1976 05 03 I I I REGUIAR ŒANHASSEN CITY COUNCIL MEETING MAY 3, 1976 Mayor KlingeJhutz called the rœeting to order at 8: 00 p.m. with the following members present: Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. The meeting was opened wi th the Pledge to the Flag. MINUTES: A mtion was made by Councilman Kurvers and seconded by Council.man Hobbs to approve the April 12, 1976, Chan View, Erie, and West 77th Street and Stonn Sewer Improvements Public Hearing minutes. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. MJtion carried. A rrotion was made by Councilman Neveaux and seconded by Councilman Kurvers to approve the April 12, 1976, Special Council minutes. A mtion was made by Councilm:m Kurvers and seconded by Councilman Neveaux to approve the Central Business District Parking lot Public Hearing minutes of April 19, 1976. A motion was rrade by Councilman Kurvers and seconded by Councilman Hobbs to note the January 22, 1976, Bicentennial Cormnission minutes. A mtion was made by Councilman Hobbs and seconded by Councilman Kurvers to note the April 6, 1976, Park and Recreation Comnission minutes. The following voted in favor: Mayor KlingeJhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. MJtion carried. ANIMAL CONTROL ORDINANCE: Dick Matthews and .M:trlene Roufs of the Ibg Ordinance Ad Hoc Ccrnrnittee were present. A motion was made by Councilman Neveaux and seconded by Councilman Hobbs to table action on the Animal Control Ordinance until the next regular meeting during which meeting the Council will spend the first fifteen minutes minutes on the question of a city controlled enforcement officer and another fifteen minutes discussing the list of changes that have been discussed over the last Council meetings. The following voted in favor: Mlyor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. MJtion carried. CENTRAL BUSINESS DISTRICT PARKING IDT: Bernie Schneider and Harry Pauly were present. The CBD Cormnittee met today and recornrrended that the City Council not be involved in Regular Council Meeting May 3, 1976 -2- the business district renovation because not all the property owners are in agreerrent wi th the contributing of the land or the selling of the land to the parking district. Bernie Schneider stated they offered to go it alone without any City financing. A lIDtion was made by Councilman Hobbs and seconded by Councilman Shulstad to take no action at this tirre and the people involved be instructed to work with the City Offices in going through the appropriate steps. The following voted in favor: Mayor KlingeJhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. M::Jtion carried. I A mtion was made by Councilman Hobbs and seconded by Councilman Kurvers to instruct the City Attorney to purchase an abstract on the above rrentioned property owned by the City and cause it to be examined. PIDJECT 75-11: Mr. and Mrs. Ted deLancey, Fred Coulter, Paul Rojina, and Don schmieg were present. A lIDtion was made by Councilrran Shulstad and seconded by Councilman Hobbs to direct the City Engineer to present this plan to the Riley Purgatory Creek watershed District for review before action is taken by the Council. The following voted in favor: Mayor KlingeJhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. M::Jtion carried. ASSESSMENT DEFERMENT - BUESGENS OFFICE BUILDING: Betty Buesgens was present I asking the Council to defer assessments over a three to five year period. The City Attorney and Administrator will rreet with Betty Buesgens to go over her financial staterrent and make a recomnendation to the Council. A mtion was made by Councilman Hobbs and seconded by Councilrran Neveaux to table action until the next regular rreeting. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. M::Jtion carried. EXCAVATING PERMIT - DON HANUS: Con Hanus was present requesting an excavation pe:rrni t to excavate 2500 cubic yards of dirt from his property on West 79th Street. A motion was made by Councilman Shulstad and seconded by Councilman Neveaux that the excavating permit be authorized in accordance with the Administrator IS recommendations and that the applicant agrees to escrow $1,500 to pay the $110.00 excavating fee should the applicant IS developrrent plan be denied. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. M::Jtion carried. MINNEWASHTA CREEK FIRST ADDITION - FINAL PLAT: Samuel Bloom, Attorney, and Con Berkey were present. RESOLUTION #76-36: Mayor Klingelhutz mved the adoption of a resolution to approve the final plat for Minnewashta Creek First Addition and payment of $823.50 as a total settlerrent for the utility easement as shovm on the plat. Resolution seconded by Councilman Neveaux. The following voted in favor: Mayor Klingelhutz, Councilmen Neveaux, Shulstad, and Kurvers. Councilman Hobbs voted no. M::Jtion carried. I I I I Regular Council ~eting May 3, 1976 -3- PARK AND RECREATION COM1ISSION APPOINTMENTS: A IIDtion was made by Councilman NeveauX and seconded by Councilrran Shulstad to accept the recomrændations of the Park and Recreation Camnission and appoint Phyllis Pope for a full three year term beginning January 1, 1976, and Shirley Chellis to fill the unexpired three year tenn of IMight Leatham expiring on December 31, 1976. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. MJtion carried. HOUSING REDEVEIDPMENT AUI'HORITY: A IIDtion was made by Councilman Shulstad and seconded by Councilman Hobbs to accept the resignation of Gail Stone frc:rn the H.R.A. and City Newsletter with regret. The following voted in favor: Mayor Klingelhutz, CouncilIœn Hobbs, Neveaux, Shulstad, and Kurvers. No negative votes. M::Jtion carried.
