SPECIAL CHANHASSEN CITY COUNCIL MEETING MAY 22, 1978
Mayor Hobbs called the meeting to order at 8:00 p.m. with the following
members present: Councilmen Pearson, Neveaux, Geving, and Waritz.
PROPERTY ASSESSMENT POLICY: Jim Fiebelkorn and Margaret Julius were
present. The Council reviewed the city's legal authority as a Board
of Equalization and Review as well as reviewed specific assessment
policies under the State Law and compared property assessments in
Chanhassen with other properties in Carver County. The Board of
Equalization and Review public hearing will be held June 8th at 8:00
p.m. in the Council Chambers.
LOT AREA VARIANCE, LEWIS WOITALLA: Mr. Woitalla has withdrawn his
request for variance as he has purchased the adjoining property on
Mandan in Carver Beach and a variance is no longer needed. No action
was taken.
CERMAK SALES - NON-CONFORMING USE: The Assistant City Attorney reviewed
the status of Cermak Sales on Highway 7. The Council requested the
Building Inspector compare present usage of the property to previous
years, i.e. comparison of current photos to previous photos and
coordination with the attorney's office in obtaining testimony from
property owners in the area. The Tree Inspector will review the site
for alleged violations of storage of diseased trees. The Council
discussed requesting a representative of the Minnesota Department of
Health look at the outside storage from the standpoint of a health
hazard. The Council requested a report from staff as to what can or
cannot be done with the situation as it exists todày.
Councilman Neveaux suggested that aerial photos were taken with the
north area sewer project and perhaps they would show how the property
was used.
TECHNIGALSERVICE AGREEMENT: The Council reviewed various positions
as approved in the 1978 budget including personnel reviews in planning
and public works.
Councilman Pearson moved to create a position of Laborer in the Street
Maintenance Department and authorize the City Manager to fill this
position at a Laborer's classification on the metropolitan salary
survey. Motion seconded by Councilman Waritz. The following voted in
favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving.
No negative votes. Motion carried.
PARK DONATION - RANDOLPH HERMAN: The Council discussed the Manager's
report and Councilman Pearson moved the adoption of resolution #78-26
accepting the Herman offer as submitted with the addendum (as modified)
as attached to the Manager's report of May 22, 1978. Resolution
seconded by Councilman Neveaux. The following voted in favor: Mayor
Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No negative
votes. Motion carried.
Councilman Waritz moved to name the property after Mr. Randolph Herman
and call it Herman Park if this is acceptable to Mr. Herman. Motion
seconded by Councilman Geving. The following voted in favor: Mayor
Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No negative
votes. Motion carried.
In discussing the item, Mayor Hobbs requested staff to work with
Council Meeting May 22, 1978

Mr. Herman to establish some type of official process or ceremony
by which the City Council could officially accept and thank Mr. Herman
for his gift to the City.
PLANNING CONSIDERATION: The Planning Commission has requested that
Bruce Pankonin be hired to work with the Assistant City Planner and
complete the Comprehensive City Plan. Bruce Pankonin presented a
contract for professional services to the Council. Staff recommended
that the City enter into the contract with Bruce Pankonin for
the technical services and during that period of time he will
carry out the functions noted in the contract. Staff will be working
on a specific contract for the completion of the City Plan.
Councilman Neveaux moved to approve the contract for professional
services for Bruce Pankonin for a period of 60 days based on a
contract that is in agreement with both Mr. Pankonin and the City.
Motion seconded by Councilman Pearson. The following voted in
favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving.
.No negative votes. Motion carried.
Councilman Neveaux moved to adjourn. Motion seconded by Councilman
Waritz. The following voted in favor: Mayor Hobbs, Councilmen
Pearson, Neveaux, Waritz, and Geving. No negative votes. Meeting.
