motion seconded by Counci 1man Matthews. The following voted in favor: Mayor Hobbs, Councilmen Pearson and Matthews. No negative votes. Motion carried. NORTH AREA ASSESSMENTS: Ray Jackson and Dale Campbell were present to review the revised maps reflecting deferred trunk and lateral sewer and water units. This was per the City Council IS action at the last work session asking that such maps be prepared so that the Council may more reasonably review individual lots as well as overall deferred assessments. Mr. Campbell had completed a summary of the overall number of deferred sewer and water units both on and off line, however, such had not been completed in time for the Manager to make an analysis of potential revenues whi ch may be generated by assessing one or more of these types of units. The Manager also noted that the number of units had been field checked to insure that the uni ts shown did not incl ude properties inundated by water, steep slopes or in otherwise genera llyunbui ldab 1 e. The effects of his calculations would reduce the total number of u~its; ~~wever, again the Manager had not completed an analysis of the financial impact. General discussion was held by the Council. An additional work session was set for September 24 to review the Manager's financial analysis of the revised data. I TROLLS GLEN FIRST ADDITION PUBLIC IMPROVEMENTS: Councilman Pearson moved that the public improvements completed in Trolls Glen First Addition be accepted by the City. This motion is conditioned upon the owner completing the three work items noted in the Engineerls field report of September 8, 1979. Motion seconded by Councilman Matthews. The following voted in favor: Mayor Hobbs, Councilmen Pearson and Matthews. No negative votes. Motion carried. I Councilman Matthews moved to adjourn. Motion seconded by Councilman Pearson.
