SUBJ: Executive Search RFP's
Councilman Senn, Mayor Mancino, and I will be meeting Thursday morning to
discuss RFP's that have been received. The intent would be to reduce the number
of firms from seven or eight down to three to actually interview on November 4th.
Should any council member have a strong position on a particular firm that should
be included in the final interviews, please feel free to contact Nancy, Mark, or me.
I will call Councilmen Berquist, Mason, and Engel as to the results of the
recommended short list before I contact any of the firms. This will occur on either
Thursday or Friday.

SUBJ: Highway 212 Update
We had a good meeting with representatives ofMnDOT, Southwest Coalition
members, neighboring engineers, county representatives, etc. Councilman Senn
and Mayor Mancino both attended that meeting. The purpose of the meeting was
to attempt to determine if there was a means by which the Memorandum of
Understanding could be modified to meet the five concerns identified in the City
ofChanhassen's letter of September 30,1998 (attached). Potential solutions will
be put into writing by the attorney for the Southwest Coalition and will probably
be distributed within the next 30 days. In the meantime, hopefully, Nancy, Mark
and I can verbally update the council as to potential solutions on Monday evening.
We did set December 7th as the date that MnDOT representatives/engineering/
planning can start discussing the number of intersections, traffic volumes, design
elements, etc.

The City of Chanhasse!1 has given a great deal of thought. study and discussion to
the Memorandum of Understanding (MOD) forwarded by thc Southwest Corridor
Transportation Coalition. Although the MOU advocates action steps to accelerate
the desigI1 and construction of Highway 212. many issueS important to the City of
Chanhassen stiU remain unresolved. Until these issues can be resolved. the City is
unable to sign the proposed agreement in its current form.
Chanhassen has historically taken a responsible. well-planned approach to
development to preserve the character that our residents value. Highway 212 has
the potential to be one of the most disruptive and destrUctive public improvement
projects to take place in our community. Done properly. Highway 212 could be an
asset. If done incorrectly. it could divide our community.

Following are sol11e of the issues that have not been íesolved to our satisfactio!1,
Apart from these issues. it is important to note that Chanhassen does support the
future building of the Highway 212 transportation corridor.
1. If construction of Highway 212 proceeds in a series of stages, and results in a
temporary termination of the highway in Chanhassen. our e1dsting road
infrastructure is insufficient to cope with the additional traffic without
considerable i!1ve~tment and significant impact to our community. Since one of
the major arguments for 212 is that it will serve to pass traffic tlu'ough the
community. the entire length tlu'ough our city should be built at one time.
2. We need to look at the oveíal1 transportation needs on a regional level. The
Southwest Corridor Transportation Coalition is champiomng the completion of
Highway 212. but this is only one element in the broader context of regio!1al
transportation. We should start right now to coordinate these needs. Member
cities and counties should appoint representaÛ\'cs to work with MnDOT to
craft a well thought out comprehensive plan.
3. Major upgrading of Highway 494 must be funded in order to cope witJ1 the
i!1creased traffic a!1d congestion.

4. As MnDOT points out, this highway has been on the books for a long time. It
is highly likely that since this road was originaJly proposed. new approaches
and flew technology have become available for tranSPortation design, including
but not limited to. Light Rail Transport. advanced concepts in mass transit. and
new concepts in highway design theory. We would like come honest effort put
into looking at viable alternatives and enhancements to the current traditional
design. We don't want to see a "394-tike" highway dividing our city.
5. We would like to see a renewed commitment to public involvement.
Chanhassen believes that important issues that affect our city should be open
and accessible throughout the process. As pressure bui1ds to move forward
with aspects of 212 planning and right-of-way acquisition. we wil1 schedule
regular public input meetings to re-examine, re-study. and re-think how and
when to proceed and what the design and character should be.
In light of the above issues. the City of Chanhassen has taken the liberty of drafti.ng
and forwarding a MOU it would wholeheartedly support and sign.

