The meeting was opened with the Pledge to the Flag. EAST IDTUS LAKE FEASIBILITY STUDY: Bill Brezinsky e:xplained the feasibility study. The Engineers are considering the feasibility of providing sanitary sewer and water service to all houses and vacant lots in the area east and north of Lotus Lake. They have divided the area into three smaller areas. Area A is south of Colonial Grove on the east side of Lotus Lake. The best way to serve this area with sewer is to install a line along the lake shore . Water would be supplied to all existing houses from the line along Highway 101. He suggested that water not be run to the hones that are a long distance from the water line . A peti tion has been received fran the Colonial Grove area signed by 12 of the 20 existing homeowners requesting sewer and water. There are presently 21 vacant lots in Colonial Grove and the owner of 17 of these lots has asked for sewer and water and in addition has asked that consideration be given to concrete curb and gutter. Estimated costs are: Sanitary Sewer Lateral $ 1,935 Sanitary Sewer Trunk 506 Water Lateral 1,461 Water Trunk 602 Sub-Total 4,493 Estimated Street Costs 1,548 Concrete Curb and Gutter 652 'Ibtal Estimated Cost 6,693 The $6,693 would be the estimated cost per lot in Colonial Grove. SANITARY SEWER AND WATER HOOK UP CHARGES: The City Attorney advised the Council that a resolution will have to be enacted to change the aIIDunt of the hook up charges. VARIANCE REQIÆST - ED HJERMSTAD: .Mr. Hjermstad had a fire at his cabin at 9241 Lake Riley Blvd. which destroyed the majority of the structure. The City Attorney stated that .Mr. Hjermstad has no imnediate plans to rebuild but is thinking of closing off the least damaged portion of the structure and using it. He will ultimately raze the existing structure and fill in the backyard (lake side). The City Attorney Regular City Council M2eting April 19, 1976 -4- previously advised Mr. Hjermstad that his application for variance may be pre;mp,twe because under the building code he would have to build wi thin six IIDnths or the permi t expires. I Mr. Hjermstad is requesting a 20 foot variance to the front yard setback and a five foot variance to the west property line. The Board of Adjusbnents and Appeals has met on this variance request and reconrnended the Council deny the request. Mr. Hjermstad stated he wants to build his own hone on the lot and would like some assurance that he can get a building permit. He presented a petition signed by several of the neighbors requesting approval of the variances. The City Attorney suggested that before the Council take any action the Council should have a permit for filling near the lake from the Riley Purgatory Creek Watershed District. Mr. Hjermstad should attempt to structure the building to conform to the setback requirements of the ordinance. Councilman Shulstad left the meeting at 11:45 p.m. ASSESSMENT DEFERRMENT REQUEST: Mr. Young, Attorney for Buesgens, was present to request the Council defer asseSSIrents of $13,960 on property located at 7701 Arboretum Blvd. over a five year period with interest at 8% per anum. I A motion was made by Councilman Neveaux and seconded by Councilman Kurvers to table action until May 3 and direct Buesgens Builders to comply with the request of the City Staff and additional information be available at that meeting. The Planning Corrmission on March 31, 1976, took no action on Devils Slide. The issue was whether it is to remain gravel or be paved. The Council's action on April 12, 1976, was to refer Devils Slide for further stu::ly. 'Ihe Planning Camnission approved Huron. to be paved and the Council disapproved Huron to be paved. 'Ihe Planning Camnission approved blacktopping Ivy to a 14 foot width and designated it one way. The Council approved the sæœ on April 12, 1976. The Planning Corrmission approved paving of West 69th Street from Iroquois to Carver Beach Road to an 18 foot width. The Council approved the same. The Planning Corrmission approved paving Elm Road to a 14 foot width and designating ita one way street from west to east. The Council approved the same. The Planning Commission approved paving Iroquois to an 18 foot width. The Council approved the sane. The Planning Commission took no action on the discontinuance for street use of west 69th Street from Iroquois to Huron. The Council also took no action. The Planning Camnission took no action on West 67th Street on the terrporary cul-de-sac which will be abandoned when the connection is made. The Planning Cornmission took no action on Forest Road. 