REGULAR CHANHASSEN CITY COUNCIL MEETING MAY 15, 1978
Mayor Hobbs called the meeting to order at 8:00 p.m. with the following
members present: Councilmen Pearson, Neveaux, Waritz, and Geving. The
meeting was opened with the Pledge to the Flag.
APPROVAL OF AGENDA: Councilman Pearson moved to approve the a~enda
with two additions: Recreational Vehicle Ordinance and Parking and
ticketing in the area of'Chanhassen Elementary during school functions.
Motion seconded by Councilman Neveaux. The following voted in favor:
Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No
negative votes. Motion carried.
TENNIS COURT LIGHTING BIDS: Councilman Neveaux moved to accept the
staff recommendation and award the bid to Ridgedale Electric in the
amount of $4,365.00 with the contractor required to enter into a
contract for the project on or before June 1, 1978. Motion seconded
by Councilman Geving. The following voted in favor: Mayor Hobbs,
Councilmen Pearson, Neveaux, Waritz, and Geving. No negative votes.
Motion carried.
MINUTES: Councilman Pearson moved to approve the May 1, 1978, City
Council minutes. Motion seconded by Councilman Waritz. The following
voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and
Geving. No negative votes. Motion carried.
Councilman Geving moved to note the April 26, 1978, Planning Commission
minutes. Motion seconded by Councilman Neveaux. The following voted
in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving.
No negative votes. Motion carried.
Councilman Pearson moved to note the April 24, 1978, Ecological
Committee minutes. Motion seconded by Councilman Neveaux. The following
voted in favor: Mayor Hobbs, Councilmen Neveaux, Pearson, Gevinf" and
Waritz. No negative votes. Motion carried.
BILLS: Councilman Geving moved to approve the bills dated May 15, 1978,
as presented. Motion seconded by Councilman Pearson. The followinf,
voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and
Geving. No negative votes. Motion carried.
POSTAL ADDRESSES: The city received a letter from M. E. Layer, MSC
Manager/Postmaster, stating the National Postal policy prohibits change
of existing delivery zip code boundaries solely to coincide with
political or incorporated village limits. The Council authorized
Mayor Hobbs to contact Federal Legislators seeking their support to
establish one postal address for Chanhassen residents.
HIGHWAY 494 SIGN -liTO CHANHASSEN" The City has not received a written
response from MnDOT regarding the installation of directional signs
to Chanhassen on 1-494. Mayor Hobbs will contact State Legislators
concerning this request.
DEVELOPMENT CRITERIA FOR DOWNTOWN CHANHASSEN, BUILDING MORATORIUM
ORDINANCE - HRA: Herb Bloomberg, John Huber, Mr. and Mrs. Bernard
Schneider, Charles Towle, Sharon Heimerl, and Mr. and Mrs. Dean
Wallentine were present. The purpose of the proposed ordinance is
to prohibit development that is not in conformance with the development
criteria and plan. _ Staff recommended approval with an expiration date
of December 31, 1978. Charles Towle read a letter requesting the

exclude his property (Chanhassen Industrial Park) from the
moratorium. Mr. Towle will furnish the City with a copy of his
request.
Councilman Neveaux moved to approve Ordinance 47-K with amendment
to section 5 moving the date from December 31, 1978, to June 30,
1978. Motion seconded by Councilman Geving. The following voted
in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and
Geving. No negative votes. l1otion carried.
Staff will review the ordinance as adopted and any correspondence
received in its relationship to the ordinance.
ROBERT REICHERT: Mr. Reichert was present requesting the city
replace a mulberry tree that was removed during sewer construction
on his property.
DICK MATTHEWS - MINNEGASCO: Minnegasco did some digging in Cheyenne
Avenue near Cheyenne Spur to repair a gas leak. City Staff will
remind Minnegasco to repair the street.

'WATER SKI SLALOM COURSE, LOTUS LAKE: Lance Fisher has petitioned
the city for permission to install a water ski slalom cöurse in
Lotus Lake. A petition, signed by approximately 185 property owners,
was received objecting to the water ski course because of the size
of Lotus Lake and possible dangers involved.
Councilman Pearson moved to deny the reqùest for a water ski slalom I
course. Motion seconded by Councilman Geving. The following voted
in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and
Geving. No negative votes. Motion carried.
BUILDING USAGE REQUEST, CHANHASSEN FIRE DEPARTMENT: Fire Chief,
Jack Kreger, requested that the meeting room be available every
Monday night for fire department training drills and meetings.
Councilman Neveaux moved to refer this to the Community Facilities
Study Committee with a recommendation back to the Council by July
3, 1978. Motion seconded by Councilman Geving. The following voted
in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and
Waritz. No negative votes. Motion carried.
LOT AREA VARIANCE REQUEST - LEWIS WOITALLA: Mr. Woitalla is requesting
a lot area variance to construct a home on Lots 1656, 1657, 1658,
1659, and 1660, Carver Beach. The lot is 8,918 square feet.
Councilman Neveaux moved to table action until ~1ay 22, 1978, to
give Mr. Woitalla time to contact the owner of Lots 1661 - 1665
to try to negotiate purchasing these lots as the area is also not
large enough for a home. Motion seconded by Councilman Geving.
The following voted in favor: Mayor Hobbs, Councilmen Pearson,
Neveaux, Waritz, and Geving. No negative votes. Motion carried.
TONKA LANDSCAPING: Tonka Landscaping, located on the north side
of Highway 7 across from Minnewashta Heights, has been sold. The
new owner has applied for a conditional use permit and will be
before the Planning Commission.

PARKING IN THE AREA OF CHANHASSEN ELEMENTARY DURING SCHOOL FUNCTIONS:
No Parking signs were installed along a portion of Laredo Drive dúring
the time the Fun Fair was held at the elementary school. This was
done to insure that the emergency vehicles could leave the fire
station. It was decided to discuss the problem with the Principal,
Fire Chief, and Police Officers to find a solution.
CONSENT AGENDA: Mayor Hobbs asked if any council member wished to
discuss any item on the consent agenda. As no member questioned any
items, Councilman Pearson moved to accept the consent agenda as
recommended by the City Manager.
a. Kennel License Requirements - Ordinance amendment.
b. Ecological Committee Appointment - Pat Swenson.
c. Retirement Benefit Deduction - CETA Employees. Resolution 78-25
d. City Council Donation - Bruce Pankonin.
e. Set Public Hearing Date for vacation of a portion of Lake
Riley Blvd. - June 19, 1978.
f. Sewer Television Contract.
Motion seconded by Councilman Waritz~ The following voted in favor:
Mayor Hobbs,Councilmen Pearson, Neveaux, Waritz, and Geving. No
negative votes. Motion carried.
ARBOR CELEBRATION: Mayor Hobbs proclaimed that Chanhassen is
participating in Minnesota's Arbor Celebration. The City is involved
in replanting trees where diseased elm trees have had to be removed.
Mayor Hobbs strongly urged the citizens of Chanhassen to do the same
to reforest the community for their children.
Councilman Geving moved to adjourn. Motion seconded by Councilman
Pearson. The following voted in favor: Mayor Hobbs, Councilmen Neveaux,
Pearson, Geving, and Waritz. No negative votes. Meeting adjourned
at 11:30 p.m.