MEMORANDUM OF UNDERSTANDING
THIS AGREEMENT. dated this _ day of . 1998. by the State of
Minnesota Department of Transportation ("MnDOT'). the Metropolitan Council ("Metro
CounciJ"'), the County of HelU1cpin ("Hennepin"), the County of Carver ("Carver"), the City of
Eden Pntirie ("Eden Prairie"), the City of Chanhassen ("Chanhassen"). the City of Chaska
("Chaska"). the Township ofChaska. ("Chaska Township"), the Township of Dahlgren
("Dahlgren Township"), and (insert any other governmental entities the new segments of the
transportation corridor passes through].
WHEREAS. the current 212 Corridor acquisitions are complete from Highway .194 west
to County Road 4 in Eden Prairie, funding is complete and construction is underway. with
scheduled completion of this segment in the year 2001: and
WHEREAS. Highway 5 improvements and upgrades to a four-lane road from County
Road 17 (Powers Boulevard) to Highway AI are funded and scheduled for construction and
completion by the year 2001; and
WHEREAS, the United States Congress has approved a demonstration grant in the
amount of $4,000.000.00 ("DEMONSTRA nON GRANT FU~TIS") to MnOOT for the
Highway 212 project through re-authorization of the Intermodal Swface Transportation
Efficiency Act (ISTEA) effective June 6. 1998: and
WHEREAS. the Right-of-Way Acquisition Loan Funds C'RALF') have been used for and
will continue to be used for acquisition of the Highway 212 corridor. however. knowing that such
funding will be unable to fund completion of right-of.way acquisition for Highway 212 in the
foreseeable future; and

WHEREAS. all the parties to this agreement remain committed to continued advocacy for
planning and construction of the 2 2 conidor under terms and conditions acceptable to each of
the parties; and
WHEREAS. the parties hereto. while recognizing it is in their mutual best interests to
agree to priorities going forward. understand that there are numerous issues to be studied and
resolved with full public participation.
NOW. TIlEREFORE. in consideration of the premises and their mutual best interests. the
patties hereto hereby agree as follows:
1) The construction of212 should be completed westerly to County Road 4 as the
City of Eden Prairie has desired.
2) The acquisition of 2 2 Corridor right-of-way should continue. fully utilizing the
DEMONSTRA nON GRANT FUNDS and avajab1e RALF. only acquiring properties deemed
necessaty by mutual agreement between MnDOT and the respective governmental entities in
which said acquisitions reside.
3) In that funds are not available in the foreseeable future to construct the balance of
212 in its entirety. and construction should not proceed further until there is sufficient committed
funding to upgrade Highway 494 to accommodate the additional traffic, and the needed
infrasttucture in the affected communities can be put in place to handle the projected additional
traffic volumes:
a) In Chanhassen. where existing road infrastructure is insufficient to handle
the increased traffic levels if 212 terminates there temporarily. 212 should be constructed
completely through the community in a single phase.

b) In the iJ1terim. the Right-of-Way should be left in passive park use with
potential temporary trail construction if funds can be gathered to accomplish such.
c) Re-study should begin immediately to fe·examine the appropriateness of
the older traditional highway concepts and thorough examination of identifying and planning for
implementation of new transportation concepts favoring mass transit. highway parkway similar to
Highway 62. and other appropriate concepts such as light rail. etc. should commence.
d) Prior to intersection acquisitions. MoDOT and the affected municipalities
shall mutually agree on the appropriateness and design of the current proposed intersections.