'Ihe City Attorney explained that the issue at this hearing is to deal with improvements on Huron, Ivy, and West 69th Street. The Council should also make the deletions from the project. Public Hearing April 19, 1976 -2- Councilman Neveaux - I was just wondering how the assessm=nt procedqre is going to be handled on people that have blacktop streets and those that don't. Bill Brezinsky - The cost of blacktopping would be separated out. The people who are on a gravel road would have a srraller assessment. I The hearing was opened for OJIT'[[1ents from the floor. Nadine Collver - We were wondering about this division of blacktopping and gravel. Don't the people that live on a street have anything to say about what goes in front of their house or is it just automatic blacktop or gravel or the way it is or what is the deal on that? We have fought against sewer and water from the beginning because we did not want the ecology interrupted out there. We had blacktop streets in Minneapolis and water and we moved out here to get rid of it. Now we are facing the same thing again. 'We didn't want it. 'Well, we got it so we are going to go along with it. If you are going to cane in and do a project why in the world don I t you do every road the same in the place. What is the difference? I just wonder what the score is. How cane that all these little streets that are now being added how come it wasn I t in the original plans of this improvement? Mayor Klingelhutz - The feasibility stu::ly was taken out of the Carver Beach Guide Plan. The Carver Beach Association plus City staff, Engineers and Planning Canrnission made the Guide Plan. Nadine Collver - The Carver Beach Property CMners Association does not speak for all property owners. It speaks only for a certain group that belongs to that association. Surely the rest of the ta:xpayers out there have something to say just because they don't belong to that association'l I feel that the government in Chanhassen does a wonderful job. I don I t think we need two governments. The Guide Plan says, but who says this Guide Plan is legal if it doesn't include the voice of all the people. It's not right. I am for Devils Slide being blacktopped. That is the worst road in Carver Beach. It has cost Chanhassen Village, I am sure, a lot of money to maintain it. I am sure the gravel washes out right away. It I s just a hopeless case. It really does need blacktopping. We don't especially want blacktopping up on Kiowa. Our gravel road is wonderful up there. If you are going to blacktop it let's blacktop the whole place and be done with it. Make everybodies assessment equal. M3.yor Klingelhutz - I pretty much agree with what you just said but I am only one voice here. I guess the public hearings that were held previously probably were the time you should have come and spoke your peace. Jack Ernst - I will have to say that it does look like special treatment for some areas. That part I will have to agree with. I have no quarrel as seldan as I drive the road I don't have any problem there but I have to agree with the lady that it does seem like certain segrænts are getting special treatment and I believe that that was sanewhat brought out at some of the hearings. Council.rran Hobbs - Just a couple of co:rtTflents to put everything in perspective. First of all as far as the Carver Beach Guide Plan it was the Association along with the Planning Commission, along with the City Staff, along with the Engineers and it's my understanding that there were public hearings held in developnent of this Guide Plan. It wasn I t three or four people telling everyone what to do. I think there were public hearings held on the sewer and water and street irrprovenent project. The Guide Plan was irrplemented and then the sewer project was separate using some of the basis I - ~ I I I Public Hearing April 19, 1976 -3- that were drafted on the Guide Plan as a guide on how they were going to approach it. As far as the particular roads go that we are discussing tonight Devils Slide, the Council last MJnday night requested the Engineers to study changing the grade on the road. I think. it was the feeling of this Council that we all know that that road is very steep and it has a very sharp curve and to sirrply go in and pave it doesn't solve the problem. We haven't changed our basic attitude on the fact that it shows paved up there and it may well be paved. We are asking, let's take another look ('.an we straighten it out, can we get rid of so:rre of that grade because I think. as the people that drive it know, it's certainly not a good road now by the same token in the middle of December if we have a light rain and it freezes over on the gravel you are in no better shape when you go down there. As far as Huron goes I think. it was the feeling of the majority of the Council that a t this particular point in time they agree with the philosophy of the Carver Beach Development Guide and we felt that it should have a year or two to see if it's going to work itself out in terms of ownership, the way the property developes down there, whether these parcels are canbined and people front on Huron and Carver Beach Road or they stay separate. I for one voted to leave the road gravel at this particular point in tiIœ and said that as the years go by we may well change our minds but I felt that it was premature at this tiIœ to change that plan until we see what happens. I don' tthink. anybody