Highway 101 Update - Project No. 97-12
The City Council has indicated their desire to construct a trail along Highway 101
as soon as possible. This trail would be constructed separately from the proposed
Highway 101 reconstruction project which currently is programmed for 2004
tumback funding. However, questions regarding use of what is now MnDOT
right-of-way slated to become Carver County right-of-way with the jurisdictional
tumback of Highway 101 and the jurisdictional agencies' willingness to allow
construction of a trail prior to the Highway 101 roadway reconstruction project
need to be answered. Additionally, in question is the commitment of funding for
the Highway 101 reconstruction project by MnDOT for 2004.
The jurisdictional authorities' willingness to allow construction of any
improvements within the Highway 101 right-of-way is unlikely due to the pending
road construction project. However, any permit for use of Highway 101 right-of-
way would not be considered until such time as plans and specifications are
complete and available for the jurisdictional agencies' review. However, based
upon my understanding of the issues regarding the tumback of Highway 101 and
proposed reconstruction project, I believe it is unlikely that such a permit would
be issued unless the proposed trail were to be constructed in such a manner as to
provide for the future roadway project. Obviously, the City could challenge the
jurisdictional authorities' right to restrict construction of a trail in the right-of-way
and Mr. Roger Knutson will be providing the Council additional information
regarding the legal implications of such an action. This legal opinion will be
emailed to Council members on Friday, December 17, 1999.
I have spoken with Mr. Bob Brown, MnDOT Metro Division State Aid Engineer,
regarding the difficulties in proceeding with the Highway 101 project process
without having a commitment as to when funding will be available from MnDOT
for this project. Mr. Brown stated as did Jim Grube at the work session on
December 6, 1999, that although this project is slated for 2004, additional
tumback funding has become available in the 8-county metro area for 2002, 2003
and 2004 in the amounts of$5 million, $12 million and $15 million, respectively.
MnDOT and the Metro County Transportation Representatives will be meeting to
discuss and prioritize what projects this additional funding will be dedicated to.
Additionally, Mr. Brown informed me that his office is in the process of preparing
a five-year CIP for tumback projects which is anticipated to be completed by mid
February. This is significant as previously MnDOT was not able to prepare a five-

year CIP which commits funding for specific projects. Mr. Brown indicated
MnDOT is willing to enter into an agreement with the agencies involved for
funding for the Highway 101 construction project in 2002 and 2003 pending the
project receiving favorable ranking in the prioritization of the additional funding
by the Metro Transportation Representatives and approval ofthe five-year CIP in
February. Such an agreement based on the current timeline for preparation of the
five-year CIP could be available for the counties to review in March of 2000.
Therefore, it is likely that by fall of 2000 the agreement could be fully executed.
The commitment of funding in MnDOT's five-year CIP which is expected to be
completed by mid February for the Highway 101 reconstruction project in 2002
and 2003 and subsequent agreement which MnDOT has expressed an interest in
entering into with the agencies involved guaranteeing this funding for those years
is a significant goal to work towards. However, in the interim it is important to
continue with the public process for the Highway 101 reconstruction project in
order to assure adequate time is allowed for public involvement, environmental
studies, and preparation of plans and specifications to deliver a construction
project in 2002. The commitment of funding in 2002 will require an agreement
on behalf of all agencies to proceed with construction of a project in 2002 as there
are other projects competing for funding.

Highway 101 Work Session Minutes from December 6, 1999
The discussion regarding the Highway 101 improvement project began with the
City Engineer providing Council members with preliminary cost estimates for
construction of a trail along Highway 101. These cost estimates depicted the total
City cost for a trail constructed within the existing right-of-way of $750,000, a
trail which would accommodate a future Highway 101 roadway reconstruction
project at a cost of$2,615,000, and for the construction of the trail with the
tumback roadway reconstruction project at no cost to the City. Staff was directed
to verify whether or not tumback funding would cover the entire cost of the trail.
Roger Gustafson, Carver County Public Works Director, provided the City
Council with information regarding Carver County's plans for the 101 corridor as
a regional trail. Mr. Gustafson further communicated the tumback agreement
status with the Minnesota Department of Transportation has been limited to the
segment of Highway 101 north of Highway 5 for purposes of moving a project
forward for this segment. Negotiations for a tumback agreement for Highway 101
south of Highway 5 will occur separately. It was communicated that approval of
the tumback agreement by MnDOT and Carver County would likely occur upon
concept approval of a roadway section by the four agencies involved.
Jim Grube, Hennepin County Transportation Director, provided an update on the
tumback funding for this project. Currently, this project is slated for 2004;
however, since the legislature ultimately sets funding levels for all transportation
projects funded through the State of Minnesota, this date can not be assured until
the Minnesota state budget is approved. Mr. Grube informed the Council that in
the eight-county metro area additional funding has become available for 2002,
2003 and 2004 in the amounts of$5 million, $12 million and $15 million,
respectively. The metro county transportation representatives will be meeting to
discuss and prioritize what projects this additional funding should be utilized on.
In response to the question of what if a tumback agreement does not occur with
Carver County for transferring jurisdictional authority for the road from MnDOT
to the County, Mr. Grube indicated that MnDOT would likely rescind the
Hennepin County tumback agreement and Highway 101 would remain a
temporary trunk highway under the jurisdiction of the Minnesota Department of
Transportation. Councilman Senn presented a "what if' scenario in which a

County and resurfacing of the roadway were to occur with the City constructing a
trail. Councilman Senn was asked to provide specifics of this scenario in written
form for future Council discussion.
Mayor Mancino expressed a concern regarding the Highway 101 memorandum
responding to issues regarding the response to question number 13 on noise
mitigation requirements. No other specific concerns were expressed by Council
members regarding this memorandum.
The project management team requested Concepts 1, 5 and 6 be eliminated from
further consideration as viable options. It was requested that direction be
provided to present Concepts 2, 3 and 4 at the neighborhood meetings. However,
after a significant amount of discussion, Council provided direction that when
neighborhood meetings occur they would like to include Concepts 1,2,3 and 4 as
concepts and eliminate Concepts 5 and 6 from further consideration.
Additionally, Council members indicated a desire to hold a joint work session
with Eden Prairie City Council members upon completion of the neighborhood
meetings to discuss/express issues and concerns of both Councils regarding
Highway 101.
The City Council is currently considering its options for construction of a trail
along Highway 101 prior to 2004. Council has indicated a desire to prepare a
feasibility study for construction of a trail (minimum impact and at the far limits
of the right of way). However, prior to making that decision, staff was directed to
provide Council members more information regarding the jurisdictional
authorities' willingness to permit the construction of a trail in the existing
Highway 101 right of way. Much of the discussion focused on construction of a
trail prior to roadway construction and what such a trail might look like. The need
to address the poor condition of the roadway surface was recognized by Council
members. Ultimately, Council expressed a desire to delay neighborhood meetings
until the legal questions regarding construction of a trail prior to the road project
are answered.