The enclosed draft has been reviewed by representatives of the local units of government. We
are proceeding with submission of the proposed agreement to the Metropolitan Council and the
local units for their approval. .

government of the State of Mi!lI\esota ("METRO COUNCIL"), the County of Hennepin, a
political subdivision of the State of Minnesota ("HENNEP~"), the County of Carver, a political
subdivision of the State of Minnesota ("CARVER"), the City of Eden Prairie, a Minnesota
municipal corporation ("EDEN PRAIRIE"), the City of Chanhassen, a Mi!lI\esota municipal

("CHASKA") and the Southwest Corridor Transportation Coalitioo, a non-profit corporation under
the laws of the State of Minnesota ("COALITION").
I. RECtT ALS:
1.01. Construction of an 1 g mile four-lane, divided freeway from 1-494 in Eden Prairie
to Norwood ("New Highway 212 Project") is of state-wide significance in that there are no
existing four-lane highways serving the southwestern portiòn of the State between U.S. Highway
169 serving Mankato and 1-94 serving St. Cloud.
1.02. New Highway 212 Project is part of the National Highway System.
1.03. There has previously been $10.9 million of federal demonstration grant funds
invested in the New T.H. 212 project.

1.04. Although the contract for construction of the first phase of the New T.H. 212
Project was let on February 27, 1998, due to lack of sufficient funds, the 20-year program of
MnDOT only contemplates constructiQn of the portion of the project lying easterly of Lyman
Boulevard in Chanhassen and the program of the Metropolitan Council does not contemplate
construction of anything west of Eden Prairie Road in Ederi Prairie prior to the year 2020;

1.06. Land values in the New T.H. 212 Corridor are escalating dramatically.
1.07. There has already been more than $105 miJIion invested or committed to
construction of the New 212 Project, including (a) approximately $50 million invested in
purchase of right-of-way, design, planning. and other related expenditures for the New 212
project (principally by MnDOT or through use of RALF funds); and (b) the cost of construction
of Segment I, Stages 1 through 3. which is currently estimated to be approximately $55 million,
1.08. The New T.H. 212 Corridor has been preserved on the offic:ial maps of the
affected communities since 1988.
1.09. In most areas the New 212 Corridor is surrounded by developed or developing
land.

Sec. 20-909. Outdoor storage.
As otherwise regulated, all outdoor storage is prohibited except:
(1) Clothes line poles and wires.
(2) Construction and landscaping material currently being used on the premises.
(3) Swings, slides and other play equipment.
(4) Outdoor furniture and lawn and garden equipment.
(5) Wood for burning in a fireplace, stove or furnace provided it is stored as follows:
a. In a neat and secure stack, not exceeding four (4) feet.

(6\ Continued storage of boats, all-terrain vehicles and snowmobiles may be stored in the
side or rear yard behind the required front setback.

Sec. 2()'910. Storage of recreation vehicles.
Recreational vehicles may be parked or stored in a residential or agricultural district
provided the following conditions are met:
(1) No more than one (1) recreational vehicle may be parked or stored outside on a
residential lot. Additional recreational vehicles may be kept within 1i11 enclosed
structure which otherwise conforms to the zoning requirements of the district.
(2) Recreational vehicles must be maintained in a clean, well.kept, operable condition.
(3) Rtcreational vehicles shall be mobile and shall not be permanently affixed in the
ground in a manner that would prevent removal.
(4) Recreational vehicles may be parked or stored only on the rear or side yard behind
the required front yard setback. Tht parking or storage of recreational vehiclts on
the rear or side yard, as permitted herein, may be on surfaced or unsurfaced areas.
(5) Recreational vehicles may be stored on a lot without regard to the location on the lot
for the sole and express purpose of loading and unloading for a period not to exceed
twenty·four (24) hours.
(6) Unmounted slide·in pickup campers must be stored no higher than twenty (20) inches
above the ground and must be securely supported at least at four (4) corners by solid
support blocks or support mechanisms.
(7) Recreational vehicles may not be occupied or used for living, sleeping or housekeep·
ing purposes, for not more than seven (7) consecutive days.
(8) Except for routine maintenance or during emergency conditions when power supply
is disrupted, the operation of a recreational vehicle power generator plant shall not
be permitted in residential districts. Routine maintenance periods shall not exceed
sixty (60) minutes per month.

An accessory fuel storage tank is permitted in any zoning district. Fuel storage tanks
