CONTINUATION OF THE SEPTEMBER 20, 1976, COUNCIL MEETING ON
SEPTEMBER 21, 1976
Mayor Klingelhutz called the meeting to order with the following members
present: Councilmen Neveaux and Waritz. Councilmen Hobbs and Kurvers
were absent. The meeting was opened with the Pledge to the Flag.
SIGN REQUEST - ST. HUBERT'S CHURCH: The City has received a request for
a sign permit to erect an II' x 9' sign on the southwest corner of the
property.
A motion was made by Councilman Neveaux and seconded by Councilman Waritz
to approve the sign permit request as presented. The following voted
in favor: Mayor Klingelhutz,Councilmen Neveaux and Waritz. No
negative votes. Motion carried.
ARBORETUM DRIVE - REQUEST FOR ONE WAY DESIGNATION FOR SEPTEMBER 25, 1976:
The Arboretum has requested that Arboretum Drive be designated as a
one-way street for Saturday, September 25, 1976, between the hours of
10:00 a.m. and 4:00 p.m. Staff recommended the Council authorize
the designation with the condition that four uniformed officers be
obtained to control ingress and egress.
A motion was made by Councilman Neveaux and seconded by Councilman Waritz
to accept staff's recommendation and allow the Arboretum Drive one-way
designation for the date of Saturday, September 25, 1976, from the
hours of 10:00 a.m. to 4:00 p.m. The following voted in favor: Mayor
Klingelhutz, Councilmen Neveaux and Waritz. No negative votes. Motion
carried.
EAST LOTUS LAKE SEWER PROJECT: The City Attorney asked for
authorization to negotiate with Eden Prairie to hook up the East Lotus
Lake Sewer to the Eden prairie trunk sewer line.
A motion was made by Councilman Neveaux and seconded by Councilman Waritz
to authorize the City Attorney to ne cptiatewi th Eden Prairie between
$19,295 and $25,030. The following voted in favor: Mayor Klingelhutz,
Councilmen Neveaux and Waritz. No negative votes. Motion carried.
COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION: The City has been
notified by HUD that the Community Development Block Grant for Carver
Beach has been found ineligible for two reasons, 1) use of~the funds
for special assessments, and 2) the project is in progress. The
City has spent approximately $3,000 on this grant application. Staff
recommended that the Council pass a resolution requesting HUD to
reconsider their position based on staff's report of· September 20,
1976, and to request our Federal Legislators to help in this for
reconsideration.
RESOLUTION #76-71: Councilman Waritz moved the adoption of a resolution
requesting HUD to reconsider their present position on the City's
Community Development Block Grant for the reasons stated in the
Administrator's memorandum dated September 20, 1976. Resolution
seconded by Councilman Neveaux. The following voted in favor: Mayor
Klingelhutz, Councilmen Neveaux and Waritz. No negative votes. Motion
carried.

ERIE AVENUE SEWER PROJECT 75-7: Bill Brezinsky explained the project
and requested authorization to advertise for bids. The total
estimated construction cost is $7,850.
RESOLUTION #76-72: Councilman Neveaux moved the adoption
resolution authorizing the City Engineer to advertise for
Project 75-7. Resolution seconded by Councilman Waritz.

WASTE CONTROL COMMISSION: The Council adopted a resolution on August
30, 1976, which Mayor Klingelhutz presented at a public hearing before
the Physical Development Committee of the Metropolitan Council. They
have agreed to complete the Lake Ann Interceptor by 1980. The City
will meet with the committee again Thursday, September 23 to discuss
the 201 study and engineering and specifications study monies allotted
for 1977 budget. Council members felt it would be a good idea to
invite Metro Council members to a meeting depending upon the outcome
of the meeting September 23.
MINN-KOTA PROJECT 7l-lE: The City Attorney has received a proposal
from the Minn-Kota attorney on settlement. This is outlined in a
memorandum dated September 20, 1976. The city has withheld $33,300.
Minn-Kota has filed a claim in arbitration seeking recovery of the
$33,300.
The City Engineer in a letter dated September 21, 1976, has inspected
the Red Cedar Point streets and found settlement in several areas I
which are due to lack of compaction by the contractor. The
estimated cost for this work is $3,500. This amount is not
included in the additional cost to the city due to the contractors
delay of $20,257.91.
The arbitration hearing is scheduled for Monday, September 27, 1976,
at 9:30 a.m. The Council felt the attorney could settle somewhere
between $17,713.47 and $18,263.47.
A motion was made by Councilman Neveaux and seconded by Councilman
Waritz that the attorney be authorized to negotiate prior to the
arbitration for the figures discussed this evening. The following
voted in favor: Mayor Klingelhutz, Councilmen Neveaux and Waritz.
No negative votes. Motion carried.
ACCOUNTING MACHINE: The Administrator discussed the accounting
machine and offered alternatives.
A motion was made by Councilman Neveaux and seconded by Councilman
Waritz to adjourn. The following voted in favor: Mayor Klingelhutz,
Councilmen Neveaux and Waritz. No negative votes. Meeting adjourned
at 9:30 p.m.
