At the start of session, the governor recom- mended a $402 million bonding bill, and instructed the Legislature that any bonding in excess of that amount or project of local nature would be vetoed. Tort limits at risk? Some folks at the Legislature are toying with the idea of eliminating municipal tort liability limits. The idea has emerged as the joint and several liability bill has received favorable legislative support. Without tort caps, cities will be at risk for exposure to unlimited damage awards. These costs would likely be passed on to property tax payers, and I1sky municipal services like police, fire, and parks and recreation would be compromised or discontinued. Small cities may look to bankruptcy In order to seek refuge 1rom colossal and financially debilitating decisions. Please mention to your legislators that tort caps are necessary for local governmentS to continue those services that are Inherently dangerous and often required by law. Ask them to oppose any amendmentS to remove our caps. Election training rules City officials are urged to read rules regarding election official and election judge training proposed by Secretary of State Mary Kiffmeyer. Those rules, published in the March 13 Issue of the State Regis- ter (Vol. 24, Issue 37, pp. 1278- 1288), were developed with the assistance of an advisory commit- tee of city, school, township, and county etection officials. LMC Election Task Force members who have reviewed the proposals suggest that election officials in smaller cities may want to pay close anention to additional. formal training that would be required beginning this year for local elec- tion administrators and head (chief) precinct election judges. Dear Mr. Kowski: I am writing to you at this time to relay to you the City and City Council's concern over the progress of moving the above-referenced project into construction this year. As you are aware, the project has already been delayed one construction season in order to incorporate several intersection revisions, and we are quickly approaching a point at which we will begin to lose this year's construction also. Therefore, we are requesting that Mn/DOT, along with the City of Shore wood, work closely together to help expedite the remaining items in order to provide adequate time yet this year to complete the construction of this intersection. The major item that is on the critical path to achieve our goal is the acquisition of the construction easements for this project. As you are aware, all of the easement appraisal work has been completed and forwarded to Mn/DOT for your review and acceptance. The City is reluctant to approve and make offers to the individual parcels until they receive confinuation from Mn/DOT that the right-of-way values are acceptable and that the cost will be reimbursed to the City of Shore wood. Mn/DOT should be aware that the City of Shorewood is not a large metropolitan community and that their financial resources are limited. Therefore, it is important that the easement costs, along with the investment that they have made into the project to date, be expedited to help ease the financial burden on the City also. The City is prepared to approve the offer letters for the easement at the April 1 0, 2000, Council meeting if they receive this confinuation and assurance wm MnlDOT. Also, at this time, I would like to request on behalf of the City that final design approval be made without an of the construction easements secured. This would allow the City to begin the advertisement for bids, which will help expedite the project into construction. As stated earlier, I feel we need to do everything we can to shorten the time frame on the remaining items on the project in order to quickly move the project into the bidding stages in order to save this year's construction season. This building violates flood plain (A11ic1e V of the Zoning Ordinance), wetland (Article VI of the Zoning Ordinance), and Zoning Ordinances (Articles X and XXIII of the Zoning Ordinance) as well as building code requirements. Your idea of putting pontoons or rafts Imder it is an attempt to obfuscate the issue. 2. The "fire place" room is an illegal structure and must be removed. 3. 111e materials strewn about the property must be cleaned up. 4. No structures may be used for human habitation. 5. All structures must comply with building code requirements. Although a building permit is not necessary for a smalJ agricultural building, which must be used for agricultural purposes and which may not be used for habitation, this does not release you from your obligation to comply with building code or zoning requirements. 6. Any development within the flood plain requires City Council approval of a Conditional Use Permit. A survey of the site showing the flood plain and any proposed improvements must be submitted for City Council approval. If you contend that the improvements are not in a flood plain, then you must provide a survey to the city verifying this. 7. Due to the need to determine the compliance of the "tool shed" with the zoning ordinance, it cannot currently be determined if this structure complies with City Code. A survey showing the location of this building in relation to the flood plain, wetland and property line must be provided to see if this building is legal. These wetlands are identified in the City ofChanhassen Wetland Inventory as a natural wetland A36-4(I). There is a minimum 75 foot structure setback from the edge of natural wetland. In order to determine the edge of the wetland, a wetland delineation must be performed prior to any development on the site. Additionally, any structures intended for human occupation must comply with city building and zoning ordinances. The intent of this memo is to provide background infonnation about this program. NPDES Phase I In November 1990, Phase I of the NPDES pennit was implemented. Phase I required cities with municipal stonn sewer systems serving populations over 100,000, construction sites above five acres, and industrial