All of the public street and utility improvements have been installed under previous phases (Springfield 2"~ Addition). The replat of Outlot D, Springfield 2nd Addition into Springfield 6th Addition results in the necessity to amend the Development Contract/PUD Agreement for Springfield 2nd Addition to include the new plat. It is therefore recommended that the attached Addendum B to the Springfield 2~a Addition Development Contract/PUD Agreement be approved conditioned upon the developer entering into Addendum B and supplying the City with administration fees in the amount of $5,128.50. CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ADDENDUM "B" TO SPRINGFIELD 2ND ADDITION DEVELOPMENT CONTRACT/PUD AGREEMENT SPECIAL PROVISIONS AGREEMENT dated March 22, 1999, by and between the CITY OF CHANHASSEN, a Minnesota municipal corporation ("City"), and LUNDGREN BROS. CONSTRUCTION, INC., a Minnesota corporation (the "Developer"). 1. BACKGROUND. The parties have previously entered into a development contract/PUD agreement for Springfield 2nd Addition dated March 23, 1998 (the "Development Contract") and Addendum A to the Development Contract dated July 27, 1998. The Development Contract was recorded on April 20, 1998 as Carver County Abstract Document No. 225681 and on April 20, 1998 as Carver County Torrens Document No. T101262. Addendum A was recorded on November 19, 1998 as Carver County Abstract Document No. 238723 and as Carver County Torrens Document No. T105218. The developer is now replatting Outlot D, Springfield 2nd Addition into Springfield 6th Addition. 2. EXTENSION OF DEVELOPMENT CONTRACT. The Development Contract shah remain in full force and effect with the modifications listed in the special conditions below. 3. SPECIAL CONDITIONS. In addition to the terms and conditions outlined in the development contract/PUD agreement, the following amendments shall apply: A. In lieu of park dedication requirements, the developer is required to repay to the city a pro rata portion of the purchase price plus accrued interest from the date the city purchased the approximately 2.7 acres, April 10, 1998, to the date of repayment by the developer at a rate of 8 percent per annum. The pro rata share for Springfield 6th Addition is five (5) percent of the purchase price plus accrued interest which equals $2,263.30 in principal plus interest at $0.65 per day from 4/10/98 to the date of payment of the administrative fees. B. The developer shall enter into an Addendum B to the Development Contract/PUD Agreement for Springfield 2na Addition with the city and pay an administration fee in the amount of $5,128.50. C. The proposed single family residential development of 0.842 developable acres is responsible for a water quality connection charge of $672.00 and a water quantity fee of $1,663.20. The water quality fee will be waived upon the applicant meeting NURP design for on site runoff. The water quantity fees of $1,663.20 are payable to the city prior to the city filing the final plat. D. All'disturbed areas during site grading shall be immediately restored with seed and disc mulch or wood fiber blanket within two weeks after site grading or before November 15 each construction season accept in areas where utilities and street will be constructed yet that year. All disturbed areas resulting from construction activities shall be restored in accordance to the City's Best Management Practice Handbook for erosion and sediment control. E. A declaration that the fields in Bandimere Community park will be lighted shall be included in the chain of title for lots within the subdivision. F. The final plat mylars shall reflect Springfield 6th Addition on the County Treasurer's signature line. 4. RECORDING. The Development Contract and this Addendum "B" shall be recorded against all lots and blocks in Springfield 6th Addition. 2 IN WITNESS WHEREOF this Addendum "B" was executed by the parties the day and year first above written.
