SPECIAL CHANHASSEN CITY COUNCIL MEETING APRIL 10, 1978
Mayor Hobbs called the meeting to order at 7:30 p.m. with the following
members present: Councilmen Pearson, Neveaux, Waritz, and Geving.
DRAINAGE REPORT, COLONIAL GROVE DRAINAGE ACROSS KURVERS PROPERTY: The
City ~lanager presented the staff report on this item and noted that the
culvert poten-tially draining the pond in Colonial Grove to the Kurvers
property has been sealed. Franklin, Melvin, and Myrna Kurvers were
present to discuss this item with the City Council. The City Council
asked the Engineer to complete minor restoration on the Kurvers property,
to review drainage at Cheyenne and Highway 101, and to review progress
on this item on June 5th (assuming no property damage occurs prior to
June 5th).
NORTH AREA DEBT ANALYSIS AND DEBT REFINANCE PROPOSAL: Various reports
from the Fiscal Agent, City Engineer and City Manager were reviewed by
the City Council. No action was taken except to encourage the Fiscal
Agent to proceed with the debt refinance proposal. If current projections
are correct, the city should be able to save approximately $250,000
through consolidating several existing debt bond issues into one refinance
issue sold at a lower interest rate than existing bonds. Re-assessing
the North Service Area for lateral sewer and water benefits was
recommended by the City Manager. Notification to property owners
concerning this assessment would be anticipated later this fall or early
,in 1979 with proposed assessments occurring in 1980 for collection in
1981. General concurrence with the staff report was given. No
specific action was taken concerning re-assessing the North Service Area -
such to be a part of final consideration on the refinance bond issue.
INDUSTRIAL REVENUE BOND CRITERIA: The City Council reviewed potential
criteria for considering the sale of industrial revenue bonds for
commercial and industrial expansions or new developments in the city.
As primarily a work session to review criteria with the Fiscal Agent,
no specific action was taken.
1978 PLANNING WORK PROGRAM: The work program of the Planning Department
was reviewed with the City Council. No action was taken.
DISEASED TREE PROGRAM, 1978: The City Manager presented salient features
of the 1978 recommended Diseased Tree Program - such including:
a). Establishment of Specifications for Diseased Tree Removal with
award of bids to the lowest responsible bidder;
b). Property owners will have the option to remove diseased trees
marked by the City Forester within ten days after notification;
c). Failure to remove the tree within the ten day period will cause
for the city to have the tree removed by the city's contractor. If the
city's contractor removes the tree, 50% of the cost of removal and
disposal will be paid by the city;
d). The City shall have the right to assess property owners not
paying 50% of the cost of removal and disposal. Procedures for assessing
costs of tree removal and disposal were not set - such to be considered
as a part of the special assessment public hearing anticipated to be
held on or about September 1 of 1978.
Councilman Neveaux moved to ~ndorse the Diseased Tree Program as
recommended by the City Manager with the exception of limiting the proposed
Diseased Tree Control Area (Official Map) to only include those properties -
within 300 feet of an existing home site in or adjacent to an existing
R-l or R-2 Residential District (as shown on the official Zoning Map) .

Motion seconded by Councilman Pearson. The following voted in favor:
Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No
negative votes. Motion carried.
Councilman Geving moved to adjourn. Motion seconded by Councilman
Waritz. The following voted in favor: Mayor Hobbs, Councilmen
Pearson, Neveaux, Waritz, and Geving. No negative votes. Meeting
adjourned at 12:05 a.m.
