SPECIAL CHANHASSEN CITY COUNCIL MEETING - SEPTEMBER 24, 1979
Mayor Hobbs called :·the meeting to order at 8: 00 p.m. with the following
members present: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving and
Matthews.
APPROVAL OF AGENDA: The City Manager requested that the following item
be placed on the city council agenda: Change Order, North Lake Susan
Improvement Project. Councilman Pearson moved and êouncilman Geving
seconded a motion that the agenda be amended to include this item after
discussion of the proposed Highway 169/212 item. Ayes - All.
WESTERN HILLS THIRD ADDITION, HANSEN AND KLINGELHUTZ, PRELIMINARY
DEVELOPMENT PLAN APPROVAL .AND REQUEST FOR PUBLIC IMPROVEMENTS: The
following persons were present concerning this item: Mark Koegler,
Craig Mertz, Doug Hansen, Jim Hawks, Tom Klingelhutz, Rodney Gordon,
Ray Jackson, Jack Gill, Bob Waibel, Russell Larson and Don Ashworth.
The City Planner reviewed his report of September 24, 1979, including
recommendations of the Planning Commission and Park and Recreation
Commission. Following a presentation by Jim Hawks, representing
Hansen and Klingelhutz, the following general comments were made by
City Council members:
1). Phasing of the project would not be desirable unless necessary
(recognizes the potential inability to receive watershed
district approval for those lands draining to the Carver
Beach Creek unless ponding were to occur on the property or
improvement to the creek occurred).
2). In light of the above, the council agreed to discuss a
potential phase I which would generally encompass those
lands lying south and east of a proposed drainage line
(See exhibit "A" dated September 24, 1979). This area,
after grading is completed, would drain towards the Western
Hills pond. All of the following comments are in regards
to preliminary development plan approval for such Phase I
and does not include any approvals or considerations of
the remainder of the plan lying outside of Phase I except
as specifically noted below.
3). The Council generally expressed concern over smaller lots
on the north side of Maria.
4). If phasing were to occur
connection to Kerber Drive would
be necessary together with some form of agreement for dust
control during construction and permanent improvement if
final phase does not occur in a two year period.
5). Financing of Phase I can occur as a public improvement
project if guarantees can be established which will not
effect the city's bond rating. The developer was to check
as to the feasibility of such with final approval not being
considered until after receipt of a report from the city's
financial consultant as to the acceptability of such guarantees
and assurances that such would not harm the city's bond rating.

WESTERN HILLS III ADDITION, CONT: Councilman Pearson moved and Councilman
Neveaux seconded a motion that preliminary development plan approval
be given to Hansen and Klingelhutz for Phase I (those lands lying south
and east of the line shown in Exhibit "A" dated September 24, 1979)
upon the following conditions:

Lots on the north side of Maria be reduced from 9 to 8;
That any necessary approvals be received from the Watershed District;
That final engineering standards (prepared as a part of
preliminary plat consideration) reflect the feasibility of
public improvement construction, soil testing for streets,
drainage, and other standards set for such consideration;
That approval be on the condition that Kerber Drive be constructed
as a part of Phase I improvements with any necessary approvals
from the Watershed District in regards to construction of such;
Recommendations of the Planning Commission and Park Commission be
reflected as a part of preliminary plat approval;
That consideration of public financing be withheld until such
time as both the developer and city financial advisor have
reported to the city council.

NORTH SERVICE AREA SEWER AND WATER PROJECT 71-1, REVIEW ENGINEER'S SUM~~RY
REPORT: This item was tabled to October S, 1979.
PROPOSED HIGHWAY 169/212: This was a discussion item updating the City
Council as to the activities of the 212 Committee representatives from
Chanhassen and current status of discussions with other communities
affected by the proposed alignment. Copies of alternatives under con-
sideration by the committee were reviewed and established as official
exhibits.
1980 BUDGET: This was a work session item and, as such, no action was
taken by the City Council. The Manager generally reviewed proposed major
changes in revenue-expenditures including proposed uses of revenue sharing
funds.

NORTH LAKE SUSAN PUBLIC IMPROVE!1ENT PROJECT, AMEND CONTRACT: The City
Engineer's office reviewed a proposed contract amendment for this project.
Stabilization of sewer installation lines is not effective as recommended
by Braun Engineering. The Council generally discussed that they wish to
see a report from Braun Engineering explaining in further detail why the
failure appeared to be occurrin0. The Council further acted to accept the
engineer's report dated September 18, 1979. Motion by Councilman Matthews
and seconded by Councilman Pearson to approve the amended contract as
presented by the engineer in accordance with his recommendation. Ayes - All.
