REQUESTED ACTION
Approve Quit Claim Deeds with MnDOT for TH 101 and Pioneer Trail
Intersection Improvements.
DISCUSSION
MnDOT and Carver County are planning to reconstruct the intersection of TH
101 and Pioneer Trial during the summer of 2005. The reconstruction will
include widening the intersection to include turn lanes and installation of a signal.
An existing trail is currently located at the northwest corner of the intersection
that will need to be moved. MnDOT has purchased additional right-of-way from
two adjacent property owners for the intersection improvements and to
reconstruct the trial. Currently, the trial is in a trail easement that will be
eliminated by this Quit Claim Deed. A Limited Use Permit (LUP) will be drafted
to reconstruct the trail in its new location. The Limited Use Permit is consistent
with other LUP's the City has approved, most recently the trial improvements on
TH 41 constructed in 2004.
The City does not have any direct costs associated with the project, however, the
City will need to enter into a signal agreement with the County and State for
future maintenance of the signal.
The City attorney has reviewed the agreement.
At this time, staff recommends Council "Approve the Quit Claim Deed with
MnDOT for TH 101 and Pioneer Trail Intersection Improvements".

Temporary Easement:
A temporary easement for highway purposes as shown on said plat as to said
Parcel 26 by the temporary easement symbol, said easement shall cease on
December 1, 2010, or on such earlier date upon which the Commissioner of
Transportation determines by formal order that it is no longer needed for
highway purposes.