can tell you for fact what is going to happen but the decisions that were made up here were in no way made in terms of who's going to get a gravel road or blacktop road anyrrore than who's going to get sewer or who's going to get water. We were trying to look at the broad scope on how we can best serve this whole area. Nadine Collver - Some of those roads don't really have to be blacktopped because there isn't that much traffic on them. There isn't that much traffic on Kiowa now. O1arles Collver - I wonder why we didn't know about this meeting a week ago. The one that you say you had on M::>nday night. This is the only notice that we have had of a meeting. Was it all cut and dried before this meeting tonight? Nadine Collver - We did not get any notices. I don't know why we didn't get it because I am sure we would have been there with bells on. That's why there is so much trouble now. There is so much misunderstanding on the beach. There are so rrany people who feel that when a letter or soræthing is written by the association it should be signed by the people who belong to that association and were at that ræeting. The rest of the proPerty owners and taxpayers resent being represented by someone that they ddldn't vote for because we don't belong to that association. We didn't know for sure what was going on here. This Guide Plan, this is something new. I am sure we should have all had a copy and read it thoroughly and debated about the part that we didn't understand. It's kind of late now, I know. O1arles Collver - I am through with the homeowners association. They are obsolete. They should be out of business years ago when our Council and Mayor first came in here. Why can't you stand up to somebody like that? Councilman Kurvers - I just want to answer you. Your corrments are valid and the .Mayor and myself have been on your side 100% because I think. you people that live out there and don't want the association have just Public Hearing April 19, 1976 -4- as much right as the people that belong to the association. We have been on your side and we need rrore people like you because I think that is governrænt not just any railroad and I agree with you that is what took place in this instance. I Jack Ernst - I believe the Engineer said that the people that lived along there would benefit from a little lower cost, is that what I understood? Bill Brezinsky - The people who have gravel roads instead of blacktop will be assessed less. Jack Ernst - I am penalized because the people down below need to get out. They get a break on their assessment and I don't. I have no objections to that other one not being oiled but the way I understood this was an overall deal where and now all at once not only are they getting treated a little bit differently than the rest. They are also be be getting their way they are getting a smaller assessrænt. Councilman Neveaux - I don't think anybody is being treated differently. Everybody is being treated equally for benefit received. The people that have been discussed as having been getting a better break on it are not getting a road into their property. I feel they are getting the short end of the stick as far as the project goes. At some point in time we are going to have to put a blacktop road in there. It might be Huron in the future, it might be some road from the north. Tha t 's the reason I voted not to put blacktop on Huron because I wasn't sure that that was going to be the rrain access into that northeast area of Carver Beach at this time. We might find in a year or two years as development progresses that Huron is the only access into that particular part of Carver Beach. If that happens those people will pay that assessment for Huron. Right now they are not getting that benefit. They are not getting a blacktop street so why should they pay for a blacktop street. The rest of the residents are getting blacktop streets. I think they should pay for it. I Jerry Heydt - I would just as soon have Devils Slide blacktopped. As it is I am not going to get it blacktopped. I am wondering if a year from now you decide to blacktop it and I get assessed for it, will I get assessed for it at the same price that I am getting deducted for it now? They will knock maybe $300 to $400 off now because I will have some blacktop to my place but not all of it. They pave Devils Slide do I just have to pay the $300 or whatever is knocked off now or do I get socked the whole assessment? Charles Collver - If they blacktop these roads and leave Devils Slide without blacktop, have your engineers made a study of where the water is going to? There is not going to be a Devils Slide anyrrore. If all of this blacktop water canes down this blacktop road down onto Devils Slide there is not going to be a Devils Slide. It's going to be down in the bottom of lDtus Lake. Mayor Klingelhutz - I think the recanrændation of the Engineer to pave Devils Slide is valid. I think Devils Slide should be paved. I can see that there can be some improvements