activities to obtain an NPDES pennit. The purpose of this pennit was to preserve, protect, and improve water quality. NPDES Phase II The NPDES program is now being expanded to Phase II. Phase II will require that cities with stann sewer systems that serve populations over 10,000 and under 100,000 to obtain an NPDES pennit. Construction projects that disturb 1 to 5 acres ofland will also be required to obtain an NPDES pennit. There are six control measures that will be required to be included in the Phase II stonnwater management plan for cities. These control measures include the fol1owing: · Public education · Public involvement · l11icit discharge detection and elimination · Construction site runoff control · Post construction stonn water management · Pol1ution prevention for municipal operations The MPCA will establish requirements for each of the control measures along with identifying a set of possible Best Management Practices (BMPs) to be used. The MPCA's schedule for identifying the program requirements and BMPs is not yet available. Once the MPCA has identified these Minneapolis. It is anticipated that many if not most of the cities' existing stonnwater management programs could be used to meet these requirements. Timeline By March 2003, each affected city must obtain NPDES Phase II pennit coverage. Once the MPCA identifies the program requirements and BMPs, cities wilJ need to submit an NOl to the MPCA for review prior to March 2003. The MPCA wilJ review the NOl and issue the NPDES Phase II pennit. The city will then have 5 years fÌ'Om the time they receive the Phase II pennit to implement the program outlined in the NO!. The timeline for the MPCA to identifY program requirements and BMPs is not yet available. Therefore, there is no action for the cities to take at this time until the MPCA develops these requirements. Summary In summary, the Phase II permit will require a stonnwater management program to be developed that addresses six specific control measures. The city will be required to develop a management plan to address these six control measures in a Notice of Intent prior to March 2003. It is anticipated that the city's stonnwater management plan win address the majority of these control measures. The NOl will then be reviewed by the MPCA and a Phase II pennit issued to the city. The city will then have 5 years to implement the NOl. The current undefined status ofthe NPDES Phase II program does not allow the cities to take fonnal action on pennit preparation at this time. The cities should anticipate the implementation of the Phase II program if they are undertaking stonnwater planning, but no other action is currently needed. The operating appropria- tion would increase annually by the lesser of the percentage increase in the Implicit Price Deflator (IPD) or 125 percent of the percentage increase of the Consumer Price Index (CPI). The appropriation would be paid by an amount of a city's HACA equal to the amount oftransit tax levied in the city. As a resun of using HACA, a city's levy would increase by the amount of HACA used for the transit appropriation. There wiil not be, however, an increase to taxpayers because there will be no transit levy. In some cities there could be a tax levy decrease because the transit levy is greater than the city's HACA and the difference is covered by state funds. The proposal achieves the goal of eliminating the transit levy. There is concern that transit funding is not dedicated and will be subject to the legislative appropriation process. There is also no authority to bond for capital improvements. The nature of the appropriation (open and standing), the inflator and the debt service appropriation have been amended into the proposal to address these concerns. Staff in cooperation with the Suburban Transit Authority wiil continue to work on the proposal. Those survey results along with staff and community input has shown us the critical need for a larger library in Chanha"sen. Your current study with MS&R will be able to assist you in establishing the size of a library to meet the needs of your growing community. AJ¡ we move into April and May, our board is planning the library system capital improvement expenditures for five years and the annual budget for 2001. In order to budget in a deliberate and thoughtful way, we want to know and consider your plan and timeline for this new library. As members of the Carver County Library Board, we request a joint meeting with the City Council in April. This meeting would give us the opportunity to work togetht:r in the interest ofChanhassen and Carver County citizens to establish a timeline and financial structure for the new library. DATE: March 27. 2000 RESOLUTION NO: 2000-24 CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA MOTION BY: Senn SECONDED BY: Labatt A RESOLUTION SUPPORTING SCHOOL DISTRICT 112 GOAL TO LOCATE SCHOOL FACILITIES WITHIN THE CITY OF CHANHASSEN WHEREAS, School District 112 is faced with increasing enrollments and a declining availability of space to educate youth within the district; and WHEREAS, School District 112 is currently evaluating opportunities for the construction of multiple facilities to meet these space requirements; and WHEREAS, the population center and growth areas within the district are general1y located within the City ofChanhassen; and WHEREAS, a great number of city residents located within District 112 have encouraged the city to work with District 112 to facilitate the location of these facilities within the city; and WHEREAS, City of Chanhassen taxpayers contributed a great amount of voter support and subsequent tax dollars to the recent referendum to construct these same middle school facilities. NOW, THEREFORE, BElT RESOLVED that the Chanhassen City Council hereby strongly supports School District 112 to locate their middle school facilities within the City of Chanhassen in order to better serve current and future growth within the district and will actively work with District 112 to explore options for partnership.
