1977 05 23 I I I SPECIAL CHANHASSEN CITY COUNCIL MEETING MAY 23, 1977 Mayor Hobbs called the meeting to order at 8:00 p.m. with the following members present: Councilmen Neveaux, Geving, and Pearson. Councilman Waritz came at 8:30 p.m. The meeting was opened with the Pledge to the Flag. APPROVAL OF AGENDA: Councilman Neveaux moved to approve the agenda as presented. Motion seconded by Councilman Pearson. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Geving, and Neveaux. No negative votes. Motion carried. MINUTES: Councilman Pearson moved to approve the May 16, 1977, Council minutes. Motion seconded by Councilman Geving. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, and Geving. No negative votes. Motion carried. PUBLIC HEARING CRESTVIEW DRIVE PUBLIC STREET AND WATER IMPROVEMENTS Mayor Hobbs called the public hearing to order at 8:10 p.m. The following interested persons were present: Arnon Reese, 2080 Crestview Drive Clarke Nicholson, 2051 Crestview Drive Edwin Mattson, 2020 Crestview Drive Ingvald Eidem, 2050 Crestview Drive Mr. and Mrs. Halvor Bang, 2110 Crestview Drive James Bixler, 2081 Crestview Drive Craig Mertz, 510 Laredo Lane Dan Nikolai, 6570 Galpin Blvd. Bill Brezinsky Russell Larson Bill Brezinsky explained the proposed project. The existing road is within the right-of-way that Mr. Bang conveyed in 1973. The existing road is 18-22 feet wide. The Engineer does not feel a 28 foot wide road would be necessary because it will ultimately serve only ten homes. A 20 foot wide road would be adequate to serve the area. The cul-de-sac is 100 foot square and is more than adequate. The lateral unit cost is $1,439.90 to serve the eight existing homes and two additional units. In additional to the lateral unit cost is the trunk availability cost of $486.40 for a total unit cost of $1,926.40. The Engineer recommended the City accept the road right-of-way as tendered by Mr. Bang in 1973. By not extending the water line to the Bixler, Bang, and McCullough properties on the west, the estimated unit cost would be $1,401.10 plus the trunk availability charge. The Bangs, Bixlers, and McCulloughs are not interested in the water extension at this time. Councilman Pearson moved to close the public hearing. Motion seconded by Councilman Neveaux. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Waritz. No negative votes. Hearing closed at 8:50 p.m. City Council Meeting May 23, 1977 -2- CRESTVIEW DRIVE: RESOLUTION #77-25: Councilman Neveaux moved the adoption of a resolution that the City Council accept the right-of-way conveyance I from Mr. and Mrs. Halvor Bang. The description of the right-of-way convenance tendered by Mr. and Mrs. Bang is that which is shown between the red lines on public hearing Exhibit A dated May 23, 1977. Resolution seconded by Councilman Geving. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No negative votes. Motion carried. CRESTVIEW DRIVE WATER AND STREET IMPROVEMENT PROJECT 77-1: RESOLUTION #77-26: Councilman Pearson moved the adoption of a resolution to authorize the project to extend the watermain from the existing six inch plug at County Road 117 (Galpin Blvd.) to a point opposite the southwesterly property line of the I. Eidam property so as to serve the A. Reese property. Resolution seconded by Councilman Waritz. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No negative votes. Motion carried. RESOLUTION #77-27: Councilman Neveaux moved the adoption of a resolution to authorize the Engineer to advertise for bids on Project 77-1 as per plans submitted to the Council on April 27, 1977. Resolution seconded by Councilman Waritz. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Waritz. No negative votes. Motion carried. NOISE ORDINANCE: Councilman Neveaux moved to place the Noise I Ordinance amendment as proposed on first reading with the Attorney instructed to work out the specific noise level restrictions with Councilman Pearson and/or other compentent sound engineers. Motion seconded by Councilman Waritz. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No negative votes. Motion carried. AUDIT SERVICE 1976: Councilman Neveaux moved to accept the recommendation of the City Manager in regard to the retaining of the firm M. J. Long Company ~o complete the audit services for the City of Chanhassen for 1976. Motion seconded by Councilman Geving. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Waritz. No negative votes. Motion carried. LAKE ANN PARK FEES - 1977: The City Manager suggested the city request additional police service during the summer season at an approximate cost of $10,000. A portion of the $10,000 could be funded by Anti-Recessionary Funds and Allocation of Special State Aids for Police of approximately $6,500.00. Councilman Waritz suggested that a groundsman be hired through the county to oversee vandalism in the park. RESOLUTION #77-28: Councilman Waritz moved the adoption of a resolution setting the fees for Lake Ann Park for 1977 as follows: I Seasonal resident stickers $1.00 per car, non-residents $10.00 per seasonal sticker, cars without stickers will be charged $1.00 at the gate entrance and Wednesday night softball players can purchase a $1.00 seasonal sticker marked "Wednesday Night Only" for league softball. Resolution seconded by Councilman Neveaux. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Waritz, and Geving. No negative votes. Motion carried. I I I City Council Meeting May 23, 1977 -3- Councilman Neveaux moved that special state aids and anti-recessionary funds be used for purchasing additional police protection during the summer months to be assigned by the City Manager. Motion seconded by Councilman Geving. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Waritz. No negative votes. Motion carried. EVERYTHING GOES: The Chanhassen team placed third in the "Everything Goes" competition last Friday evening. A motion was made by Councilman Pearson and seconded by Councilman Neveaux that a certificate of appreciation along with a letter be sent to the participants. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Waritz. No negative votes. Motion carried. CHANHASSEN POSTAL MAILING ADDRESSES: Signed petitions should be received by the City by June 6. GATE AT MINNETONKA WEST JUNIOR HIGH: The school is experiencing vandalism on their property adjacent to the city water tower and want to fence the east side of their property. The city water department personnel use the school property for access to the well property. The school district has asked the city to install a gate at the city property. The cost would be $570.00 for 50 feet of fencing and a gate. Councilman Geving moved to direct the City Manager to negotiate with Minnetonka School District for the fencing of the gate or the total fencing on a one-half basis. Motion seconded by Councilman Neveaux. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Waritz. No negative votes. Motion carried. TREE INSPECTOR 1977: The City Manager will be hiring a Tree Inspector for the summer. The salary will come out of the Maintenance Department Budget. STREET LIGHT POLICY: The City Manager will research the City Street Lighting Policy. PLANNING INTERN: The City has received approval through CETA Funding for the position of Planning Intern for an 18 month period of time. This will be on the Council Agenda for June 6. HRA MEETING: Council members were invited to attend an HRA meeting on Tuesday, May 24 at City Hall. CARVER BEACH BOAT LANDING: The Carver Beach Development Guide shows a boat landing area and the paving plan shows a boat access area. The contractor for the sewer and water project has put in rock to act as rip rap. An asphalt area could be installed next to the rip rap with parking for three or four boat trailers. This would be funded through the sewer and water project. The Council would like to discuss this with the City Engineer. POLICE CONTRACT: Mayor Hobbs gave a report on the meeting with the Carver County Board of Commissioners. City Council Meeting May 23, 1977 -4- councilman Waritz moved to adjourn.