on Devils Slide but I am wondering if it isn I t to late to think about those I improvements now that it shouldn't be paved with the job at the present time. Bill Brezinsky - We are stu::lying it now. We are looking into the possibility of maybe lengthing or soræhow making the slope less steep on Devils Slide. We expect to have that stu::ly done soon along with a drainage study of the area. When we get that completed we will give it to the Council and the Council will again consider it. I I I Public Hearing April 19, 1976 -5- We are just saying for the tirœ being right now we are not going to pave it but we feel we will have this study done in time to pave Devils Slide on this project. Nadine Cbllver - These roads that are not being blacktopped, when they are blacktopped will this cost go allover the beach again? .Mayor Klingelhutz - Tb the benefitted property owners. Ml::'s. Gordon 'Ibck - I live down on the corner of 66th and Huron. You say Huron is not going to be paved. What is going to become of the ditches along the side? Those ditches have not been dug out in the last two years and the water is running allover our property in the front. What is going to be done about that? Bill Brezinsky - We plan on cleaning up those ditches and improving them. We hadn't planned on piping the water to the lake. This ditch can be designed so that the water will be slowed and there won't be as much erosion as there is now. We considered putting a pipe in and piping the water down to the lake. What happens is that the water gets down there faster through the pipe and erodes the lake shore and there is a lot of siltation on the lake. Nadine Collver - Is there any plans in the future to run 67th street all the way through? Bill Brezinsky - The plans now are to build a cul-de-sac at the end. Nadine Collver - The reason why I ask is because of the tine we had the tornado the main road was blocked. There was no place to go. Charles Collver - Have you found a location for a cul-de-sac on Kiowa? Bill Brezinsky - We are still trying to find a place to put one. Charles Collver - I will donate enough property there to make one. If you can find a way to put it in. I hate to see it in the middle of the block but I guess that's what we are going to have to settle for. We do want snowplow service and we do want them to get in there and be able to get out again. There is too much of a drop off at the end of Kiowa for a cul-de-sac. Mayor Klingelhutz - I wish you people had been here sooner and made the same comœnts you did at the time of the first public hearing was held. I think it could have changed the picture of a lot of things. It could have saved a lot of problems for us. I think we have been quite accorrmodating. If it ever happens again don't wait until the last public hearing, speak your peace at the first public hearing so that your imput can do some good. Once the decision and the bids are made it's awful hard to change a project. A notion was made by Councilman Neveaux and seconded by Councilman Hobbs to close the public hearing. Mayor Klingelhutz called the continuation of public hearing to order with the following members present: Councilræn Hobbs, Neveaux, Shulstad, and Kurvers. The following interested persons were present: Henry Wrase, 8175 Hazeltine Blvd., Chaska Bernard Schneider, 220 West 78th St., Chanhassen I Bernie Schneider - The ŒD net this afternoon and they have made a IIDtion and seconded that the Cbuncil close the public hearing on the ŒD Parking lDt and defer any action until the ŒD would make a reconmendation to the Council which will be sul:rni tted wi thin two weeks. There is no particular purpose in keeping the hearing open any longer and we are very close to an agreement of all the affected property owners and this should be resolved within the next week and we will cone in with a total program and costs for the Council's consideration. Russell Larson - If they coræ in with a proposal joined in by all of the property owners which is acceptable to the Council and there is a change even an enlargenent of the cost aspect of it, if the City has the consent of all of the property owners in the project the public hearing can be waived. Bruce Pankonin - The IIDSt conterrporary of the ŒD plans has the same number of parking spaces that we originally started with. The shape is a little bit different. I Bernie Schneider - What the ŒO will be doing is making a proposal to the City Council and the City Council can either accept or reject it or make recormnendations and refer it back to the ŒD. I think that this would be in the best interests of all at this particular time that the hearing be closed because there is no point in continuing it any further. There is no outside interest outside of the affected property owners, business association, and the City Council. The parking lot is going to be the same size as we originally stated. There has been a change in the property owners within the last IIDnth and this has sonewhat delayed it.
