1976 08 17 CONTINUATION OF REGULAR COUNCIL MEETING AUGUST 17, 1976 I Mayor Klingelhutz reconvened the meeting at 8:00 p.m. with the following members present: Councilmen Hobbs, Neveaux, and Shulstad. Councilman Kurvers was absent. ORDINANCE AMENDMENT, POSSESSION AND CONaJMPTION OF LIQUOR ON PUBLIC AND SEMI-PUBLIC PROPERTY: A motion was made by Councilman Shulstad and seconded by Councilman Neveaux that City Staff be directed to place on first reading an ordinance amendment, possession and consumption of liquor on public and semi-public property. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. No negative votes. Motion carried. A motion was made by Councilman Shulstad and seconded by Councilman Hobbs to place on first reading an ordinance amendment which would require review by the Council of any liquor license where it has been established that violations of the ordinance during the current license year has occurred by patrons leaving the licensed premise and providing penalites against the license holder for the allowance of such. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. No negative votes. Motion carried. I FIRE DEPARTMENT PENSION: RESOLUTION #76-58: Councilman Neveaux moved the adoption of a resolution approving Minnesota Laws 1976, Chapter 71 applying to Firemen's Service Pensions. Resolution seconded by Councilman Shulstad. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. Nö negative votes. Motion carried. MTC - ROUTE 53J: RESOLUTION #76-59: Councilman Shulstad moved the adoption of a resolution stating that it is the Metropolitan Transit Commission's job to negotiate with Mr. Holter to allow his bus to stop in Chanhassen. If they cannot do this Chanhassen requests that we be dropped from the MTC mill levy in Carver County and.· failing that , action be instituted to recóver such. Resolution seconded. by Councilman Neveaux. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. No negative votes. Motion carried. MEMBERSHIP ON THE SIGN COMMITTEE: Councilman Shulstad advised the Council that someone should replace him on the Sign Committee. It was decided that the committee will submit names to the Council. I POLICE CONTRACT: Mayor Klingelhutz reported on a County Taskforce meeting he attended. The City of Chaska did not agree with the proposal that was previously submitted. A meeting is being held this evening to try to get the townships to contract with the county in excess of the three mill levy for patrol service equal to about 1 mill. Mayor Klingelhutz - It looks to me that if Chanhassen is going to have to pay on the hourly basis that is set up by the accounting firm that did this last accounting which would be about $14.38 per hour, our police contract with the county would be approximately $145,000. I personally would have to say Chanhassen I Council Meeting August 17, 1976 -2- is going to get their own police force. It is something we are going to have to think about with the budget coming up. I A motion was made by Councilman Hobbs and seconded by Councilman Shulstad that the Council direct the Administrator to investigate the possibility and feasibility in forming our own police department or the possibility of a joint powers agreement with other communities in the area. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. No negative votes. Motion carried. 1976 SPECIAL ASSESSMENTS: Bill Brezinsky, Bill Schoell, and Frank Laska were present to discuss assessment procedures for Projects 74-1A, 75-2, 75-3, and 75-8. RESOLUTION #76-60·: Councilman Hobbs moved the adoption of a resolution to set a policy for interest rates on special assessments by adding l~% to the bond sale interest rate and rounding that off to the nearest ~% provided it does not exceed 8% interest. Resolution seconded by Councilman Shulstad. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. No negative votes. Motion carried. . . A motion was made by Councilman Hobbs and seconded by Councilman Neveaux to set the interest rate on Projects 74-1A, 75-2, 75-3, and 75-8 at 7~ percent. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. No negative votes. Motion carried. I SPECIAL COUNCIL MEETING: Mayor Klingelhutz called a special meeting for August 30, 1976, at 8:00 p.m. to set dates for the assessment hearings. A motion was made by Councilman Neveaux and seconded by Councilman Shulstad to adjourn. The following voted in favor: Mayor Klingelhutz, Councilmen Hobbs, Neveaux, and Shulstad. No negative votes.
